ORDINANCE NO. 4259

AN ORDINANCE providing for the construction of a certain storm sewer
in the City of Salina to be designated as Storm Sewer No. 11-A,
and providing for the manner of the payment of the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Storm Sewer No. 11-A. That it is necessary and it
is hereby ordered that a storm sewer which is hereby designated as
Storm Sewer No. 11-A, together with all necessary inlets, connections
and other appurtenances be constructed in the City of Salina along
the following course, to -wit:
Beginning at an existing manhole in the intersection of Minneapolis
Avenue and Fourth Street, thence south in Fourth Street a 24" storm
sewer 268 feet to a manhole in Fourth Street 40 feet north c.f the north
line of Ellsrorth Avenue, thence south in Fourth Street a 21" storm
sewer 332 feet to a manhole 35 feet north of the north line of Jewell
Avenue, thence south in Fourth Street an 18" storm sewer 357 feet to
a manhole 4 feet north of the north line of Kirwin Avenue, thence south
in Fourth Street an 18" storm sewer 77 feet to a manhole 3 feet south
of the south line of Kirwin Avenue, thence south in Fourth Street a 15"
storm sewer 277 feet to an inlet on the north curb line of Claflin
Avenue, thence south in Fourth Street a 12" storm sewer 62 feet to an

inlet on the south curb line of Claflin Avenue, with lateral inlet con-
nections in Ellsworth Avenue, Jewell Avenue and Kirwin Avenue.
Section 2. That on or before May 4th, 1933, the City Engineer
shall prepare and file in the office of the City Clerk detailed plans
and specifications for the construction of storm sewer provided for
in Section 1 of this ordinance with vitrified and concrete sewer pipe
or any combination of such types of sewer as said Engineer may deem
advisable, and on or before the same date shall prepare and file in
the office of the City Clerk, and, -r oath, detailed estimates of the
cost thereof. After such plans and specifications and estimates of
cost shall have been filed as aforesaid, the City Clerk shall advertise
by advertisements published in the official city paper for at least
three consecutive days for sealed proposals for the building and con-
struction of such storm sewer and at the time and place mentioned
the Board of Commissioners, may contract with the lowest and best
responsible bidder tr,erefor, for the building and construction of
such storm sewer, but the right to reject any and all bids shall be
and is hereby reserved; PROVIDED that such contract shall be let only
for the furnishing by the contractor of the materials and equipment
necessary to be used in connection with the construction of such work,
and for the supervision of such work. All of the ordinary labor in

connection with such storm sewers is to be paid for out of the
Emergency Relief Funds, heretofore created, from money secured
from and furnished for such purpose by the Kansas Federal Relief
Committee. Any contract awarded for such work shall provide for
the furnishing by such contractor of performance and maintenance
bonds and for a statutory ' ond, in such amounts and with such con-
ditions as may be required and approved by the Board of Commissioners.
All tlonds so required shall �e filed by such contractor and approved
by the Board of Commissioners before any siich work shall be com-
menced. The contractor shall be required to carry and pay for
workmens compensation insurance covering the labor on such work.
Section 3. That for the purpose of pat,'ng the cost of such
improvements, the Board of Commissioners shall issue improvement
bonds of the City of Salina, "ansas, in an amount not to exceed the
total cost of such work and improvements, except as herein provided,
to be payable in ten apt,rox:imately equal annual installments and to
bear interest at not to exceed 5% per annum from the date of such
bonds, and for the purpose of paying such bonds and interest as they
severally mature, the Board of Commissioners shall annually lever a
tax upon all real and personal property in the City of Salina in an
amount sufficient to pay the annual installments of such principal
and interest, and that pending the issue of such bonds, temporary
notes shall be issued according to lar, to pay the cost of such
work.
Section 4. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
