AN ORDINANCE ratifying and confirming a contract for the building
and construction of lateral sanitary sewer No. 170, and pro-
viding for the issuance of temporary notes to pay the cost
thereof pending issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the acceptance by the City of Salina of the
proposal of 0. N. Lyon, d/b/a Lyon Plumbing Company of Salina, Kansas,
hereinafter referred to as the ~Contractor" as submitted to the Board
of Commissioners on November 121, 1934, which is hereby found and
determined to be the lowest and best bid for such work, and the con-
tract awarded by the Board of Commissioners of said city to said
contractor and signed on behalf of the City of Salina by the Mayor
on November 12, 1934, for the construction of a certain lateral
sanitary sewer in Lateral Sanitary Sewer District No. 170 as pro-
vided for in Ordinance No. 4475 at and for the unit prices contained
in said proposal, which proposal and contract are hereby referred to
and made parts of this ordinance, be and the same is hereby ratified
and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimate of the City Engineer filed
in the office of the City Clerk, which estimates are hereby referred
to and made a part of this ordinance.
Section 2. That said lateral sanitary sewer shall be built and
constructed in accordance with the plans and specifications therefor
prepared by the City Tngineer on file in the office of the City Clerk
and in accordance with the proposal of said contractor and under the
terms of said contract entered into between the City and said con-
tractor on November 12, 1934, which said plans, specifications, pro-
posal and contract are hereby referred to and made parts of this
ordinance, said work to be done and the material, equipment, appliances
and appurtenances necessary and required in connection therewith to be
performed and furnished in accordance with said plans and specificati ns,
conditioned however upon the furnishing by the contractor of the con-
tract., maintenance and statutory bonds within the time required by
said contract.
Section 3. That temporary notes signed by the Mayor and attested
by the City Clerk be issued from time to time as the work progresses
in the manner and form as required by law, the total amount thereof
not to exceed the contract price for such work, such notes to bear
interest not to exceed four (4) per cent per annum and to be issued
in such amounts and at such time as money for the payment of the cost
of such work may be required, such notes to be issued to said con-
tractor and to be redeemed and cancelled at the time that permanent
bonds are issued in lieu thereof.

Section 4, This ordinance shall take effect and be in force
from and after its publication in the official city paper,
