AN ORDINANCE providing for and requiring the construction of
certain sidewalks along certain streets in the City of
Salina.
V,HEREAS, petitions each duly signed by ten or more citizens
of the Citv of Salina, have been filed in the office of the City
Clerk, praying for the construction of sidewalks along the streets,
and in front of and abutting upon the property, mentioned in the
following ordinance, and
'HEREAS, said petitions have been considered by the Board
of dvCommissioners of the City of Salina and have been found to
be sufficient and the side,,.alks hereinafter referred to are by
said Board of Commissioners deemed to be necessary; NO'%r THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That concrete sidewalks shall be and the same
are hereby ordered to be constructed and laid along the following
streets and in front of and abutting upon the following described
lots, tracts and pieces of land in the �'ity of Salina, said con-
crete sidewalks to be five feet in width, to -wit:
Along the north side of Johnstown Avenue in front of and
abutting upon the south side of Lot 13, Block 12, riverside
Park Addition.
Along the south side of Morrison Avenue in front of and
abutting upon the south side of Lots 6, 5 and the east 42 feet
of Lot 4 on Morrison Avenue in Block 23* Morrisons Third Addition.
Along the south side of Spruce Street in front of and
abutting upon the north side of Lot 14, 16, 18, 20, 22 and 24
on Spruce Street in Phillips Fourth Addition.
Along the west side of Seventh Street in front of and
abutting upon the east side of Lots 23, 4, 6, 8, 10, 12, 143,
16, 18 and 20 in Block 12 of the Episcopal Military Institute
Addition.
Along the west side of Seventh Street in front of and
abutting upon the east side of Lots 2, 4, 6, 8, 10, 12, 14,
169 18 and 20 in Block 13 of the Episcopal Military Institute
Addition.
Along the west side of Seventh Street in front of and
abutting upon the east side of Lot 29 4, 6, 89 10, 12, 14,
16, 18 and 20 in Block 24, Episcopal Military Institute
Addition
Section 2. That the sidewalks provided for in the preceding
sections of this ordinance shall be constructed and laid in
accordance with the provisions of Ordinance No. 2407 and Ordinance
No. 3509 and in accordance with the plans and specifications for
concrete sidewalks on file in the office of the City Engineer
and in the office of the City Clerk, pursuant to the provisions
of said Ordinance No. 3509, which plans and specifications have
been and are now hereby approved, the same to be constructed at
the grade to be furnished by the City Engineer.
Section 3. That the owners of each of the lots and parcels
of land described in the preceding sections of this ordinance be
and they are hereby ordered to construct in front of and abutting
upon said lots or parcels of land, and along the streets hereinabove
mentioned, concrete sidewalks as above provided for, and if any one
of them shall fail within 15 days from and after the publication
of this ordinance to construct such sidewalks, the City Engineer
shall prepare and file �,,.l_th the City Clerk detailed estimates under
oath of the cost of constructing such sidewalks and the Board of
Commissioners of said city, shall proceed to construct or cause to
be constructed such sidewalks as hereir- provided for and may let a
contract therefor, at a cost not to exceed the estimate of the City
Engineer, and shall assess the cost thereof against such 16ts or
parcels of land upon which such sidevralks shall abutt, according to
the front foot thereof, and such costs so assessed shall be duly
certified by the City Clerk to the County clerk of Saline County
to be collected as other taxes and assessments are collected. i
Section 4. This ordinance shall take effect and be in force
from and after its publication once in the official city paper.
