APiiblished_ in _the Salina Journal 193.4) AN ORDINTANCE relating to and regulating the use, operation and parking V; of vehicles on the streets of the City of Salina, Kansas, and " the passage of pedestrians upon and over such streets, providing -r penalties for the violation of this ordinance and repealing certain ordinances and parts of ordinances of the City of Salina. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1, Definitions: When used in this ordinance, the word "vehicle" shall be deemed to include all self-propelled or horse drawn vehicles of every kind and nature, capable of being used upon or which are used upon the streets of the City of Salina, including auto- mobiles, trucks, wagons, drays, tractors, farm or road machinery, motor vehicles, tricycles, bicycles and led, ridden, driven or herded horses or other animals of any kind. The word 'Driver" used in this ordinance includes the operator of an automobile, motorcycle or any other vehicle or rider or driver, or person in charge of any horse or other animal and the rider of any bicycle. The word "person" when used in this ordinance shall be deemed to include one or more persons, companies, copartnerships, corpora- tions, and the agents, servants, employees or other representatives, members or officers thereof. The word "Streets" when used in this ordinance shall be deemed to include all streets, avenues, alleys, roads, lanes or places set aside for and used for vehicular traffic, in the City of Salina. The word "Traffic" when used in this ordinance, shall be deemed to include all vehicles and other conveyances while using any street for the purposes of travel and to include pedestrians, ridden, driven or herded animals and bicycles. The word "Park" or "parking" when used in this ordinance shall mean the leaving or standing of any vehicle, when not in motion, in any Porti -.n of any street for any purpose, except temporarily for the purpose of permitting a person to enter or leave such vehicle. Section 2. The inner, operator or driver or person in charge of or in cgntrol of any vehicle used, propelled, driven or parked upon the streets of the City of Salina, and all persons using or occupying any such streets for any purpose, shall conform to and obey all of the rules, regulations and provisions hereinafter set forth in this ordinance, with respect to the use and occupancy of such streets and with respect to the use, operation and/or parking upon the streets in the City of Salina of any vehicle or vehicles owned, operated, driven by or under the control of any such person and shall cause the same to be conformed to, observed and obeyed 36-7 by any person in or under his control, charge or direction. Section 3. Rules of the Road: Vehi6les meeting, approaching from opposite directions, shall pass each other on the right. A vehicle overtaking another vehicle from the rear shall pass on the left side of the overtaken vehicle and shall not pull over in front of the overtaken vehicle until entirely clear of it. In passing an overtaken vehicle, the overtaking vehicle shall not be driven to the left of the center of the street if any vehicle approaching from the opposite direction is so near that the vehicle i pulling to the left will be apt to interfere with or endanger the free passage of such approaching vehicle. No vehicle shall pass or attempt to pass another vehicle, .going in -the same direction, in any intersection. Every person using any vehicle on any street, shall operate, drive or ride the same on that portion of such street to the right of the center thereof except where such porti-)n is not in a passable i• condition, or is temporarily blocked for construction purposes or otherwise, and in such event, any such vehicle shall not cross over to the left of the center line of said street except with due regard for the safety and convenience of other vehicles lawfully using such portion of said street. Vehicles moving slowly shall keep as close as possible to the curb to their right, or to vehicles parked along such curb, and shall allow more swiftly moving vehicles free passage to the left. All vehicles shall at all times be driven and operated in a careful manner and with due regard for the safety and convenience of pedestrians and of all other vehicles. No vehicle shall so occupy or shall be so parked upon any street as to Interfere with or interrupt the passage of other vehicles except when lawfully parked at or along the curb of such street in the manner provided by ordinance, and all parking of vehicles in the center of any street, and so-called "double parking„ back of or at the side of lawfl?11y parked vehicles, is hereby specifically prohibited. Every person in charge of a vehicle shall pull to the right of the street when signalled by a vehicle behind, desiring to pass. No vehicle shall be parked with its left side to or along the curb of any street. Vehicles crossing from one side of the street to the other shall do so by turning to the left so as to head in the same direction. as the traffic on the street. 398 No vehicle shall be parked or left or permitted to stand in any street unless the right side of such vehicle be parallel to and within one foot of the right curb or side of such street (where parallel parking is required) or unless the right fron wheal of the vehicle is against the right curb or such street (where angle parking is required). Whenever two vehicles, proceeding upon different streets, meet at the intersection of such streets or enter such intersection at approximately the same time, (except at intersections where traffic signal lights are in operation, and at intersections where stop signs are placed), the vehicle to the right shall have the right of way but no driver of any such vehicle shall exercise such right of way wher}, by reason of the position of the other vehicle, it is or should be apparent to him that the exercise of such right of way might cause a collision between such vehicles. Section 4. Nuisances:: No operator of a motor vehicle shall race his engine or allow or cause smoke to escape therefrom, or make any unnecessary noise in the operation of such motor vehicle. Every motor vehicle shall be equipped with a suitable muffler or muffling device designed to and which will muffle the exhaust from such motor. No person shall operate any such motor vehicle on any street in the City of Salina or run the motor thereof, either while the same is standing or moving, without such muffler, or when the cut out of such muffler is open. No person shall repair any vehicle or any part or tires thereof or paint any vehicle, or perm't the same to be done, on any street, except in case of an emergency, and then only to the extent necessary to permit such vehicle to be removed from the street, and only on the part of such street where parking is permitted. No vehicle shall be washed in any street in any commercial or industrial district as defined by the Zoning ordinance. Section 5, Riding Motor Cycles: No person driving a motor- cycle shall curve to and fro on his vehicle, or drive the same with- out his hands on the handlebars, and no such person shall carry any other person on such vehicle unless the same is equipped with an additional seat for each additional person so carried. I' j Section 6. mineral Processions: No vehicle or pedestrian shall pass through any funeral procession or through any parade i which is being given with the permission of the proper city author- ities, except with the permission of a police officer. 