AN ORDINANCE creating and defining a certain lateral sanitary sewer
district in the City of Salina designated as lateral sewer
district No. 167, providing for the construction of a lateral
sanitary sewer in such district and for the cost thereof and
for the levying of special assessments against the property
in such district for the payment of such cost, sad for the
issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Lateral Sanitary Sewer District No. 167. That
there be and there is hereby created a lateral sewer district in
the City of Salina which shall be designated as lateral sewer
district No. 167, and which shall include all of the following
described property in the City of Salina, to -wit:
Lots 1, 3, 5. 7, 9, 11, 13, 15, 17 and 19 on Ellsworth Avenue
and lots 2, 4, 6, 8, 10, 12, 14, 16, 18 and 20 on Jewell
Avenue in the Addition to Kansas Wesleyan University Gfsoud.ds.
Section 2. That it is necessary, and it is hereby ordered that
a lateral sanitary sewer with all necessary connections, manholes,
flush tanks and other appurtenances be constructed and built in and
to serve said lateral sewer district No. 167 as created by Section
1 of this ordinance, along the following described course, tow4t:
Beginning at a flush tank to be constructed in the alley
between Ellsworth Avenue and Jewell Avenue approximately forty
(40) feet west of the west line of Osborne Street, thence west
an 8" sewer a distance of 3201 feet to a manhole -to be constructed
thence west an 811 sewer a distance of 320 feet to an existing man*"
hole on Lateral Sanitary Sewer No. 100 in the alley between Ellsworth
Avenue and Jewell Avenue approximately 40 feet west of the west line
of Fourth Street.
Section 3. That the City Engineer shall on or before October
27th, 1932, prepare and file in the office of the City Clerk plans
and specifications for the construction of Lateral Sanitary Sewer
provided for in the preceding section of this ordinance which shall
be of proper character to serve the property lying within the dis-
tricts within which such sewers are to be constructed and shall on
or before the same date, prepare and submit to the Board of Commiss-
ers detailed estimates under oath, of the cost thereof. That there-
after the City Clerk shall advertise for three consecutive days in
the official city paper for sealed proposals for the building and
construction bf such sewer according to such plans and specifica-
tions, which proposals shall be filed with the City Clerk on or be-
fore the time fixed in such notice at which time the Board of Com-
missioners may let a contract or contracts for the building and con-
stfuction of such sewer to the lowest and best bidder or '-idders there-
for, provided that such bids shall not exceed the estimated cost thereof
and provided further that said Board shall reserve the right to reject
any or all such proposals.
Section 4. That for the cost of building and constructing such
sewer, special assessments shall be made for the full cost thereof,
j on all lots or pieces of land within the Lateral Sanitary Sewer Dis-
trict, within which such sever shall be built, according to the appraised

value thereof, without regard to the improvements or buildings thereon.
Section 5. After the passage and -publication of this ordinance,
the Board of Commissi^ners shall appoint three disinterested appraisers
who after having taken an oath to make a true and impartial appraisement
of all lots or pieces of land liable to taxation for the cost of such

improvements, shall within five days after having been notified of their
appointment proceed to appraise all of the lots or pieces of land with-

in such districts liable to assessment and taxation as aforesaid, with-
out regard to the buildings or improvements thereon, and after making
said aprraisements shall return the same to the Board of Commissioners

of said city and said Board shall designate a time for holding a special
meeting of said Board for the purpose of hearing any complaints that
may be made as to the value of any lot or piece of land appraised as
aforesaid, of which special session due notice shall be given in the
official city paper, and at which special session said Board may alter
any valuation of any lot or piece of land, if, in their opinion, the
same has been appraised too high or too low.
Sectinn 6. The special assessments herein provided for may be
paid by the person liable therefor in ten approximately equal annual
installments but the owner of'any property liable to such assessment
may within thirty days from the date of determining the amount assessed
against his property pay the same in full and his property shall not be
liable for any assessment for the cost of such improvements, and bonds
as hereinafter provided for shall be issued for the amount of the cost
of such improvements, remaining unpaid at the end of thirty days from
the time such assessment is fixed.
Section 7. For the purpose of paying for the work and improve-
ments in this ordinance provided for, the Board of Commissioners are
hereby authorized and directed to issue improvement bonds of the City
of Salina in an amount not to exceed the cost of such improvements and
to run for a period of ten years and be payable in ten approximately
equal annual installments, together with interest not to exceed five

