AN ORDINANCE creating and defining certain lateral sanitary sever
districts in the City of Salina, designated as Lateral Sewer
Districts No. 144, No. 145, No. 149, No. 162, and No. 5 pro-
viding for the construction of Lateral Sanitary Severs in such
districts and for the cost thereof, and for the levying of
special assessments against the property in such districts
for the payment of such cost, and for the issuing of bonds
therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Lateral Sewer District No. 144. That there be
and there is hereby created a lateral sewer district in the City of
Salina, which shall be designated as Lateral Sewer District No. 144,
and vrhich shall include all of the fo ` lowing described property in
the City of Salina, to -wit: All of Lots 1 to 13 inclusive in Block
13; and Lots 1 to 12 inclusive, Block 15 and Lots 1 to 12 inclusive,
Block 16, all in Highland Court Addition.
Section 2. That it is necessary, and it is hereby ordered that
a lateral sanitary sewer with all necessary connections, manholes,
flush tanks and other appurtenances be constructed and built in and
to serve said lateral sewer district No. 144 as created by Section 1
of this ordinance, along the following described course, to -wit:
Commencing at a manhole on existing main sewer in Main Sewer
District "P" approximately 135 ft. more or less, north of the north
line of Beloit Street; thence west along a line parallel to the north
line of Beloit Strut to a manhole at or near the center of North
Court lace; thened west along last mentioned line to a manhole in
Funston Street approximately 17 ft. east of the west line of Funston
Street; thence south parallel to the west line of Funston Street
approximately 350 feet to a manhole; thence south along said line
to a flush tank ap-,roximately 44 ft. north of the north line of
Jewell Avenue. Also commencing at a manhole approximately 135 ft.
north of the north line of Beloit and 17 ft. east of the west line
of Funston thence in a north and westerly direction to a point 7 ft.
east of and opposite the northeast corner of Lot 11, Block 15,
Highland Court Addition.
Section 3. Lateral Sewer District No. 145. That there be and
there is hereby created a lateral sewer district in the City of Salina,
which shall be designated as Lateral Sewer District N6. 145,and which
shall include all of the following described property in the City of
Salina, to-4-vit; All of Lots 1 to 22 inclusive in Block 93, Highland
Court Addition.
Section 4. That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connections, man-
holes, flush tanks and other appurtenances be constructed and built
in and to serve said lateral sewer district No. 145 as created by
Section 3 of this ordi ante, along the following described course,
to-1%,it :
Commencing at a manhole on existing main sewer in Main Sewer
District rrp" approximately in the center of Pershing Street 135
fleet more or less, north of the north line of Sunset Drive, thence
west along a line parallel to the north line of Sunset Drive to a
manhole to be constructed at or near the northeast corner of Lot 6,
Block 91 Highland Court Addition; thence west to a flush tank to be
constructed approxi:iately 5 feet v, -est of the northeast corner of Lot
11, Block 9, Highland Court Addition.
Section 5. Lateral Se,,rer District No. 149. That there be
and there is hereby created a lateral sewer district in the City of
Salina which shall be designated as Lateral Sewer District No. 1491
and which shall include all of the fo lowing described property in
the City of Salina, to -wit: All of Blocks 12 and 14 in Highland
Court Addition.
Section 6. That it is necessary, and it is hereby ordered
that an 8" lateral sanitary sewer ,.,ith all necessary connections,
manholes, flush tanks and other appurtenances be constructed and
built in and to serve said lateral sewer district No. 149 as created
by Section 5 of this ordinance in the folloiuing described course
to-vit:
Beginning at an existing manhole on main sanitary se:,�er "P"
in Pershing Street ap-,roxiiately 135 feet south of the so--th line
of Ells�r.,orth Street, thence west approximately 230 feet to a man-
hole to be constructed in South Court Place; thence west approxi-
mately 295 feet to a flush tank to be constructed on the rear lines
of Lot 5 and 6 in Block 14, Highland Court Addition, 45 feet east
of the east line of runston Street.

approximately 255 feet to a flush tank to be constructed in Twelfth Street.
Section 9. Lateral Sewer District No. 5. That there be and
there is hereby created a lateral sewer district in the City of Salina
:which shall be designated as Lateral Sewer District No. 5, and which

Salina, to -wit: All of Block 1, 12, 13 and 24 in the Episcopal Military

Institute Addition.
Section 10. That it is necessar-,r and it is hereby ordered that

serve said lateral sewer district No. 5 as created by Section 9 of this
ordinance along the following described course to -wit:
Commencing at an existing manhole on the sanitary sever in the
ince section of Pacific Street and the alley running north and south.
between Seventh and Eighth.; thence north in said alley 320 feet to
a manhole to be constructed; thence north in said alley 320 feet to
a manhole to be constructed; thence north in said alley 325 feet to
a manhole to be constructed; thence north in said alley 300 feet to
a manhole to be constructed; thence north in said alley 300 feet to
a flush tank to be constructed approximately 4C feet south of the south
line of Otis Avenue.
Section 11. That the City Engineer shall on or before the 29th
day of September 1930, prepare and file in the office of the City Clerk
plans and specifications for the construction of Lateral Sanitary Severs
provided for in the preceding sections of this ordinance which shall be
of proper character to serve the property l -ring within the districts
-ith %,hich such sev.,-ers are to be constructed and shall on or before the

