4274 Construction of Storm Sewer # 11-A4 ORDINANCE NO. 4274 J-Our-na.l AN OR-_,I.;hNCE ratifying and confirming a contract for the construction of Storm Se'uFer No. 11-A in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of 1-,onds. BE IT ORDxIT,1hD by the Board of Com-cissioners of the City of Salina, Kansas: Section 1. That the acceptance by the CitTr of Salina of the proposal of H. J. Taylor Construction Company, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on May 9th, 1933, -hich is herel-y found fqnd determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of said City by its mayor on Way 9th, 1933, for the con- struction of Storm Sever No. ll -h as pro�,ided for by Ordinance No. 4259, said storm sevier to be constructed of vitrified clay pipe in sizes 12 inch to 24 inch at and for the unit prices contained in said proposal, which proposal and contract are herebTr referred to and made parts of this ordinance, be and the same is hereby re- ferred to and made parts of this ordinance, be and the same is hereby rW-ified and confirmed, said proposal being within the esti­ated cost of said improvements as shown by the sworn estimates of the Cit•r Engineer filed in the office of the City Clerk, which estimates are hereby referred to and made parts of this ordinance. Section 2. That said storm sewer No. 11-K shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer and on file in the office of the City Clerk, and in accordance with the proposal of said contractor and under the terms of said contract, all of rhich are hereb-- referred to and made carts of this ordinance. Section 3. That temporary notes signed by the payor and attested ?�v the Cit,r Clerk be issued from time to time as the work progresses I in the manner and form as required by law, the total amount thereof i not to exceed the contract price for such 1zwork, such notes to bear interest not to exceed four (4j_") per cent T:er annum and to be issued in such amounts and at such ti -.e as money for the paTrnent of the cost of such work may be required, such notes to be issued to said con- tractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor Construction Company, hereinafter referred to as the "Contractor" as submitted to the Board of Com- missioners on May 9th, 19330 which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said con- tractor and signed on behalf of said City by its Mayor o8 May 9th, for 1933, for the construction of Storm Sewer No. 11-A as provided/by Ordinance No. 4259, said storm sewer to be constructed of Vitrified Clay Pipe in sizes 12 inch to 24 inch at and for the unit prices contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer filed in the office of the City Clerk, which estimates are hereby referred to and made parts of this ordinance. Section 2. That said storm sewer No. 11-A shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer and on file in the office of the City Clerk, and in accordance with the proposal of said con- tractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. SA..ion 3, That temporary notes signed by the Mayor and attested'by the City Clerk be issued from time to time as the work progresses in the manner and form as required by -law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed four (4%) per cent per annwn and to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and canvelled at the time that permanent bonds are issued in lieu thereof.