'j Section 7. Driving over Sidewalks: No vehicle shall be driven over or across any curbing or over or across any parking or parkway, and no vehicle shall be driven along over or across I any sidewalk, except at an alley or at a. private entrance for vehicles provided for such purpose. Section S. Hitching Horses: No horse attached to any vehicle shall be permitted to stand upon any portion of any street i unless the driver thereof is in charge of and accompanying the same, or unless such animal is securely tied or hitched to some suitable hitching contrivance. Section 9. Hanging onto or Riding in Vehicles: No person shall ride upon or jump any vehicle without the consent of the driver thereof or hang onto or attach himself or any bicycle or motorcycle which he is riding to any vehicle, and no person when riding in any vehicle shall permit any part of his body to protrude or extend beyond the outer limits of such vehicle. Section 10. Articles Extending from Vehicles: No person owning or driving any vehicle shall allow or permit any object, carried on or in such vehicle, or any part of the body of such vehicle including any end -gate thereof, to extend beyond the front or rear of such vehicle in such manner as to endanger other persons or other vehicles using the streets, or other property within or- adjacent radjacent to the streets, nor in any event unless the objects or parts so protruding or extending beyond the front or rear limits of such vehicles shall be marked with a red flag in the day time or red lantern or red light at night, which shall render such object plainly visible to all other person. No person shall permit any object or article to extend beyond the sides of any such vehicle to such extent that the total width of the vehicle and load is more than eight feet, or so that the distance from the center of the vehicle to the extreme outer point of the object 80 extended on either side is more than five feet. Section 11. Signals by drivers, Backing: The driver or person, in control of any vehicle, intending to slow or stop suddenly or intending to make a left turn, shall extend his hand to the left to indicate such intention. No person shall back any vehicle in anv street or away from curb until the same can be done without 370 danger to vehicles approaching from the rear, which are lawfully using such street, and unless such vehicles lawfully approaching from the rear will have ample time to see the backing vehicle and avoid colliding with the same. Section 12. Traffic Control Lights: During the hours when the traffic control signal lights heretofore installed at the intersections of Santa Pe Avenue with Ash Street, Iron Avenue and Walnut Street or hereafter installed at any intersection, are being operated, all traffic at such intersections shall be governed by and shall obey the regulations hereinafter contained, relating to such traffic control signal lights, and it shall be unlawful for any operator of any vehicle to disobey the directions of such traffic control signal lights, at such intersections, or at any other intersections where traffic control signal lights may be hereafter installed, unless otherwise directed by a police officer. The City Manager shall designate the hours during which such traffic control signal lights shall be operated and shall make such .regulations relating thereto as may be required by the traffic at such intersections. Section 13. Stop and Go Lights: Whenever traffic at any such intersection is alternately directed to proceed and to stop by the use of signals exhibiting colored lights or the words "Go", "Caution" and "Stop", said lights and terms shall indicate, and shall authorize traffic to proceed as follows, except as provided for in Section 23 of this ordinance, to -wit: (a) Green or "Go": Traffic facing the signal may proceed, (straight ahead, or to the right or left in accordance with the regulations herein set forth) exfept that vehicular traffic shall yield the right of way to pedestrians and vehicles lawflilly in a cross walk or intersection at the time such signal was exhibited. (b) Yellow or "Caution", when shown following the green or "Go": Traffic facing the signal shall stop before entering the intersection unless so close to the intersection that a stop can- not be made in safety, (c) Red or "Stop": Traffic facing the signal shall stop before entering; the intersection and remain standing until green or "GO" is shown alone, except that a vehicle in the right hand traffic lane may turn to the right against a red light, after having been brought to a full stop before entering the intersection, and with due regard for the rights and safety of pedestplans and other vehicles. A pedestrian crossing or starting across a street on a green or "go" signal at any intersection controlled by traffic control signals, shall have the right of way over all vehicles, including those making right or left hand turns, until such pedestrian shall have reached the opposite curb, and it shall be unlawful for the operator of any vehicle to fail to yield the right of way to any such pedestrian. Pedestrians shall ,yield the right of way at all such intersections to all vehicles proceeding straight ahead on any green or "go" signal, and pedestrians crossing any street between intersections shall yield the right of way to vehicles proceeding along such street, and any pedestrian crossing any street at any such intersection against a red or "stop" signal or at any place in any block between intersections shall do so at his own risk, Notwithstanding any of the provisions of -is ordinance, all vehi.clilar or pedestrian traffic shall at all times be subject to the direction of any police officer. Section 14. Turning of Vehicles: (a) It shall be unlawful for the operator of any vehicle to make a complete "U" turn at the Intersections of Santa Fe Avenue with Walnut Street and Iron Avenue and Ash Street, and signs warning traffic against such turns shall be placed and maintained at each such intersection. (b) The operator of a vehicle intending to turn to the right at any intersection of streets, or into or from any alley or drive- way, shall approach the point of turning with the right side of his vehicle as near as possible to the right hand edge or curb of the street from which the turn is to be made, and in turning shall keep as close as practicable to the right hand edge or curb of the street from which and into which the turn is to be made. (c) The operator of a vehicle intending to turn to the left at any intersection of streets or into any alley or driveway shall approach the pont of turning as near as possible to and with the left side of his vehicle immediately next to and to the right of the center of the street from which the turn is to be made. At intersections where traffic signal lights are in operation, the driver intending to make a left turn, shall not enter or drive through any line of traffic which may be then proceeding straight ahead on a green or "go" signal, nor shall such turn be completed if the same will interfere with any vehicle proceeding straight ahead on such green or "go" signal. At intersections where traffic signal lights are not in operation, such left turn shall not be completed if the same will interfere with any vehicle proceeding i straight ahead from the opposite direction on the street from which the turn is being made, or proceeding straight ahead in either direction on the street into whic# the turn is to be made, but shall be completed only after danger of such interference with any such vehicles shall have ceased. All such left turns shall be completed by turning the vehicle to the left of the center of the intersection in such manner that the right wheels of the vehicle making such turn shall be to the left of the center po.°nt of the intersection, but the vehicle shall not be turned to the left until it shall have passed to the right of the intersection of the center line of the street from which the turn is being made with the property line of the street into which the turn is to be made, and such vehicle shall keep to the right of the po;nt of i.ntersect°Con of the center line of the street into which the turn is being made with the property of the street from which the turn has been made. Section 15. "U" Turns in Streets: No "U" turn shall be made between intersections on Santa Fe Avenue between Ash Street and Walnut Street or on Iron Avenue between Fourth Street and Ninth Street. No "U" turns shall be made at any place on any street unless such turn can be made without interfering with other traffic on such street and without danger to other traffic, and only when no other traffic is approaching which might collide with the vehicle being turned. Section 16. Speed Limit: No person shall operate any vehicle on any street at a rate of speed greater than thirty miles per hour or at a rate of speed greater than is reasonable and proper, having regard for traffic and the use of the road, and the condition of the road and the kind of vehicle being operated, nor at a rate of speed such as to endanger the property or life or limb of any person; provided, that the speed limit provided for in this section shall not apply to streets adjacent to schools as in this ordinance otherwise provided for. Section 17. Speed