3956 Issue Imp BondsORDINANCE NO. 3956 (Published in the Salina Journal -q,ev _b 1930) AN ORDINANCE authorizing and providing for the issuance of Improve- ment Bonds of the City of Salina, Kansas, in the sum of $94,331.63, to pay the cost of improving certain streets and alleys in said city. WHEREAS, pursuant to proceedings duly had according to law, contracts have been ;et and performed for the construction of the follow- ing street improvements in said city. Paving Center Street from Fifth to entrance to Kenwood Park Curbing, guttering and paving Chicago Street from Ash Street to State Street. -` Curbing, guttering and paving Columbia Avenue from Ash Street to Iron Avenue. Curbing, guttering and paving Ellsworth Avenue from Highland Avenue to Ninth Street. Curbing, guttering and paving Gypsum Avenue from Ohio Street to Columbia Avenue. Curbing, guttering and paving Highland Avenue from Claflin Avenue to Cloud Street. Curbing, guttering and paving Prescott Avenue from Eelventh Street to Twelfth Street. Paving of unpaved portion of Santa Fe Avenue from Lincoln Avenue to Harsh Street. Curbing, guttering and paving Seventh Street from Elm Street to North Street. Curbing, guttering and paving Front Street from Pine Street to North Street. Curbing, guttering and paving Park Place from Oakdale Avenue to Oakdale Drive. Curbing, guttering and paving Washington Avenue from Tenth Street to Eleventh Street. Paving Center of Santa Fe from Harsh Street to Otis Street. Paving Third Street from Iron Avenue south to Smoky Hill xiver. Curbing and guttering Woodland Avenue from Seventh Street to Santa Fe Avenue. V:'HEREAS, the total cost of said improvements hasb een ascertained, and the total portion thereof to be paid by a general tax to be levied upon all the taxable property within said city for the improvements of squares and areas formed by the crossing of streets and alleys, and for the improvements of any of said streets where the same is through or adjacent to property of the city for which the city is liable, and for which bonds shall be issued as hereinafter provided, has been ascertained and is hereby determined and found to be the sum of $14,511.09; and WHEREAS, the portion of said street improvements to be paid by special assessment levied upon the lots and pieces of ground liable for the payment of said street improvements has been ascertained and is here- by found and determined to be the sum of $95,396.04, which said last amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground on such streets liable therefor, payable in ten equal instalmnets, according to law, and as provided in the ordinances of the City of Salina relating thereto duly passed and approved, of which amount the sum of $15,575.50 has been paid by the property owners liable therefore leaving a balance for which bonds are to be issued in the sum of $94,331.63, NOV)THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. `that for the purpose of providing funds to pay the cost of the i»iprovements hereinbefore described, there shall be issued and hereby are issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $94,331.63, i said issue shall consist of 95 bonds, numbered from 1 to 95 in - elusive, all dated May 1st, 1930, and shall become due serially in denominations as follows: No. 1 for $331.63 due May 1, 1931. No. 2 to 5 inclusive $1,000 each, due May 1, 1931 No. 6-15 inclusive 1,000 each, due May 1, 1932 No. 16to 25 inclusive 1,000 each, due May 1, 1933 No. 26 to 35 inclusive 11000 each, due May 1, 1934 No. 36 to 45 inclusive 19000 each, due May 1, 1935 No. 46 to 55 inclusive 1,000 each, due May 1, 1936 No. 56 to 65 inclusive 1,000 each, due May 19 1937 No. 66 to 75 inclusive 1,000 each, due May 1, 1938 No. 76 to 85 inclusive 1,000 each, due May 1, 1939 No. 86 to 95 inclusive 19000 each, due May 1, 1940 All of said bonds bear interest at the rate of 41%, per annum, payable semi-annually on May 1st and November 1st in each year, ex- cept that the first interest on all of said bonds shall become due and payable on May 1st, 1931. Section 2. Said bonds shall be executed by the Mayor and shall be attested by the City Clerk, and the corporate seal of the City shall be affixed thereto. Said bonds shall have attached thereto interest coupons representing the interest thereon and said interest coupons shall bear the fac-simile signatures of the Mayor and City Clerk of said city. Section 3. Said bonds shall be in the form and shall contain recitals substantially as follows: a i I No. KN04:' ALL in the County to be indebted the bearer the UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL I`'PROVEMENT BOND MEN BY TTTESE PRESENTS, That the City of Salina,. of Saline, State of Kansas, acknowledges itself and for value received hereby promises to pay to sum of Dollars in lawful money of the United States of America, on the first day of May 19_, with interest thereon from the date hereof at the rate of four and one-half per cent (41%) per annum, pay- able semi-annually on the first days of May and November in each ,year, on presentation and surrender of the interest coupons here- to annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 95 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of $94,331.63, issued by the City of Salina, Kansas for the purpose of paying the cost of improving certain streets and alleys in said city, by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-115, 12-601 to 12-610 of the Revised Statues of Kansas 1923, and all amendments thereof, and all other provisions of the laws of said state applicable thereto, and this bond and all of the other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, condi- tions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Consitution and laws of the State of Kansas, and that the total in- debtedness of said city, including this series of bonds, does not exceed any constitution or statutory limiation. The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and to advertise and sell the same in the manner provided by law, and, when duly executed and registered, to deliver said bonds to the pur- chaser or purchasers thereof, on receipt of the purchase price. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall be, and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the Uity of Salina, Kansas, shall annually make provision for the payment of the principal and interest on said bonds as the same become due by levying taxes and assessments upon the property liable therefor as provided b« law.
