4510 Utility Improvements450 ORDINANCE NO. 4510 Published in the Salina Journal 1935) AN ORDINANCE providing for the construction of a certain storm sewer in the City of Salina to be designated as Storm Sewer No. 17-B and pro- - viding for the letting of a contract for such construction and for the payment of the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina,Kansas; Section 1. That it is necessary and it is hereby ordered that a storm sewer which is hereby designated as Storm Sewer No. 17-B together with all necessary inlsts, connections and other appurtenances be con- structed in the City of Salina along the following course to -wit: Beginning at a manhole to be constructed at the intersection of Fifth Street and Lincoln Avenue, thence east in Lincoln Avenue an 18 inch sewer 585 feet to a manhole to be constructed at the intersection of Third Street and Lincoln Avenue, thence south in Third Street a 24 inch sewer 433 feet to a manhole to be constructed at the intersection of Third Street, and North Street; also beginning at an inlet to be constructed in Third Street a a point 100 feet south of the south line of North Street thence north a 15 inch sewer 110 feet to the last described manhole, thence east in North Street a 27 inch sewer 333 feet to a manhole to be con- structed at the intersection of Second Street and North Street; also beginning at an inlet to be constructed 180 feet north of the north line of North Street thence south in Second Street a 12 inch sewer 243 feet to the last described manhole at Second Street and North Street, thence south in Second Street a 30 inch sewer 483 feet to an existing manhole at the inter -section of Second Street and Pine Street, together with the necessary inlets, inlet connections, manholes and other accessories. Section 2. That on or before February 13th, 1935, the City Engineer shall prepare and file in the office of the City Clerk detailed plans and specifications for the construction of storm sewer provided for in Section 1 of this ordinance with vitrified and/or concrete sewer pipe or any combination of such types of sewer pipe and on or before the same date shall prepare and file in the office of the City Clerk, under oath, detailed estimates of cost thereof. After such plans and specifications and estimate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such storm sewer and at the time and place mentioned the Board of Commissioners, may contract with the lowest and best responsible bidder therefore for the building and construction of such storm sewer, but the right to reject any and all bids shall be and is hereby reserved; Provided, however, that such contract shall be let only for the furnishing by the contractor only of such materials as are not paid for out of the funds furnished to the City of Salina for such purpose by the Kansas Emergency X51 Relief Committee and for the equipment necessary to be used in con- nection with the construction of such work and for the supervision of such work it being understood that Federal Emergency Relief Funds i furnished b -7r and through the Kansas Emergency Relief Committee will be used by the City of Salina to furnish and pay for a portion of the i materials to be used in the construction of such work, including all 1 pipe in sizes from 15" to 24" inclusive, and for the payment of all I common labor used in connection with the construction of such work. Any contract awarded for such work shall provide for the furnishing j by the contractor of performance and maintenance bonds and for a statutory bond in such mounts and with such conditions as may be re- quired and provided by the Board of Commissioners. All bonds so re- quired shall be filed by such contractor and approved by the Board of Commissioners before such work shall be commenced. The contractor shal be required to carry and pay for workmens compensation insurance cover - Ing all labor furnished and paid for by the contractor. Section 3. If no satisfactory bids shall be received from a responsible bidder within the amount of the estimates prepared by the City Engineer as required by this ordinance, the Board of Com- missioners may direct said Engineer to construct such storm sewer within such estimated cost and for such purpose may purchase such materials and equipment and may hire and pay for such labor as may be necessary to construct such storm sewer and for the supervision of such work. Section 4. For the payment of the cost of such work except such part thereof as may be paid from funds furnished by the Kansas Emergency Relief Committee, the Board of. Commissioners shall issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements, except as herein provided, to be payable in ten approximately equal annual installments and to bear interest at not to exceed 5% per annum from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issue of such bonds, temporary notes shall be issued according to law, to pay the cost of much work.