Limits past Schools: No person shall drive any motor vehicle on any portion of any street adjacent to any public or private school grounds at any time when any school children are on or adjacent to the grounds or buildings of such school, or approaching the same, at a rate of speed greater than fifteen miles per hour, or at a rate of speed greater than is reasonable and proper, having regard for the traffic and use of the road and the condition of the road, nor at a rate of speed such as to endanger the life or property or limb of any person; provided further that the driver of any vehicle traveling on any street adjacent to any private or public school building, shall bring such vehicle to a complete stop before passing or approach- ing such school building whendver he is signalled or requested so to do by a traffic officer or traffic director placed in such street for the purpose of directing traffic past any such school building, and after being signalled to stop, it shall be unlawful for the driver of any such vehicle to proceed along any such street until such street is clear of school children and until the person giving such signal shall have signalled the driver of such vehicle to proceed. Section 18. Parking of Vehicles: Except as herein otherwise provided, all vehicles when parked or left standing in any street shall be parked parallel with the curb or gutter line of such street, and with the right hand side of the vehicle not more than one foot distant from the said right hand curb or gutter line of such street; Provided, that on Iron Avenue between Delaware Street and Marymount Road, no vehicle shall be parked or stopped on the concrete pavement slab or within two feet from either side of such pavement. Section 19, Angle Parking: On the following named streets, vehicles shall be parked with the right side of any such vehicle toward and at an angle of 500 with the right hand curb line of such street, and with the right front wheel of such vehicle against the curb or on the curb line of such street, and it shall be the duty of the City Manager and the Street Superintendent to be caused to be plainly marked upon the curb or along the curb line, by means of painted lines, set at an angle of 500 with the curb line, and nine (9) feet distant from center to center of such lines at the curb line, indicating the spaces within which and the angles at which i all vehicles shall be parked on such portion of such streets, and it shall be unlawful for any driver or owner of any vehicle to park or permit the same to be parked on any portion of any such street except within the spaces so indicated, and at the angles so indicated, the streets upon which such angle parking is to be required, being as follows; Santa Fe Avenue between Pine Street and Mulberry Street, East side of Santa Fe Avenue from Claf lin Avenue to Kirwin Avenue East side of Santa Fe Avenue from Ellsworth Avenue to the alley north of Ellsworth Avenue, West side of Santa Fe Avenue from Mulberry Street to South Street, West side of Santa Fe Avenue from Jewell Avenue to Kirwin Avenue, Fifth Street between Ash Street and Walnut Street, Seventh Street between Elm Street and Walnut Street, except on the west side thereof between Iron Avenue and the driveway south of the Dost Office, East side of Eighth Street between Ash Street and Iron Avenue, Iron Avenue between Fourth Street and Ninth Street, Mulberry Street between Santa Fe Avenue and Fifth Street, Claf lin Avenue between Highland Avenue and Fourth Street, Provided, further, that wherever the curbs of any street have been set back and additional width of paving provided, the City Manager may designate such spaces for angle parking and may cause the same to be marked for such purpose, in which event they shall be governed by the same regulations as streets specifically designated for such purpose. Where curbs have been cut for driveways, but such drive- ways are not being used for such purpose, the space along the curb i line in front of such driveways shall be used for parking. Section 20. No Parking Zones At the end of each block with- in the business district, and specifically upon all streets where angle parking is required and at such other places on any street as the City Manager may deem necessary or as may be ordered by the Board of Commissioners, zones shall be set aside and designated where parking of vehicles shall be prohibited, and it shall be the duty of the City Manager to cause signs to be erected or the curbs to be marked, for such distance within each such district, designating and setting apart such no parking zones, as in his judgment is reasonable and proper for the safety of traffic and pedestrians using such streets, or for such distance as may be hereafter specifically ordered by the Board of Commissioners, and when such signs are erected or painted, it shall be unlawful for any person to park any vehicle within any zone so designated and marked. Section 21. Parking Near Fire Hydrants: It shall be unlawful for the driver of any vehicle to park such vehicle within ten feet of any fire hydrant. Section 22. Signs and Obstructions in Streets or Parkings: It shall be unlawful for any person to place in any street any sign relating to the parking of vehicles or purporting to limit, prohibit or direct the parking of vehicles or vehicular traffic, except such signs as are placed in such streets by the officers of the City of Salina pursuant to th3_s ordinance or other ordinances of said city or by or under the authority or direction of officers of the City of Salina or other police regulations, or signs placed in such street by the State Highway Department, or other governmental authority, or to place in any part of any street, including the parkway in public sidewalk, any post, fence, wire or other obstruc- tion of any kind, except such as may be specifically authorized or directed by the Board of Commissioners or by some duly authorized officer of the city, or other public authority, and no sign of any kind, and no such post, fence, wire or other obstruction of any kind except such as are hereby permitted shall be placed in any portion of any street including the parking and public side- walks adjacent thereto. Section 23, Fire, Police and Ambulance Vehicles: Vehicles i of the Police Department and Fire Department of the City of Salina, when responding to emergency calls, and ambulances when responding to emergency calls or when carrying passengers requiring emergency treatment shall have the right of way over all other vehicles in i all streets, provided that such vehicles when traveling in response to such emergency call shall sound a siren to indicate the nature of any such vehicle, and provided further that the driver of any such vehicle shall use due care in operating such vehicle, and it shall be the duty of the driver of every other vehicle on any street, when the siren of any such emergency vehicle is sounded, to pull his vehicle as far to the right hand edge of such. street as is I possible and brim; such vehicle to a stop until such emergency vehicle has passed. No driver of any vehicle equipped with a siren as provided for herein shall sound such siren except at such times as are provided for herein. Section 24. Use of Sirens: It shall be unlawful for the owner or driver of any vehicle to equip or permit any such vehicle, except police, fire department or ambulance vehicles, to be equipped i with a siren or with any horn producing a sound resembling; that of a siren, such as is used by police, fire department and ambulance vehicles, or to use upon or in connection with any such vehicle any such siren or other horn which produces a sound similar to that pro- duced by any such siren. Section 25, Motor Drivers: It shall be unlawful for any person to drive or operate any motor vehicle on any street unless such person be duly licensed as required by the lads of the State of Kansas, or by the state of his residence, relating to the licensing of the drivers of motor vehicles and unless such persons shall have in their possession the license and/or badge required by the laws 37 6 Of the State of Kansas or such other state evidencing the right of such i driver to operate the particular kind of vehicle lr.hich he may be then operating. Section 26. Age of Motor Drivers: It shall be unlawfv.l for any person under the age of 13 ,years to drive or operate on any street in the City of Salina, any motor vehicle at any time or in any event and it shall be unlawful for any person to cause or permit any person under the age of 13 years to drive or operate or to be in possession of any vehicle on any street in any event; provided that no person under the age of 16 years of age shall drive or operate or be perm_Itted by any other person to drive or operate any motor vehicle on any street, unless such person_ under the age of sixteen years, and over the afire of thirteen years, shall have been licensed As en operator by the State of Kansas, and shall have secured the written consent of parent or guardian of such person as required by law. Section 27. Drivers of Public or Common Carriers: It shall be unlawful for any person under the age of eighteen years to operate or drive, or for any person to cause, permit, or direct any person under the age of eighteen years to operate or drive on any street, a motor vehicle while in use as a pi.