4210 Construction of Storm Sewers #17-AORDINANCE NO. 4210 (Fr_�t;__published in the Salina Jn»rnal1932.) AN ORDINANCE providing for the construction of certain storm sewers in the City of Salina to be designated as Storm Sewers No. 24, and No. 17-A, and providing for the manner of the paymen t of the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Storm Sewer No. 24. That it is necessary and it is hereby ordered that a storm sewer which is hereby designated as Storm Sewer No. 24, together with all necessary inlets, connections and other appurtenances be constructed in the City of Salina along the following course, to -Hit: Beginning at a manhole to be constructed in the intersection of Marietta Street and Clerk Street, thence west in Marietta Street an 18" sewer 135 feet to a manhole at the alley between Clark and Chicago Street, thence west a 24" server 153 feet to a manhole at the east line of Chicago Street, thence west a 24" sewer 78 feet to a manhole at the west line of Chicago Street, thence west a 27" sever 358 feet to a manhole at the west line of Olive Street, thence west a 27" sewer 140 feet to a manhole at the alley west of Olive Street, thence west a 30" sewer 40 feet to the outfall at Dry Creek; also beginning at a manhole at the alley between Clark Street and Chicago Street on University Street, thence north an 18" sewer 395 feet to a manhole in Marietta Street. Section 2. Storm Sewer No. 17-A. That it is necessary and it is hereby ordered that a storm sewer which is hereby designated as Storm Sewer No. 17-A, together with all necessary inlets, con- nections and other appurtenances be constructed in the City of Salina along the following course, to -wit: Beginning at an existing inlet on the north side of Elm Street between Seventh Street and Eighth Street thence east in the north parking of Elm Street a 15r sewer 342 feet to an inlet to b e con- structed on the north side of Elm Street between Santa Fe Avenue and 7th Street. Section 3. That on or before October 14th, 1932, the City Engineer shall prepare and file in the office of the City Clerk detailed plans and specifications for the construction of storm sewers provided for in Section 1 and 2 of this ordinance with vitrified and concrete sewer pipe or any combination of such types of sewer pipe and such other types of sewers as said Engineer may deem advisable, and on or before the same date shall prepare and file in the office of tjTe City Clerk, under oath, detailed estimates of the cost thereof. After such plans and specifications and estimates of cost shall have been filed as aforesaid, the City 306 I Clerk shall advertise by advertisements published in the official cite* paper for at least three consdcutive days for sealed proposals for the building and construction of such storm sewers and at the time and place mentioned the Board of Commissioners, may contract with the lowest and best responsible bidder therefor, for the building and construction of such storm sewers, but the right to reject any and all bids shall.be and is hereby reserved; PROVIDED, that such contract shall be let only for the furnishing by the contractor of the materials and equipment necessary to be used in connection with therconstruction of such work, and for the supervision of such work. All of the ordinary labor in connection with such storm sewers is to be paid for out of the Emergency Relief Funds, heretofore created, from•and furnished for such purpose by the Kansas Federal Relief Committee. Any contract awarded for such work shall provide for the furnishing by such contractor of performance and maintenance bonds and for a statutory bond, in such amounts and with i such conditions as may be required and approved by the Board of Com- missioners. All bonds so required shall be filed by such contractor and approved by the Board of Commissioners before any such work shall be commenced. The contractor shall be required to carry and pay for workmens compensation insurance covering the labor on such work. Section 4. If no satisfactory bids shall be received from a responsible bidder within the amount of the estimates prepared by the City Engineer as required by this ordinance, the Board of Commissiondrs may direct said Engineer to construct such storm sewers within such estimated cost and for such purpose may purchase such materials and equipment as may be necessary to construct such storm sewers, and may hire and pay for the labor necessary for the construction and supervision of such work and all of such cost, to such extent as may be necessary in excess of the amount received for such purpose from the Ka sas Federal Relief Committee, whether the work be done by contract or otherwise, shall be paid by the City out of the Geneaal Improvement Fund of said city.
