j AN ORDINANCE providing for the issuance of refunding bonds of the
City of Salina, Kansas, in the aggregate amount of $60,090.57
j for the purpose of refunding certain outstanding bonds of such
City in a like amount.

WHEREAS, there are at this time outstanding bonded obligations
i of the Cityof Salina, Kansas, as hereinafter more specifically des-
cribed which will. mature on the dates hereinafter set forth during
the year 1933 and for the payment of which at maturity there are not
and wil'_ not be on the dates of maturity funds in the city treasury
sufficient to pay the bonds so maturing and it is hereby determined
by the Board of Commissioners of said city that it is necessary and
it is for the best interest of said city to refund said indebtedness
and to issue the refunding bonds of said city in the amount of said
outstanding bonds; and
{ WHEREAS, all acts, conditions and things required by the con-
stitution and laws of the State of nansas, to exist, happen or be
performed precedent to the issuance of said refunding bonds of
the City of Salina'. Kansas, in the amount of $60,090.57 for such
purpose, and in the issuance of the bonds hereby refunded, have
hap,:ened and been performed in regular and due form, time and
manner; NOW THEREFORE
BE IT ORDAINED by the Board of Comnissionera of the City of Salina,
Kansas:
Section 1. That for the purpose of refunding and retiring the
following described outstanding bonded obligations of the Uity of
Salina, Kansas, to -wit:
(a) Memorial Hall Bonds dated January 1st, 1921, in
denominations of $1000 each, bearing interest at
the rate of 5-1/2% per annum, numbered from 141
to 160 inclusive, due January 1st, 1933, author-
ized by ordinance No. 2386, aggregating - - - - - - $ 20,000.00
(b) Sewage Disposal Bonds dated January 10th, 1927,
in denominations of $1000 each, bearing interest
at the rate of 4-1/4% per annum, numbered from
36 to 42 inclusive, due January 10, 1933, author-
ized by ordinance No. 3224, aggregating -- - - - - $ 7000.00
(c) Sewer Repair Bonds dated February lst, 1930, in
denominations of �100C each, bearing interest at
the rate of 4-1/2/ per annum, numbered from 5 to
6 inclusive, due February lst, 1933, authorized
by ordinance No. 3844, aggregating - - - - - - - - 2000.00
(d) Storm Sewer Bonds dated March 1st, 1932. Bond
No. 1 in denomination of $590.57 and bond No.
2 to 12 inclusive in denominations of $1000 each,
bearing interest at the rate of 4-1/4% per annum

in denominations of 41000 each, bearing interest at
the rate of 4% per annum, numbered from 3 to 4 in-

(g) Sewer Repair Bonds dated August 1st, 1929, in denom-
inations of $1000 each, bearing interest at the rate
of 4-1/2o per annum, numbered from 8 to 9 inclusive,
due August 1st, 1933, authorized by ordinance No.

denominations of $1000 each, bearing interest
at the rate of 4-3/4% per annum, numbered from
23 to 29 inclusive, due October lst, 1633,
authorized by ordinance No. 3796, aggregating -- $7000.00
(i) Storm Sewer Bonds dated November lst, 1930, in
denominations of X1000 each, bearing interest
at the rate of 4-1/4p per annum, numbered from
8 to 11 inclusive, due November lst, 1933,
authorized by Ordinance No. 3992, age-regating - $ 4000.00
(i) Flood Control Bond dated December 1st, 1930,
in denomination of 6500.00 bearing interest
at the rate of 4-1/4% per annum, numbered 3,
due December lst, 1933, authorized by ordin-
ance No. 3996, aggregating - - - - - - - - - - $ 500.00
there are hereby authorized to be issued, and the Mayor and City
Clerk are hereby directed to sign and execute the negotiable
coupon bonds of said city in the aggregate amount cf $60,090.57,
which amount does not exceed the amount of the above described
outstanding bonds.
Section 2. Said Refunding Jjonds shall b e dated Januarq 1st,
1933, shall bear interest at the rate of four per cent per annum,
payable July 1st, 1933, and semi-annually thereafter on the first
days of January and July of each Near until the respective maturities
of the bonds herein authorized, for which interest coupons shall be
attached, authenticated by the lithographed facsimile signatures of
the Mayor and City Clerk. Said bonds shall be signed by the Mayor,
attested by the City Clerk and have the seal of the City affixed
thereto. Said bonds shall be registered by the City clerk of the
City of Salina, Kansas, and by the Auditor of the State of Kansas.
Section 3. Said Refunding Bonds and interest coup -,ns thereon
shall be payable at the office of the State Treasurer in the City
of To-peka, Kansas. Said bonds shall be in the denomination of $1000
each, and shall become due and payable as follows:

KNOW ALL MEN BY THESE PRESENTS: That the City of Salina, Saline
County, State of Kansas, is indebted to and promises to pay the bearer
the sum of
Dollars in lawful money of the United States of America, on the first-
day of January, 19., with interest thereon at the rate of four per
cent (4a) per annum, payable semi-annually bn the first days of January
and July of each year, upon the presentation and dc,livery of the proper
coupons hereto annexed signed by the Mayor and Clerk of said City.
Both principal and interest of this bond are payable at the office of
the State Treasurer, in the City of Topeka, Kansas, and said City is
hereby held and firmly bound and its faith and credit and all of the
resources of said pity are hereby pledged for the prompt payment of
this bond and interest at maturity.
THIS BOND is one of a series of bonds numbered from One (1) to
Sixty (60) inclusive, aggregating Sixty Thousand Ninety Dollars and
Fifty Seven Cents ($60,090.57) of like tenor and effect except as to
maturity and amount, issued by the City of Salina, Kansas, for the
purpose of refunding certain outstanding bonded indebtedness hereto-
fore legally created by said City, and is issued under authority of
and in conformity with the provisions, restrictions and limitations
of Chapter 10, Article 1, Revised Statutes of Kansas, 1923, and all
acts amendatory, complementary, and supplemental thereto, and such
bonds and the interest thereon are to be paid by the City of Salina,
Kansas.
AND IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions,
and things required to be done precedent to and in the issuance of
said bonds, have been properly done, hap-ened and performed in regular
and due form as required by law, and that the indebtedness which is
refunded by this series of bonds, is a constitutional, subsisting and
legal obligati -n of said City and that neither the ind-btedness which
is refunded nor this series of bonds exceed the statutory or consti-
tutional limitation.
IN TESTIMONY WHEREOF, we, the undersigned officers of the City of