-blic or common carrier of person or property, and it shall be unlawful for any person under the age of 21 years to drive any motor vehicle while in use as a public passenger carrvinq vehicle. Section 28, Persons Prohibited from Driving: It shall be unlaw- ful for any person who is an habitual drunkard or who is addicted to the use of narcotic drugs, or who has been adjudged insane, an idiot, imbecile, epileptic or feeble minded, and who has not at the time of the application been restored to competency by judicial decree or re- leased from a hospital for insane or feeble minded by official certi- ficate that such person is competent and capable, or for any person who is afflicted with or suffering from such physical or mental dis- ability or disease as will serve to prevent such person from exercising reasonable and ordinary control over a motor vehicle while operating the same, to drive or operate any motor vehicle on any street, and it shall be unlawful for any person to cause, permit or direct any such person as above described to operate any motor vehicle on any street. 7.�'.-�=+ Section 29. Section 30. Taking or Moving Automobile: It shall be un- lawful for any person to enter or operate the motor vehicle of any other person, or to take or remove the automb')ile of any other person fro -I any place where it has been left or kept by the owner or person in charge, without the consent of the owner or person in charge thereof, except b -v or under the direction of a police officer. j Secti -�n 31. Report of Accidents: It shall be the duty of the driv of any vehicle and of the owner or other person in i charge ther f in case of the disability of such driver, which collides with r in a.ny manner causes injury or damage to any person, property r other vehicle in the City of Salina to stop and give reasonable ssistance to any person so injured, and to give to any person, s njured, or to the occupant, owner or person in charge of any operty or other vehicle so damaged, the full name of the driver nd of the owner of such vehicle, and the motor and license numb s thereof, and to make a report � k to the police department of the ty of Salina immediately there- w :3 after, giving the name of the drive and owner of such vehicle, with the motor and license numbers the of, description of any property or other vehicle damaged as a r\so ch collision, a 4 the name of any person injured and the nowner or person in charge of any other propertyor vehiced , and such other details with respect to such colli:e cause thereof as may be required by any police officer, and it sh\ 1 be unlawful for the driver or operator of any such vehicle or the o er or person in charge thereof, to leave the scene of any such , cident or collision without having given to the person or persons s in- jured and to the person or persons owning, occupying or in cha e of other property or any other vehicle so damaged, the inf ormatio herein required. Section 32. Motor Vehicle Lights: vuring the period between one half hour after sunset and one half hour before sunrise, every motor vehicle using any street in the City of Salina shall show two lamps on the front of such. vehicle, (except motorcycles which shall show one lamp) emitting white light visible at a distance of 300 feet in the direction toward which such vehicle is proceeding and shall show at least one red light from the rear of such vehicle, andonly from the rear, which shall be visible for at least 200 feet from the rear end of such vehicle. If any trailer :Is attached to the rear end of such vehicle, a red l.i?ht as akbove described shall be attached to the rear end of any such trailer. 378 Section 33, Bright Lights: No driver of any motor vehicle while operating on any street shall use any headlights unless the same are properly shaded or supplied with lenses of ground or frosted glass, or with dispersive lenses or glass or with a mechanical apparatus for turning down such illuminating lights, so that such lights will not blind or dazzle other users of the highway or make it unsafe for such other users to ride, drive or walk thereon, and such lamps shall be ad- justed by the proper direction of said lamps downward, and the adjust- ment of the bulb, so that the uppermost part of the light ray shall not rise above the level of the top of the front lamp, or glass opening, vithin a distance of 75 feet ahead of such vehicle. Section 34. Spot Lights: It shall be unlawful for the di-iver of any motor vehicle to direct the rays of a light known as a spot light upon any street in the Citti of. Salir.a, except vehicles operated by peace officers. Section 35. Horns or signals: Every motor vehicle used on any street in the City of Sali­a shall have a suitable horn or other adequate signal in good working order, capable of -producing a sound of sufficient volume to give warning of the approach of such vehicle, to pedestrians and to the drivers of other vehicles, but the use of unnecessarily loud or raucous horns or other signals producing a sound of such volume or quality as tc surprise or startle pedestrians or the drivers of other vehicles is hereby prohibited. Section 36, Brakes: Every vehicle operated on any street shall be equipped with good and sufficient brakes, which shall at all times be kept in good working order, and sufficient to enable the driver of such vehicle to properly control the same. Section 37. Riding on Running Boardsi etc:- No person shall ride upon the running board or fenders of any vehicle or at any place in any vehicle other than in the space intended and provided for the carrying of passengers or property, except in case of emergency or when so directed by a police officer. Section 38, Arterial Hi�hwMa. (a) The following named streets within the limits herein mentioned shall be and they are hereby designated as areterial highways, to -wit: Santa Fe Avenue from the south line of Otis Street to the North line of Claflin Avenue: Iron Avenue from the east line of College Avenue to the west line of Marymount Road: Ninth Street from the north line of Euclid Avenue to the south line of Cloud Street, except at its intersection with Iron Avenue. Ash Street from the east line of Seventh Street to the west line of Phillips Street, except at its intersection with Ninth Street: College Avenue from the north line of Elm Street to the south line of University Place, except at Tron Avenue. Section 39. Vehicles Stop: No vehicles shall enter or cross any arterial highway as defined in the preceding section of this ordinance (except at intersections controlled by the traffic signal lights) without first coming to a full and complete stop upon arriving at the street line of such arterial highway, and such vehicle shall not enter such highway until danger of colliding with any vehicles on such arte?ial highway has passed. Section 40. Additional Stops: No vehicle shall enter any of the following named streets, from the streets hereinafter designated, without first being brought to a full and complete stop at the street line of the street which is to be entered, and until, danger of colliding with vehicles lawfully proceeding along such streets has passed, to -wit: Ash Street, from Columbia Avenue (south side only), from Penn Avenue, and from Third Street, Section 41. Stop Signs: It shall be the duty of the City Manager and Street Superintendent to procure and place at all inter- sections of other streets with arterial highways as defined