3979 Sewer ImprovementsORDINANCE NO. 3979 _(P.ubli.shed---n_th.e Sa] ina T ounral_uP• 1930)_ i AN ORDII14ANCE ratifying and confirming a contract for the build- ing and construction of certain lateral sanitary sewers in Lateral Sanitary Sewer Districts No. 5-144-145-149 and 162 and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. that the acceptance by the City of Salina of the proposal of R. C. Snyder, hereinafter referred to as the "Contractor" as submitted to the Board of Cormr!issioners on October 13, 1930, which is hereby found and determined to be the lo,, -est and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by the .vZayor on "c'ober 13, 1930, for the construction of certain lateral sanitary sewers in Lateral Sanitary Sevier Districts No. 5, 144, 145, 149 and 162 as provided for in ordinance No. 3963 at and for the unit prices contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and c nfirmed, said proposal being v,ithin the estimated cost of said improvements as shown by the sworn estimate of the City Engineer filed in the of -'ice of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. That said lateral sanitary sewers shall be built and constructed in accordance vrith the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the .rroposal of said con- tractor and under the terms of said contract entered into be- tween the city and said contractor on October 13, 1930 which said plans, specifications, proposal and contract: are hereby referred to and made parts of this ordinance, said -ork to be done and the material, equipment, appliances and appurtenances necessary and required in connection therewith to be performed and furnished in accordance with said plans and specifications, conditioned however u-ccn the furnishing; by the contractor of the contract, maintenance and statutory bonds within the time required of said. contract. Section 3. That temporary notes signed by the Tayor and attested by the City Clerk be issued from time to ti7,e as the work x;rogresses in the manner and form as required by law, the total amount thereof not to exceed the contract trice for such ork, such notes to bear interest nto to exceed 4-1/2`"' per annum and to be issued in such amounts and at such time as money for the payment of the cost of such ^,(-rk may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 2. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 4-1/2% per annum and to be issued in such amounts and at such time as money for the payment of'the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
