AN ORDINANCti%creating and defining certain lateral sanitary seiner
districts in the City of Salina designated as lateral sewer
districts No. 1621 and 164, providing for the construction of
lateral sanitary sewers in such districts and for the dost
thereof and for the levying of special assessments against the
property in such districts for the payment of such cost, and
for the issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Lateral Sewer vistrict No. 163. That there be
and there is hereby createda lateral sever district in the City
of Salina which shall be designated as lateral sewer district No.
163, and which shall include all of the following described property
in the City of Salina to -wit: The west 150 ft. of Lot 25 in Sur-
veyors Plat "G"; Lots 4, 6, 8, 10, 12, 14 and the east 90 ft. of
Lots 11 and 13 in Block 13 in Riverside Park Addition and Lots 1
to 7 inclusive in Block 2, Oakdale Addition.
Section 2. That it is necessary, and it is hereby ordered

that a lateral sanitary sewer with all necessary connections, man-
holes, flush tanks and other appurtenances be constructed and built

in and to serve said lateral sewer district No. 163 as created by
i
Section 1 of this ordinance, along the following described course,
i
to -wit:
Commencing at a manhole to be constructed on the existing
sanitary sewer in the intersection of Kansas Avenue and Ash Street;
thence south in Kansas Avenue as an 8" sewer to a manhole to be con-
structed in the intersection of Kansas Avenue and Johnstown Avenue;
thence west as an 8" sewer in Johnstown Avenue to a flush tank to
be constructed approximately 45 feet east of the east line of
Columbia Avenue.
Section 3. Lateral Sewer District No. 165. That there be
and there is hereby created a lateral sewer district in the City
of Salina, which shall be designated as Lateral Sewer District No.
164 and which shall. include all of the following described property
in the City of Salina, to -wit: Lots 17 to 40 inclusive in Block 3
in Riverside Park Addition.
Section 4. That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connections, man-
holes, flush tanks and other appurtenances be constructed and built
in and to serve said lateral sewer district No. 164 as created by
Section 3 of this ordinance, along the following described course,
to -wit: Commencing at an existing manhole in the alley in lock
8 in Riverside Park Addition 358 ft. north of north line of Elm
Street; thence north in said alley as an 8" sewer to a flush tank
to be constructed approximately 70 feet south of the south line
of riverside Drive.
Section 5. That the City Engineer shall on or before
the 20th day of October 1930, prepare and file in the office of the
City Clerk plans and specifications for the construction of Lateral
Sanitary Sewer provided for in•the preceding sections of this Ord-
inance which shall be of.proper character to serve the property lying
within the district within which such sewer is to be constructed and
shall on or before the same date, prepare and submit to the Board
of Commissioners detailed estimates under oath, of the cost thereof.
That thereafter the City Clerk shall advertise for three consecutive
days in the official city paper for sealed proposals for the build-
ing and construction of such sewer according to such plans and speci-
fications, •which proposals shall be filed with the City Clerk on or
before the time fixed in such notice at which time the Board of Com-
missioners may let a contract for the building and construction of
such sewer to the lov:iest and best responsible bidder or bidders
thereof, provided that such bids shall not exceed the estimated
cost thereof and provided further that said Board shall reserve