by i ordinance, and at all other intersections where vehicles are required to stop, except at exits from alleys and private driveways into streets, appropriate signs bearing the word "STOP" visible to the drivers of vehicles approaching the intersections where such vehicles are required to stop. Section 42.St� op t Alleys and Driveways: No person shall i drive or back any vehicle from any alley or private driveway into any street without first bringing such vehicle to a complete stop before crossing the sidewalk line, if there is a sidewalk along such street, or before entering the travelled portion of the street if there be no sidewalk along such street, and after stopping the driver of such vehicle shall -not enter the street until danger of colliding with traffic lawfully proceeding along such street has passed. i Secti,-n 43. Entering Alleys or Driveways: It shall be unlawful for any person driving any vehicle to enter any alley or private driveway from any street, when crossing any sidewalk or the space in any such alley or private driveway used by pedestrians as a side- walk or cross -walk across such alley or driveway, at a rate of speed greater than ten miles per hour. 380 Section 44. Slow Signs: Wherever at any intersection or other place on any street the volume or condition of the traffic in such, in the 'dudgment of the City Manager and the Chief of Police, as to make the same necessary for the safety of traffic, or wherever on any street the Board of Commissioners may order the same, signs shall be placed in such streets bearing the word "SLOW". Whenever any such sign is placed in any street, the same shall be deemed to be a warning to all traffic approaching such sign that a dangerous or hazardous condition exists, and it shall be the duty of the driver of any vehicle approaching such sign or entering any intersection where such sign is placed to slow down the speed of his vehicle to such speed as is reasonable under the circumstances in view of the condition of traffic at such place, and so as to have his vehicle under sufficient control to avoid any collision with any other vehicle, person or object, and he shall not increase the speed of his vehicle until the danger thereof has passed. Section 45, Two Hour Parking: No person shall park or leave or vause or permit to be parked or left, any vehicle for more than two hours at any one time, and in any one place, between the hours of 7 o'clock A. M. and 7 o'clock P.M. on any day of the week except Sunday on any of the following streets in the City of Salina between the limits hereinafter mentioned, to -wit: On Santa Fe Avenue from Ash to 375 feet south of Walnut, On Fifth Street from Ash Street to Walnut Street, On Seventh Street from Ash Street to Walnut Street, On Iron Avenue from Fourth Street to Eighth Street, On Walnut Street from Fifth Street to Seventh Street, On Ash Street from Fifth Street to Seventh Street, Provided, that the parking limits herein provided for shall not apply where other limits within the zones hereby created are otherwise specifically provided for by ordinance. Section 46, Fifteen Minute Parking Zones: The City Manager shall and he is hereby authorized and directed to designate and have marked three zones on each side of each block on Santa Fe between Ash Street and Walnut Street, and two zones on the west; side and one zone on the east side of Fifth Street between Iron Avenue and Ash Street, and two zones on each side of Fifth Street between Iron Avenue and Walnut Street with parking spaces in each of such zones for five cars, and one zone in each block on each stde of Iron Avenue between Fifth Street and Seventh Street, with parking spaces in each of such zones for three cars, and all of the south side of Iron Avenue between Seventh Street and the alley west of Seventh Street, and all of the west side of Seventh Street 3 S I -- -- - - - r - - -- , _ -- - -- — — - --. - -- - - i between Iron Avenue and the driveway south of the Post Office � building, and after such zones are designated and marked it shall i be unlawful for any person to park or leave or cause or permit to i be parked or left in any one space in any such zone, any vehicle for more than fifteen minutes at one time, between the hours of 9 o'clock A, M. and 7 otclock P. M. Section 47. Thi Minute Parking Zone: Two parking zones for five cars each, are hereby established on each side of Santa i Fe Avenue in the Citv of Salina between Ash Street and Elm Street. The City Manager shall designate and have marked such zones, and after they are so marked, it shall e unlawful for any person to park or leave or cause or perm;t to be parked or left in any space in any such zone, any vehicle for more than thirty minutes at any one time between the hours of 7 o'clock A. M. and 7 otclock P.M. Section 48. Marking of Vehicles: The Chief of Police shall cause all vehicles parked on that portion of the streets designated i in Sections 45 to 47, inclusive, of this ordinance, to be marked in such manner as to distinguish such vehicles during the hours in which the parking requirements within such limits are effective, and any I person who shall remove, erase, or destroy or cause to be removed, i erased or destroyed any mark placed upon any such vehicle or upon the tires thereof by any police officer, otherwise than for the purpose and in the course of co; -plying with the provisions of this ordinance, shall be deemed guilty of a violation:of this ordinance. Section 49. Taxicab and Bus Parking:_ It shall be unlawful for anv person to use any part of any street for the parking of any taxicab or for a taxicab stand or station except as specifically pre- scribed or designated in the ordinances of the City of Salina relating; to taxicabs, and it shall be unlawful for any person to use any i portion of any street for the parking of any passenger carrying i bus or stage or as a station or stand for any such bus or stage except as specifically prescribed or designated by an ordinance of the City of Salina relating thereto or as permitted in any franchise ordinance or agreement duly entered into between the Board of Commissioners of said city and owners or operators of sny such 1 bus or stage. 382 as a truck and trailer or truck and semi -trailer on any portion of any street in the City of Salina where angle parking is required by ordinance at any time either for loading or unloading property or for any other purpose. It shall -be unlawful for any person to park or leave any vehicle of any kind having a total length of more than 18 feet on any street in the City of Salina where angle parking of vehicles is required by ordinance, except temporarily for the purpose of loading or unloading merchandise and then only when the use of such vehicle for such purpose does not interfere with the -regular traffic on such street. Any projection or extension from the rear of any vehicle whether a part of such vehicle or of the contents thereof shallbe deemed to be included in the total length of such vehicle under the provisions of this ordinance and in the case of a horse drawn vehicle the distance from the horses heads to the rear and of the vehicle or any extension thereof shall be included in the length of such vehicle. All vehicles above referred to when parked or left in any street in the City of Salina (except as herein specifically permitted) shall be parked or left in some portion of the street where parking parallel with the curbing is required by ordinance and when so parked or left such vehicle shall have its right wheels next to and not more than one foot from the curb line of such street. Section 51. Use of. Alleys by Trucks:- It shall be unlawful count of the danger to other traffic and to property of other persons cap �t reby and the hazard to other traffic when such vehicle are driven rom alleys, for any person to drive or cause to be driven into or to_in any alley in the City of Salina, where the width of such alley more than 10 feet, any combination of vehicles commonly known as tr and trailer or truck and semi -trailer. Section 52. Parking on Bridges: It shall be unlawful for persons to stop or park any vehicle on any bridge in the City of Salina except in case of emergency. Section 53. No Parking Parking: It shall be unlawful for any Section 50. No Parking Zones at Schools: - Where are hereby created "No Parking" zones 20 feet in length along the curb line immediately in