per cent per annum, which bonds shall be issued and payable according
to law; and for the purpose of paying the principal and interest on
said bonds as they severally become due and payable, the Board of
Commissioners shall apportion and assess agAinst the lots or pieces

of land within the taxing districts of such improvements, special
assessments covering the cost of such improvement and the apportion-
ment therein contained shall hold good for all of the installments
that are to be collected from the specific property chargeable with
said improvements. Such assessment and apportionment ordinance shall
contain the total amount of tax apportioned to such tract, piece or
parcel of land within the taxing district and shall state the number
of annual installments in which such tax is to be collected; and
thereafter the City Clerk shall annually at the same time other taxes
are certified, certify to the County Clerk of Saline County, Kansas,

a full list of all property liable for such work and improvements,
together with the respective amounts due on each of said tracts, piece
or parcels of land, which amounts shall include the annual install-
ments and interest on all unpaid balances for one year at the rate
of not to exceed 5 per cent per annum on such amounts so certified,
which shall be collected as other taxes are collected.
Secti-n 8. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

Section 2. That it is necessary, and'it is hereby ordered that
a lateral sanitary sewer with all necessary connections, manholes,

Ssction 3. That the City Engineer shall on or before

oath,.of the cost thereof. That thereafter the City Clerk shall
advertise for three consecutive days in the official city paper

shall be filed with the City Clerk on or before the time fixed in
such notice at which time the Board of Commissioners may let a con-
tract or contracts for the building and construction of such sewer
to the lowest and best responsible bidder or bidders therefor, pro-
vided that such bids shall not exceed the estimated cost thereof
and provided further that said Board shall reserve the right to
reject any or all such proposals.
Section 4. That for the cost of building and constructing
such sewer, special assessments shall be made for the full cost
thereof, on all lots or pieces of land within the Lateral Sanitary
Sewer District, within which such sewer shall be built, according
to the appraised value thereof, without regard to the improvements
or buildings thereon.
Section 5. After the passage and publication of this
ordinance, the Board of Coijmissioners. shall appoint three dis-
interested appraisers who after having taken an oath to make a
true and impartial appraisement of all lots or pieces of land
liable to taxation for the cost of such improvements, shall within
five days after having been notified of their appointment proceed
to appraise all of the lots or pieces of land within such districts
liable to assessment and taxation as aforesaid, without regard to

are hereby authorized and directed to issue improvement bonds of
the City of Salina in an amount not to exceed the cost of such
improvements and to run for a period of ten years and be payable
in ten approxi^ately equal annual installments, together with
interest not to exceed five per cent per annum, which bonds shall
be issued and payable according to law; and for the purpose of

districts of such improvements, special assessment covering the
cost of such improvement and the apportionment therein contained
shall hold good for all of the installments that are to be collected
from the specific property chargeable with said improvements.
Such assessment and apportionment ordinance shall contain the
total amount of tax apportioned to such tract, piece or parcel
of land within the taxing district and shall state the number
of annual installments in which such tax is to be collected;
and thereafter the City Clerk shall annually at the same time
other taxes are certified, certify to the County Clerk of Saline
County, Kansas, a full list of all property liable for such work
and improvements, together wi0h the respective amounts due on each
of said tracts, piece oP parcels of land, which amounts shall in-
clude the annual installments and interest on all unpaid balances
for one year at the rate of not to exceed 5 per cent per annum
on such amounts so certified, which shall be collected as other
taxes are collected.
Section S. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