the right to reject any or all such proposals.
Section 6. That for the cost of building and constructing
such sewer, special assessments shall be made for the full cost
thereof, on all lots or pieces of land within the lateral sanitary
sewer district, within which such sewer shall be built, according
to the appraised value thereof, without regard to the improvements
or buildings thereon.
Section 7. After the passage and publication of this
ordinance, the Board of Commissioners shall appoint three disinterested
appraisers who after having taken an oath to make a true and impartial
appraisement of all lots or pieces of land liable to taxation for the
cost of such iYprovements, shall within five days after having been
notified of their appointment proceed to appraise all of the lots
or pieces of land within such district, liable to assessment and
taxation as aforesaid, without regard to the buildings or improve-
ments ther-on, and after maVing said appraisement shall return the
same to the Board of Commis--ioners of said city and said Board shall
designate a time for holding a special meeting of said Board for the
purpose of hearing any complaints that may be made as to the value
of any lot or piece of land appraised as aforesaid, of which special
session due notice shall be given in the official city paper, and
at which special session said Board may alter any valuation of
any lot or piece of land, if, in their opinion, the same has been
appraised too high or too low.
Section G. The special assessments herein provided for may
be paid by the person liable therefor in ten approximately equal
annual installments but the owner of any property liable to such
assessment may within thirty days from the date of determining the
amount assessed against his property pay the same in full and his
property shall not be liable for any assessment for the cost of
such improvements, and bonds as hereinafter provided for shall be
issued for the amount of the cost of such improvements remaining
unpaid at the end of thirty days from the time such assessment
is fixed.
Section 9. For the purpose of paying for the work and
improvements in this ordinance pro•-ided for, the Board of Com-
missioners are hereby authorized and directed to issue improve-
ment bonds of the City of Salina in an amount not to exceed the
cost of such improvement and to run for a period of ten years and
be payable in ten approximately equal annual installments, to-
gether with interest not to exceed five per cent per annur which
bonds shall be issued and payable according to law; and for the
purpose of paying the principal and interest on said bonds as
they severally become due and payable, the Board of Commissioners
shall appprtion and assess against the lots or pieces of land
within the taxing districts of such improvements, special assess-
ments covering the cost of such improvements and the apportionment
therein contained shall hold good for all of the installments that
are to be collected from the specific property chargeable with said
improvements. Such assessment and apportionment ordinance shall
contain the total amount of tax apjortioned to such tract, piece
or parcel of land within the taxing district and shall state the
number of annual installments in which such tax is to be collected;
and thereafter the City Clerk shall annually, at the same time other
taxes are certified, certify to the County Clerk of Saline County,
Kansas, a full list of all property liable for such work and im-
provements, together with the respective amounts due on each of
said tracts, piece or parcels of land, which amounts shall include
the annual installments and interest on all unpaid balances for
one year

