I BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: I I Section 1. That the acceptance by the City of Salina of the prop sal of R. C. Snyder, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on October 27, 1930, which is hereby found and determined to be the lo`^rest and best bid for i such work, and tqe contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by the Mayor on October 27, 1930, for the construction of certain lateral sanitary sewers in Lateral Sanitary Sewer Districts No. 163 i and 164 as provided for in Ordinance No. 3971 at and for the unit prices contained in said proposal, ,^,hich proposal and contract are hereby referred to and made parts of this ordinance, be and the same i I is hereby ratified and confirmed, said proposal being w.rithin the 1 estimated cost of said improvements as shown by the sworn estimate of the City Engineer filed in the office of the City Clerk, which i estimates are hereby referred to and made a part of this ordinance. Section 2. That said lateral sanitary sewers shall be built and constructed in accordance with the plans and specifications there - 9 i fore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract entered into between the city and said contractor on October 27, 1930, which said plans, speci- fications, proposal and contract are hereby referred to and made parts of this ordinance, said work to be done and the material, g equipment, appliances and appurtenances necessary and required in I connection therewith to be performed and furnished in accordance vrith said plans and specifications, conditioned hot=ie`Jer upon the j furnishing by the contractor of the contract, maintenance and statutory bonds within the time required of said contract. Section 3. That temporary notes signed by the ,Ya -or and I - j attested by the City Clerk be issued from time to gime as the lrork progresses in the manner and form as required by law✓, the i total amount thereof not to exceed the contract price for such ­.Tork, such notes to bear interest not to exceed 4-1/2% per annum, and to be issued in such amounts and at such time as money for the payment of the cost of such ork may be required, such notes to be i issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. That the acceptance by the City of Salina of the proposal of R. C. Snyder, the "Contractor" as submitted to October 27, 19300 which is hereby the lowest and best bid for such by the Board of Commissioners of and signed on behalf of the city for the construction of certain Sanitary Sewer Districts No. 163 hereinafter referred to as the Board of Commissioners on 7 found and determined to be. work, and the contract awarded said city to said contractor by the Mayor on October 27, 1930, Lateral sanitary sewers in Lateral and 164 as provided for in Ordi- nance No. 3971 at and for the unit prices contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer filed in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. That said lateral sanitary sewers shall be built and constructed in accordance with the plans and specifica- tions therefore prepared by the City Engineer on file in the office Of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract entered into between the city and said contractor on October 27, 19303 which said plans, specifications, proposal and contract are hereby referred to and made parts of this ordinance, said work to be done and the material, equipment, appliances and appurtenances necessary and required in 3980 ------------------- 2. connection therewith to be le rformed and furnished in accordance with said plans and specifications, conditioned however upon the furnishing by the contractor of the contract, maintenance and statutory bonds .within the time required of said contract. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 4-1/* per annum, and to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