front of and adjacent to the entrance or entrances of every school building in the City of Salina and on the north side of Mulberry Street adjacent to the Washington Nigh School Building, and on the west side of Ninth Street adjacent to the 382 � I i grounds of the Bartlett School, and it shall be unlawful for any person to park any vehicle in any such "No Parking" zone. Section 54. "No Parking" Signs: Each zone or place on any street in the City of Salina wherearkin is p g prohibited under the provisions of this ordinance or any other ordinance of said city shall be plainly marked and designated by signs or by having marked ., g on the curb the words "No Parking" and this ordinance shall not be r effective at any such zone or place unless the same is so marked, i except in case of parking near a fire hydrant. Section 55, All Night Truck Parking: It shall be unlawful for any person to use any street in the City of Salina for what is commonly known as the all-night parking of any truck or com- mercial vehicle, or to park or permit any such truck or commercial vehicle to stand all night on any street; and no such truck or commercial vehicle shall be parked or kept all night in any drive- way or front yard of any private premises in the City of Salina, i in any Residential District as defined by the Zoning Ordinance of said City or amendments thereto, between the street line and the building set back line as defined by such zoning ordinance. Section 56. Parking on Sidewalk or in Driveways and Alleys: It shall be unlawful for anyperson to park any vehicle on any public sidewalk or so that any part of such vehicle or the contents thereof extends across such sidewalk, or to park any vehicle in or in front of any private driveway without the consent of the owner or person entitled to the use of such driveway. It shall be unlawful to park any vehicle in any alley, except for the purpose of loading or un- loading merchandise or other property from or onto premises adjacent to such alley, and then only for such time as is reasonably necessary to complete such loading or unloading. Section 57. Removal of Vehicles: Any vehicle parked on any street in violation of the provisions of this ordinance may be removed by or under the direction of any police officer to any proper parking space or to the police station, and the owner of such vehicle shall pay the reasonable cost of such removal in addition to any fine which may be assessed for any violation of this ordinance. Section 58. Ordinances Repealed: That Ordinances numbered 1983, 2053s 3037, 3049, 30712 3140, 3173, 33179 3336, 3356, 3 6409 3667, 38229 3882, 3934, 3984, 4051, 4056, 41082 4112, 41590 42619 4280, 4305, and any other ordinances or parts of ordinances specifically in conflict with any of the provisions of this ordinance, insofar as they so conflict, be and they are hereby repealed. Speed LimitA: No person shall operate <any vehicle on any street at a rate of speed greater than thirty miles per hour or at a rate of speed greater than is reasonable and proper, having regard for traffic and the usp of the road, and the kind of vehicle being operated, and the condition of the road,/nor at a rate of spped such as to endanger the property or life or limb of any person; provided �. that the,-. speed limit provided for in this section shall not apply to streets adjacemt to shhools as in this ordinance other- wise provided for. Section 17. Speed Limits past Schools: No person shall drive any motor vehicle on any portion of any street adjacent to any public or private school grounds at any time when any school children are on or adjacent to the grounds or bu;ldings of such school, or approaching the same, at a rate of speed greater than fifteen miles per hour, or at a rate of speed greater than is reasonable and proper, having regard for the traffic and use of the road and the condition of the road, nor at a rate of speed such as to endanger the life or property or limb of any person; provided further that the driver of any vehicle traveling on any street adjacent to any private or public s'hhool building, shall bring such vehicle to a complete stop before passing or approaching such school building whenever he is signalled or requested so to do by a traffic officer or traffic director placed in such street for the purpose of directing traffic past any such school building, and after being signalled to stop, it shall be unlawful for the driver of any such vehicle to proceed along any such street until such street is clear of school children and until the person giving such signal shall have signalled the driver of such vehicle to proceed, Section 18. Parking of Vehicles: Except as herein otherwise provided, all vehicles when parked or left standing in any street shall be parked parallel with the curb or gutter line of such street, and with the right hand side of the vehicle not more than one foot distant from the said right hand curb or gutter line of such street; Provided, that on Iron Avenge between Delaware Street and Marymount Road, no vehicle shall be parked or stopped on the concrete pavement slab or within two feet from either side of such pavement. The owner, operator or driver or person in charge of or in control of any vehicle used, propelled, driven or parked upon the streets of the City of Salina, and all persons using or occupying any such streets for any purpose, shall conform to and obey all of the rules, regulations and provisions hereinafter set forth in this ordinance, with respect to the use and occupancy of such streets and with respect to the use, operation and/or parking upon the streets in the City of Salina of any vehicle or vehicles owned, operated, driven by or under the control of any such person and shall cause the same to be conformed to, observed and obeyed by any person in or under his control, charge or direction. Section 3. Rules of the road: Vehicles meeting, approaching f om opposite directions, shall pass each other on the right. A vehicle overtaking another vehicle from the rear shall pass on the left side of the overtaken vehicle and shall not pull over jin front of the overtaken vehicle until entirely clear of it. In passing an overtaken vehicle, the overtaking vehicle shall not be driven to the left of the center of the street if any vehicle approaching from the opposite direction is so near that the vehicle pulling to the left will be apt to interfere with or endanger the free passage of such approaching vehicle. 0.1 No vehicle shall pass or attempt to pass another vehicle, i ing in the same direction, in any intersection. Every person using any vehicle on any street, shall operate, drive or ride the same on that portion of such street to the right of the center thereof except where such portion is not in a passable condition, or is temporarily blocked for construction purposes or otherwise, and in such event, any such vehicle shall not cross over to the left of the center line of said street except with due regard for the safety and comnience of other vehicles law- fully using such portion of said street. Vehicles moving slowly shall keep as close as possible to the curb to their right, or to vehicles parked along such curb, and shall allow more swiftly moving vehicles free passage to the left. All vehicles shall at all times be driven and operated in a ~ careful manner and with due regard for the safe convenience t`J and i iof pedestrians and of all other vehicles. No vehicle shall so occupy or shall be so parked upon any street as to interfere with or interrupt the passage of other vehicles except when lawfully parked at or along the curb of such street in the manner provided faa by ordinance, and all parking of vehicles in the center of any street, and so-called "double parking" back of or at the side of lawfully parked vehicles, is hereby specifically prohibited. Every person in charge of a vehicle shall pull to the right Of the street when signalled by a vehicle behind, desiring to pass. No vehicle shall be parked with its left side to or along the curb of any ,. s treet. Vehicles crossing from one side of the street to the other shall do so by turning to the left so as to head in the same direction as the traffic on the street. No vehicle shall be parked or left or permitted to stand in any street unless the right side of such vehicle be parallel to and within one foot of the right curb or side of such street (where