same date, prepare and submit to the Board of Commissioners detailed
estimates under oath, of the cost ther<-of. That thereafter the City
s `
Clerk shall advertise for three consecutive days in the official
city paper for sealed proposals for the building and construe -
tion of such sew=ers according to such plans and specifications,
.,hich proposals shall be filed ,,ith the City Clerk on or before
the time fixed in such notice at v"hich ti -,;e the Board of Com-
rissioners may let a contract or contracts for the budding and
construction of such. sewers to the lowest and best responsible
bidder or bidders thereof, provided that such bids shall not ex-
ceed the estimated cost thereof and provided further that said Board
shall reserve the right to reject any or all such proposals.
Section 12. That for the cost of building and constructing
such sewers, special assessments shall be made for the full cost
thereof, on all lots or pieces of land °,rithin the Lateral Sanitary
Sewer -�)istricts, within which such sewers shall be built, according
to the appraised value thereof, without regard to the improvements
or buildings thereon.
Section 13. After the passage and :publication of tris ordinance
the Board of Commissioners shall ap:oint three disinterested appraisers
who after having taken an oath to make a true and impartial aprraise-
i
ment of all lots or
pieces of land liable to taxation for the cost of
such i-provements shall within five days after having been notified
of their aprointment proceed to appraise all of the lots or pieces
of land within such districts, liable to assessment and taxation
as aforesaid, without regard to the buildings or improvements thereon,
and after making said appraisement shall return the same to the
Board of Commissioners of said city and said Board shall designate
a tirre for holding a special meeting of said Board for the purpose
of hearing; any complaints that may be made as to the value of any
lot or piece of land appraised as aforesaid, of which special session
due notice shall be given in the official city paper, and at which
special session said -6oard may alter any valuation of any lot or
piece of land, if in their option, the same has been appraised too
hi_h or too low.
Section 14. The special assessments herein provided for may
be.aid by the
p Terson liable therefor in ten approximately equal
annual instalments but the n;.n.er of an -T property liable to such
assessment may within hin thirty days from the date of determining
the amount assessed against this property pay the same in full
and his prouerty shall not be liable for any assessment for the
cost of such improvements, and bonds as hereinafter provided for
shall be issued for the arount of the cost of such improvements re-
maining unpaid at the end of thirty days from the time such assess-
ment is fixed.
Section 15. For the purpose of paying for the ,Mork and improve-
ments in this ordinance provided for, the Board of Commissioners
are hereb,- authorized and directed to issue improvement bonds of
the City of Salina in an amount not to :exceed the cost of such
improvement and to run for a period of ten nears and be payable
in ten approximately equal annual instalments, together with in-
terest not to exceed five per cent per annum, which bonds shall be
issued and payable according to law; and for the purpose of paying
the principal and interest on said bonds as they severally become
due and pa'Table, the Board of Com-_,!is:;ioners shall. apportion and
assess against the lots or pieces of land writhin the taxing districts
of such improvements special assessments covering the cost of such
improvements and the apportionment therein contained shall hold
good for all of the instalments that are to be collected from the
specific r.�roi:erty chargeable wr.i.th said improvements. Such assess-
gent and apportionment ordinance shall contain the total amount of
tax app-rtioned to such tra-ct, piece or parcel of land within the
taxing districts and shall state the number of annual instalments
in which such tax is to be collected; and thereafter the "ity Clerk
shall annually at the same time other taxes are certified, certify
to the County "lerk of Saline County, Kansas, a full list of all
propert'T liable for such work and improvements, together with the
respective amounts due on each of said tracts, pieces or parcels
of land, which amounts shall include the annual instalments and
interest on all unpaid balances for one year at the rate of not to
exceed 5 per cent per annum, on such amounts so certified, which
shall be collected as othert axes are collected.
Section 16. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

Section 4. That it is necessary, and it is hereby ordered
that a lateral sanitary sewer with all necessary connections, man-
holes, flush tanks and other appurtenances be constflucted and built
in and to serve said lateral sewer district No. 145 as created by

to -wit:

there is hereby created a lateral sewer district in the City of
Salina which shall be designated as Lateral Sewer District No. 5,
and which shall include all of the following described property
in the Cittr of Salina, to -zit: All of Block 1, 12, 13 and 24 in

Section 11. shat the City Engineer shall on or before the 29th

which time the Board of Commissioners may let a contract or contracts
for the building and construction of such sewers to the lowest and
best responsible bidder or bidders thereof, provided that.such bids
shall not exceed the estimated cost thereof and provided further
that said Board shall reserve the right to reject any or all such
proposals.
Section B2 That for the cost of building and constructing
such sewers, special assessments shall be made for the full cost
thereof, on al'. lots or pieces of land within the Lateral Sanitary
Sewer Districts, within which such sewers shall be built, according
to the appraised value thereof, without regard to the improvements
or buildings thereon.
Section 13 After the passage and publication of this ordinance
the Board of Commissioners shall appoint three disinterested

Board may alter any valuation of any lot or piece of land, if,
in their opinion, the same has been appraised too high or too
low.
Section 14 The special assessments herein provided for may
be paid by the person liable therefor in ten approximately equal
annual instalments but the owner of any property liable to such
assessment may within thirty days from the date of determining
the amount assessed against this property pay the same in full
and his property shall not be liable for any assessment for the
cost of such improvements, and bonds as hereinafter provided for
shall be issued for the amount of the cost of such improvements
remaining unpaid at the end of thirty days from the time such
assessment is fixed.
Section 1'5 For the purpose of paying for the work and improve-
ments in this ordinance provided for, the Board of Commissioners
are hereby authorized and directed to issue improvement bonds of
the City of Salina in an amount not to exceed the cost of such

tax apportioned to such tract, piece or parcel of land within
the taxing districts and shall state the number of annual instal-
ments in which such tax is to be collected; and thereafter the
City Clerk shall annually at the same time other taxes are certi-
fied, certify to the County `'lerk of Saline County, Kansas, a full
list of all property liable for such work and improvements, to-
gether with the respective amounts due on each of said tracts,
pieces or parcels of land, which amounts shall include the annual
