AN ORDINANCE relating to the condemnation and appropriation of certain
private property for the opening and widening of North Street
! east of the intersection of North Street and Santa Fe Avenue
j designating a benefit district and providing for the appointment
i of commissioners to make an appraisement and to assess damages
and benefits on account of such condemnation.
ygHEREAS, pursuant to the provisions of Ordinance No. 3964 the City
Engineer of the City of Salina has made and filed in the office of
the City Clerk a survey and description of the private property to
be appropriated for the purpose of opening and widening North Street
as provided for in said ordinance, and
"HEREAS, in the opinion of the governing body of said city certain
property will be benefited by such proposed improvement and a benefit
district to include property specially benefited should be fixed and
commissioners to aptraise the land to be taken and to assess damages
and benefits therefor should be appointed as provided by law;
N0' ThEEFFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the following described tract or parcel of
land by and the same is hereby condemned and appropriated for the
purpose of opening and widening North Street in the City of Salina,
Kansas to -wit:
Commencing at the southwest corner of Lot 23, Block 16 in
Calkins Addition in the City of Salina, Kansas; thence east to
the southeast corner of said lot; thence north 12.5 feet; thence
northwesterly in a straight line to the northwest corner of said
lot; thence south to the point of beginning; being part of said
Lot 23, Block 10 in Calkins Addition.
Section 2. That all of the property lying within the benefit
district hereinafter described is, in the opinion of the Board of
Commissioners specially benefited by the condemnation of the land
described in Section 1 of this ordinance, and by the opening and
vridening of said North Street and that said benefit district be
and the same is hereby designated and fixed as follows:
Lots 1 to 46 inclusive in Block 10, Calkins Addition, Lots
2 to 28 inclusive (even numbers) on Fifth Street and Lots 1 to
27(odd numbers) on Fourth Street, Jones Addition, Lots 1 to 17
inclusive (odd numbers) on Santa Fe Avenue, Original Town of Salina;
Lots 1 to 18 inclusive on Fifth Street, Original Town of Salina;
Lots 2 to 18 inclusive (even numbers) on Fourth Street, Original
Town of Salina.
Section 3. That the City Attorney be and he is hereby authorized
and directed after this ordinance takes effect to present a written
application to the Judge of the District Court of Saline County,
Kansas, describing the property condemned as aforesaid, for such
improvements and setting out the benefit district as fixed herein,
and requesting the appointment of three commissioners to appraise

! to value of the property taken and to assess damages therefor, and

! to assess against the city at large the amount of the benefit, if

any, to the public generally and to assess against the property in

said benefit district the cost of such condemnation except that
portion assessed against the city at large as provided by laity.
Section 4. This ordinance shall take effect after its publica-
tion in the official city paper.