parallel parking is required) or unless the right front wheel of the vehicle is against the right curb of such street (where angle parking is required). L` Whenever two vehicles, proceeding upon different streets, meet at the intersection of such streets or enter such intersection at approximately the same time, (except at irAersections where traffic signal- lights are in operation, and at intersections where stop signs are placed), the vehicle to the right shall have the right of way but no driver of any such vehicle shall exercise such right of way when, by reason of the position of the other vehicle, it is or ohou3.dbe apparent to him that the exercise of such right of way might cause a collision between such vehicles. Section 4, Nuisances: No operator of a motor vehicle shall race his engine or allow or cause smoke to escape therefrom, or make any unnecessary noise in the operation of such motor vehicle. Every motor vehicle shall be equipped with a suitable muffler or muffling device /designed to and which will muffle the exhaust from such motor. No person. shall operate any such motor vehicle on any street in the or run the motor thereof, City of Salina/either while the same is standing or moving, without such muffler, or when the cut out of such muffler is open. No person shall repair any vehicle or any part or tires thereof. or paint any vehicle, or permit the same to be done, on any street, except in case of an emergency, and then only to the extent necessary to permit such vehicle to be removed from the street, and only on the part of such street where parking is permitted. No vehicle shall be washed in any street in any commercial or industrial district as defined by the zoning ordinance. Section 5. Riding d4QV"""""Niotor Cycles No person driving a motorcycle shall curve to and fro on his vehicle, or drive the same without his hands on the handlebars, and no such person shall carry any other person on such vehicle unless the same is equipped with an additional seat for each additional person so carried. Section 6. Funeral Processions: No vehicle or pedestrian shall pass through any funeral procession or through any parade which is being given with the permission of the proper city authorities, except with the permission of a police officer. Section 7. Driving over Sidewalks: No vehicle shall be driven over or across any curbing or over or across any parking or parkway, and no vehicle shall be driven along over or across any sidewalk, except at an alley or at a private entrance for vehicles provided for such purpose. Section 8. Hitching Horses: No horse attached to any vehicle shall be permitted to stand upon any portion of any street unless the driver thereof is in charge of and accompanying the same, or unless such animal is securely tied or hitched to some suitable hitching contrivance. Section 9. Hanging onto or Riding in Vehicles :No person shall ride upon or jump any vehicle without the consent of the driver thereof or hang onto or attach himself or any bicycle or motorcycle which he is riding to any vehicle, and no person when riding in any vehicle shall permit any part of his body to protrude or extend beyond the outer limits of such vehicle. Section 10, Articles Extending from Vehicles: No person owning or driving any -'vehicle shall allow or permit any object, carried on or in such vehicle, or any part of the body of such vehicle including any end -gate thereof, to extend beyond the font or rear of such vehicle in such manner as to endanger other persons or other vehicles using the streets, or other property with - or adjacent to in/Jhe streets, nor in any event unless the objects or parts so protruding or extending beyond the front or rear limits of such vehicles shall be marked with a red flag in the day time or red lantern or red light at night, which shall render such object plainly visible to all other persons. No person shall permit any object or article to extand beyond the sides of any such vehicle to such extent that the total width of the vehicle and load is more than eight feet, or so that the distance from the center of the vehicle to the extreme outer point of the object so extended on either side is more than five feet. Section 11, SiEnals by drivers, Backing: The delver or person in control of any vehicle, intending to slow or stop suddenly or intending to make a left turn, shall extend his hand to the left to indicate such intention. No person shall back any vehicle in any street or away from any curb until the same can be done ri thout danger to vehicles approaching from the rear, which are lawfully such lawfully using such street, and er..leas/vehicles/approaching from the rear will have ample time to see the backing vehicle and. avoid colliding with the same. Section 12, Traffic Control Lights: Dearing the hours when the traffic control signal lights heretofore installed at the intersections of Santa Fe Avenue with Ash Street, Iron Avenue or hereafter installed at any intersection, acid Walnut Street,/are being operated, all traffic at such inter -- sections shall be governed by and shall obey the regulations herein- after contained, relating to such traffic control signal lights, and it shall be unlawful for any operator of any vehicle to disobey the directions of such traffic control signal lights, at such intersections, or at any other intersections where traffic control sig -nal lights may be hereafter installed, unless otherwise directed by a police officer. The City Manager shall designate the hours during which such traffic control signal lights shall be operated and shall make such regulations relating thereto as may be respired by the traffic at such intersections. Section 13. Stop and Go Lights: Whenever traffic at any such intersection is alternately directed to proceed and to stop by the use of signals exhibiting colored lights or the words "Go", "Caution" and "Stop", said lights and terms shall indicate, and shall authorize traffic to proceed as follows, except as provided for in Section 23 of this ordinance, to wit: 7 (a) Green or "Go": Traffic facing the signal may proceed, (straight ahead, or to the right or left in accordance with the regulations herein set forth) except that vehicular traffic shall yield the -right of way to pedestrians and vehicles lawfully in a cross walk or intersection at the time such signal was exhibited. (b) Yellow or "Caution", when shown following the green or "Go": Traffic facing the signal shall stop before entering the intersection unless so close to the intersection that a stop can- not be made in safety. (c) Red or "Stop*: Traffic facing the signal shall stop before entering the intersection and remain standing until green or "Go" is shown alone, except that a vehicle in the right hand traffic lane may turn to the right against a red light, after having been brought to a full stop before entering the intersection and with due regard for the rights and safety of pedestrians,*. A pedestrian crossing or starting across a street on a green or "go" signal at any intersection controlled by traffic control signals, shall have the right of way over all vehicles, including those making right or left hand turns, until such pedestrian shall have reached the opposite curb, and it shall be unlawful for the operator of any vehicle to fail to yield the right of way to any such pedestrian. Pedestrians shall yield the right of way at all such intersections to all vehicles proceeding straight ahead on any green or "go" signal, and pedestrians crossing any street between interseoti6na shall yield the right of way to vehicles proceeding along such street, and any pedestrian crossing any street at any such intersection against a red or "stop" signal or at any place in any block between intersections shall do so at his own risk. Not- withstanding any of the provisions of this ordinance, all vehicular or pedestrian traffic shall at all times be subject to the direction of any police officer* Section 14. Turning of Vehicles_: (a) It shall be unlawful for the operator of any vehicle to make a complete "U" turn at the inter- sections of Santa Fe Avenue with Walnut Street and Iron Avenue and Ash Street, and signs warning traffic against such turns shall be placed and maintained at each'such intersection. (b) The operator of a vehicle intending to turn to the right at any intersection of streets, or into or from any alley or driveway, shall