4505 Public Transportation3 ORDINANCE N0. 4505 (Published in the Sal'na Journal � _ � 1935) AN ORDINANCE relating to the use of streets of the City of Salina for the transportation of passengers by busses or stages and prohibit- ing the use of such streets for such purpose by any person, co- partnership or corporation not having a franchise from the City of Salina to use the streets for such purpose and providing a penalty for the violation of this ordinance and a remedy for the enforcement of this ordinance, and repealing Ordinances No. 3048 and No. 3248. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. It shall be unlawful for any person, co -partnership or member thereof, or corporation, either as principal, agent, employee or otherwise, to use the streets of the City of Salina for the transpor- tation of passengers in busses or other similar vehicles or to engage in the business of transporting passengers in such a manner, there such passengers are transported from one place to another within the City of Salina or where the major portion of the route or routes of any such bus line or 1.1nes lies within the City of Salina and where. such bus line or limes are operated along a regular route or routes or in such manner as not to come within the definition of taxicabs as defined by ordinances of said city relating to taxicabs, unless such person, co- partnership, or corporation shall have a franchise granted by the governing body of the City of Salina to use the streets of the City of Salina for such purpose. Section 2. Any person, copartnership or member thereof, or corporation, who shall, either as principal, agent, employee or other- wise, violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and for each offense shall be punished by a fine of $50.00 and each day upon which any such violation shall occur or shall continue shall be deemed to be a separate offense, and the operation of each separate vehicle by any person, copartnership or corporation either as principal, agent, employee or otherwise in violation of the provisions of this ordinance shall be deemed to be a separate offense. Section 3. In addition to the enforcement of this ordinance by the arrest of any person, copartnership or corporation either as principal, agent, employee or otherwise, it shall be the duty of the proper officials of the City of Salina to cause any violation or con- tinued violation of the provisions of this ordinance to be restrained or enjoined by appropriate proceedings in any court of competent jurisdiction. Section 4. That ordinances No. 3248, and Ordinance No. 3048 as amended by Ordinance No. 3248 be and the same are hereby repealed. Section 5. It shall be unlawful for any person, co -partnership or mei- r -t e`reof, or corporation, either as principal, agent, employee or otherwise, to use the streets of the City of Salina for the transportlon of passengers in busses or other similar vehicles or to engage in the business of transporting passengers in such a manner, where such passengers are transported from one place to another within the City of Salina or where the major portion of the route or routes of any such bus line or lines lies within the City of Salina and where such bus line or lines are operated along a regular route or routes or in such manner as not to come within the definition of taxicabs as defined by ordinances of said city relating to taxicabs, unless such person* copartnership, or corporation shall have a franchise granted by the governing body of the City of Salina to use the streets of the City of Salina for such purpose„ wx%h t Section 2. Any person, copartnership or member thereof, or corporation, who shall, either as principal, agent, employee or otherwise, violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and for each offense shall be punished by a fine of $50.00 and each day upon which any such violation shall occur or shall continue shall be deemed to be a separate offense, and the operation of each separate vehicle by any person, copartner- ship or corporation either as principal, agent, employee or other wise in violation of the provisions of this ordinance shall be deemed to be a separate offense, Section 3. In addition to the enforcement of this ordinance by the arrest of any person, copartnership or corporation either as principal, agent, employee or otherwise, it shall be the duty of the proper officials of the City of Salina to cause any violation or continued vio&ation of the provisions of this ordinance to be restrained or enjoined by appropriate proceedings in any court of competent jurisdiction. Section 4. That ordinances No. 3248, and Ordinance No. 3048 as amended by Ordinance No. 3248 be and the same are hereby repealed. Section S.