Section 10. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

ORDINANCE NO. 3971
AN ORDINANCE creating and defining certain lateral sanitary sewer
districtsin the City of Salina designated as lateral sewer
districts No. 163 , and 164 , providing for the construction
of lateral sanitary sewers in such districts and for the cost thereof
and for the levying of special assessments against the property
in such districts for the payment of such cost, and for the
issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Lateral Sewer District No. 163 . That there be
and there is here y created a lateral sewer district in the City
of Salina which shall be designated as lateral sewer district No.
,f , and which shall include all of the following described
property in the City of Salina to -wit: The west 150 ft. of
Lot 25 in Surveyors Plat "G"; Lots 4, 6, 8, 10, 12 and 14,,in
block 13 in Riverside Park Addition and Lotal to 7 inclusive
In Block 2, Oakdale Addition.
Section 2. That it is necessary, and it is hereby ordered
that a lateral sanitary sewer with all necessary connections,
manholes, flush tanks and other appurtenances be constructed and
built in and to serve said lateral sewer district No. 163 as
created by Section 1 of this ordinance, along the following described
course, to -wit:
Commencing at a manhole on the existing sanitary sewer in the
intersection of Kansas Avenue and Ash Street; thence south in Kansas
Avenue as an 8" sewer to a manhole to be constructed in the inter-
section of Kansas Avenue and Jo�mstown Avenue; thence west as an
8" server in Johnstown Avenue to a flush tank to be constructed
approximately 45 feet east of the east line of Columbia Avenue.
Section 3. Lateral Sewer District No.164 That there
be and there is hereby created a lateral sewer district in the City
of Salina, which shall be designated as Lateral Sewer District No.164
and which shall include all of the following described property in
the City of Salina, to -wit: Lots 17 to 40 inclusive in Block in
Riverside Park Addition.
Section 4. That it is necessary, and it is hereb7T ordered
that a lateral sanitary sewer with all necessary connections, manholes,
flush tanks and other appurtenances be constructed and built in
and to serve said lateral sewer district No. 164 as created by
Section 3 of this ordinance, alibng the following described course,
to -wit: Co*mencing at an existing manhole in the alley in Block
8 in Riverside Park Addition 358f -north of the north line of Elm
Street; thence north in said alley as an 8" sewer to a flush tank
to be constructed approximately 70 feet south of the south line
of `riverside Drive.
Section 5. That the City Engineer shall on or before the 20th
day of October 1930 prepare and file in the office of the
City Clerk plans and specifications for the construction of Lateral
Sanitary Sewer provided for in the preceding sections of this
ordinance which shall be of proper character to serve the property
lying within the district within which such sewer is to be con-
structed and shall on or before the same date, prepare and submit
to the Board of Com�issioners detailed estimates under oath, of
the cost thereof. That thereafter the City Clerk shall advertise
for three consecutive days in the official city paper for sealed
proposals for the building and construction of such sewer according
to such plans and specifications, which proposals shall be filed
with the City Clerk on or before the time fixed in such notice
at which time the Board of Commissioners may let a contract for
the building and construction of such sewer to the lowest and
best responsible bidder or bidders thereof, provided that such
bids shall not exceed the estimated cost thereof and provided
further that said Board shall reserve the right to reject any or
all such proposals.
Section 6. That for the cost of building and constructing
such sewer, special assessments shall be made for the full cost
thereof, on all lots or pieces of land within the Lateral Sanitary
Sewer District, within which such sewer shall be built, according
to the appraised value thereof, without regard to the improvements or
buildings thereon.
Section 7. After the passage and publication of this ordinance,
the Board of Commissioners shall appoint three disinterested appraisers
who after having taken an oath to make a true and impartial appraise -
,rent of all lots or pieces of lard liable to taxation for the cost
of such improvements, shall within five days after having been
notified of their appointment proceed to appraise all of the lots
or pieces of land within such district, liable to assessment and
taxation as aforesaid, without regard to the buildings or i---prove-
ments thereon, and after making said appraisement shall return the
same to the Board of Commissioners of said city and said Board shall
designate a time for holding a special meeting of said Board for the
purpose of hearing any complaints that may be made as to the value
of any lot or piece of land appraised as aforesaid, of which special
session due notice shall be given in the official city paper, and
at --.hick special session said Board may alter any valuation of any
lot or piece of land, if, in their opinion, the same has been
appraised toy, high or too low.

The special assessments herein provided for may

improvements, and bonds as hereinafter provided for shall be issued
for the amount of the cost of such improvements remaining unpaid at
the end of thirty days from the time such assessment is fixed.
Section 9. For the purpose of paying for the work and improve-
ments in this ordinance provided for, the "pard of Com&i.ssioners
are hereby authorized and directed to issue improvement bonds of the
of the City of Salina in an amount not to exceed the cost of such
improvement and to run for a period of ten years and be payable
in ten apt�roximately equal annual installments, together with in-
terest not to exceed five per cent per annum, which bonds shay, be
issued and payable according to law; and for the purpose of paying
the principal and interest on said bonds as they severally become
due and payable, the Board of Commissioners shall apportion and
assess against the lots or pieces of land within the taxing dis-
tricts of such improvements, special assessments covering the cost
of such improvements and the apportionment therein contained shall
hold good for all of the installments that are to be collected from
the specific property chargeable with said improvements. Such
assessment and apportionment ordinance shall contain the total
amount of tax apportioned to such tract, piece or parcel of lind
within the taxing district and shall state the number of annual
installments in which such tax is to be collected; as d thereafter
the City Clerk shall annually, at the same time other taxes are
certified, certify to the County Clerk of Saline County, Kansas,
a full list of all property liable for such world and improvements,
together :,lith the respective amounts due on each of said tracts,
piece or parcels of land, which amounts shall include the annual
installments and interest on all unpaid balances for one year at
the rate of not to exceed 5 per cent per annum on such amounts so
certified, which shall be collected as other taxes are collected.
Sectior 10. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
