AN ORDINANCE provicling for the widening of a portion of North Street
between Santa Fe Avenue and Fifth Street; providing for and author-
izing the acquisition bt,- the City of Salina by Turchase of certain
land for such pu-rpose; providing for and authorizing the paving,
curbing and guttering of a portion of North Street, as widened,
between Santa Fe Avenue and Fifth Street, the construction of a
sidewalk on the north side of such street, and repealing Ordinance j
No. 4119 of the City of Salina.
17HEREAS, the Board of Commissioners of the City of Salina deem it i
necessary to widen a portion of North Street in said City between
Santa Fe Avenue and Fifth Street, and for such purpose to a cquire by
purchase from the owner thereof the tract of land hereinafter des-
cribed and to curb and gutter and pave a portion of North Street be-
tween Santa Fe Avenue and Fifth Street, as v,idened, pursuant to a
certain agreement entered into between `,he City of Salina and the
Atchison, Topeka & Santa Fe Railway Company and the Union Facific
Railroad Company hereinafter referred to; NOW THEREFORE
BE IT ORDAITTED by the Board of Comr:,issicners of the City of Salina,
Kansas: I
Section 1. That the City of Salina acquire by purchase from
the estate of Joseph Duncan, deceased, the owner thereof, the
following described tract or parcel of land in the Cit -r of Salina,
to -wit:
Commencing at the southwest corner of Lot 23, Block 10
in Calkin's Addition; thence east to the southeast corner
of said lot; thence north 12.5 feet; thence northwesterly
in a straight line to the northwest ocrner of said lot; thence
south to point of beginning.
and pay for such land in the sum of w 1500 which the Board of Com-
missioners deem to be the reasonable value thereof.
Section 2. That North Street between Santa Fe Avenue and Fifth
Street be widened to include a tract or parcel of land described in
Section 1 of this ordinance.
Section 3. That the unpaved portion of North Street between
Santa Fe Avenue and Fifth Street, as widened b,.- the addition there-
to of the land described in Section 1 of this ordinance, be curbed,
guttered and paved to such extent as may be necessary to create a
paved roadway 35 feet in width lying the northerly side of the
railraod tracks of the Atchison, Topeka and Santa Fe Railway Com�:an y
in North Street, and that a concrete sidewalk be constructed along
the north side of such street to replace the one destroyed by the
widening and improving of such street as herein provided for.
Section 4. For the work and improvements herein provided for
the City Engineer shall make and file on or before May 20th, 19329
complete plans and specifications for the paving of that portion
of such street so to be paved (including the excavation necessary
for the completion of Bach work) and for the curbing and guttering
required therefor, with the following materials:
3 inch vitrified brick ,pith asphalt filler on 6 inch concrete
base;
Concrete combined curb and gutter 30 inches wide from back of
curb to paving line; Curb 14 inches deep at back; Gutter 6 inches
deep; Concrete sidewalk 5 ft. wide, 4 inches deep
and shall on or before the same date submit to the Board of Commissioners
under oath detailed estimates of the cost of such workz.-ith such
materials.
Section 5. That after such plans and specifications shall have
been made and prepared by the City Engineer and filed with the City
Clerk as aforesaid the Board of Commissioners may advertise, by ad-
vertisement published in the official city paper of the City of Salina,
Kansas for three consecutive days for the receipt of sealed proposals
for the improving of said street with the kind of material named and
specified in the preceding section hereof, and for the excavating
and grading necessary for the completion of such work, and 'ter the
receipt of such proposals the said Board of Commissioners may and
are hereby authorized to let contracts for the improving of said
street with the material selected by them to the lowest responsible
bidder therefor, as determined by said Board of Commissioners, and
for such excavating and grading. Said Board of Commissi"ners re-
serve the right to reject any and all bids.
Section 6. The cost of acquiring the land hereinabove described
and the cost of paving, curbing and gut'ering such street as above
provided for shall be paid as follows:
One half of the purchase price of said land, or X750, shall be
;aid by the City of Salina out of its General Improvement Fund and
the remaining one half or X750 shall be paid by the Atchison'; Topeka
and Santa Fe Railway Company and the Union Pacific Railroad Company:
the entire cost of such paving, curbing and guttering and sidewalk
improvements, up to a total cost of X1825.79, shall be paid by said
railroad companies, and the remaining cost, if any, shall be paid
by the City of Salina out of the General Improvement Fund, all in
accordance with the written agreement of the City of Salina and said
railroad companies, as approved by the Board f Commissioners on
May 9th, 1932, which agreement is hereby referred to and made a
part of this ordinance, and which agreement is hereby ratified and
confirmed.
Section 7. That Ordinance No. 4419 of the City of Salina be
and the same is hereby repealed.
Section 8. This ordinance shall take effect and be in full
force from and after its publication once in the official city
paper.

WHEREAS, the board of Commissioners of the City of Salina deem
