4216 Construction of Lateral Sanitary SewerORDINANCE NO. 4216 (Published in the Salina Journal p 1932) AN ORDINANCE ratifying and confirming a contract for the building and construction of a certain lateral sanitary sewer in Lateral Sanitary Sewer District No. 167 and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of 1�onds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of the H. J. Taylor Construction Company of Salina, Kansas, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on October .31st, 1932, which is hereby found anduetermined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City by the Mayor on October 31st, 1932, for the construction of a certain lateral sanitary sever in Lateral Sanitary Sewer District No. 167 as provided for in Ordinance No. 4212 at and for the unit prices contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confiPmed, said proposal being within the estimated cost of said Improvements as shown by the sworn estimate of the City Engineer filed in the office of the City '-%lerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. That said lateral sanitary sewer shall b e built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said con- tractor and under the terms of said contract entered into between the City and said contractor on October 31st, 1932, which said plans, specifications, proposal and contract are hereby referred to and made parts of this ordinance, said work to be done and the material, equipment, appliances and appurtenances necessary and required in connection therewith to be performed and furnished in accordance with said plans and specifications, conditioned however upon the furnishing by the contractor of the contract, maintenance and statutory bonds within the time required by said contract. Section 3. That temporary notes signed by the Mayer and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such vrork, such notes to bear interest not to exceed 4-1/4 per annum and to be issued in such amounts and at such time as money for may be requiredsucx notes to the payment of the cost of such work , i i be issued to said contractor and to be redeemed and cancelled at the ! time that permanent bonds are issued in lieu thereof. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from tine to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed "r4ii-1%4` per annum I and to be.isaued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued inilieu thereof. Section 4. This ordinance shall take effect and be in force from and after its publication in the official city paper.