approach the point of turning with the right side of his vehicle as near as possible to the right hand edge or curb of the street from which the turn is to be made, and in turning -shall keep as close as practicable to the right hand edge or curb of the street from which and into which the turn is to be made. ,4--. (c) The operator of a vehicle intending to turn to the left at any intersection of streets or into any alley or driveway shall approach the point of turning as near as possible to and with the left side of his vehicle immediately neat to and to the richt of the center of the street from which the turn is to be made/. At intersections where traffic signal lights are in operation, the driver intending to make a left turn, shall not enter or drive through any line of traffic which may be then proceeding straight ahead on a green or "go" signal, nor shall such turn be completed if the same will interfere with any vehicle proceeding straight ahead on such green or "got' signal. At intersections where traffic signal lights are not in operation,/such left turn shall not be completed if the same will interfere with any vehicle proceeding straight ahead from the opposite direction on the street from which the turn is being made, or proceeding straight ahead in either direction on the street into which the turn is to be made, but shall be completed only after danger of such interference with any such vehicles shall have ceased./ All such left turns shall be completed by turning the vehicle to the left of the center of the intersection in such manner that the right wheels of the vehicle making such turn shall be to the left of the center point of the intersection, but the vehicle shall not be turned to the left until it shall have passed to the right of the intersection of the center line of the street from which the turn is being made with the property line of the street into which the turn is to be made, and such vehicle shall keep to the right of the point of intersection of the center line of the street into which the turn is being made with the property M of the street f rom which the turn has been made. Section ,15. "U" Turns in Streets: No "U" turn shall be made between intersections on Santa Fe Avenue between Ash Street and Walnut Street or on Iron Avenue between Fourth Street and Ninth Street. No "U" turns shall be made at any place on any street unless such turn can be made without interfering with other traffic on such street and without danger to other traffic, and only when no other traffic is approaching which might collide with the vehicle being turned. Section 16. Speed Limits: No person shall operate f -1 -any vehicle on any street at a rate of speed greater than thirty y miles per hour or at a rate of speed greater than is reasonable and proper, having regard for traffic, and the use of the goad, and the kind of vehicle being operated, and the condition of the road,/nor at a rate of spped such as to endanger the property or life or limb of any person; provided that the':: speed limit provided for in this section shall not apply to streets adjacemt to shhools as in this ordinance other- wise provided for. Section 17. Speed Limits past Schools: No person shall drive any motor vehicle on any portion of any street adjacent to any public or private school grounds at any time when any school children are on or adjacent to the grounds or buildings of such school, or approaching the same, at a rate of speed greater than fifteen miles per hour, or at a rate of speed greater than is reasonable and proper, having regard for the traffic and use of the road and the condition of the road, nor at a rate of speed such as to endanger the life or property or limb of any person; provided further that the driver of any vehicle traveling on any street adjacent to any private or public sbhool building, shall bring such vehicle to a complete stop before passing or approaching such school building whenever he is signalled or requested so to do by a traffic officer or traffic director placed in such street for the purpose of directing traffic past any such school building, and after being signalled to stop, it shall be unlawful for the driver of any such vehicle to proceed along any such street until such street is clear of school children and until the person giving such signal shall have signalled the driver of such vehicle to proceed. Section 18. Parking of Vehicles: Except as herein otherwise provided, all vehicles when parked or left standing in any street shall be parked parallel with the curb or gutter line of such street, and with the right hand side of the vehicle not more than one foot distant from the said right hand curb or gutter line of such street; Provided, that on Iron Avenge between Delaware Street and Marymount Road, no vehicle shall be parked or stopped on the concrete pavement slab or within two feet from either side of such pavement. Section 19. Angle Parking: On the following named streets, vehicles shall be parked with the right side of any such vehicle 0 toward and at an angle of 50 with the right hand curb line of such street, and with the right front whebl of such vehicle against the curb or on the curb line of such street, and it shall be the duty of the City Manager and the Street Superintendent to be caused to be plainly marked upon the curb or along the curb line, by means of painted lines, set at an angle of5©o,,*ith the curb line, and nine (9) feet distant from center to center of such lines at the curb line, indicating the spaces within vhiah and the angles at which all vehicles shall be parked on such portion of such streets, and it shall be unlawful for any driver or owner of any vehicle to park or permit the same to be parked on any portion of any such street except within the spaces so indicated, and at the angles so indicated, the streets upon which such angle parking is to be required, being as follows: Santa Fe Avenue between Pine Street and Mulberry Street, East side of Santa Fe Avenue from Claflin Avenue to Kirwin Avenue, East side of Santa Fe Avenue from 'Ellsworth Avenue to the alley north of Ellsworth Avenue, West side of Santa Fe Avenue from Mulberry Street to South Street West side of Santa Fe Avenue from Jewell Avenue to girwin Avenue, Fifth Street between Ash Street and Walnut Street, Seventh Street between Elm Street and Walnut Street, except on the west side thereof between Iron Avenue and the driveway south of the Post Office. East side of Eighth Street between Ash Street and Iron Avenue, Iron Avenue between'Fourth Street and Ninth Street, Mulberry Street between Santa Fe Avenue and Fifth Street, Claflin Avenue between Highland Avenue and Fourth Street, Provided further, that wherever the curbs of any street have been set back and additional width of paving provided, the City Manager may designate such spaces for angle parking and may cause the same to be marked for such purpose, in which event they shall be governed by the same regulations as streets specifically designated for such purpose. Where curbs have been cut for driveways, but such driveways are not being used for such purpose, the space along the curb line in front of such driveways shall be used for parking. Section 20. No Parkin&Zones: At the end of each block with- in in the business district, and specifically upon all streets where angle parking is required and at such other places on any street as the City Manager may deers necessary or as may be ordered by the Board of Commissioners, zones shall be set aside and designated where parking of vehicles shall be prohibited, and it shall be the duty of the City Manager to cause signs to be erected or the curbs to be marked, for such distance within each such district, designating and setting apart such no parking zones, as in his judgment is reason- able and proper for the safety of traffic and pedestrians using such streets, or for such distance asmay be hereafter specifically ordered by the Board of Commissioners, and when such signs are erected or painted, it shall be unlawful for any person to park any vehicle within any zone so designated and marked* Section 21. Parking Near Fire Hydrants:_ It shall be unlawful for the driver of any vehicle to park such vehicle within ten feet of any fire hydrant. Section 22. Signs and Obstructions in Streets or Parking It shall be unlawful for any person to place in any street any sign relating to the parking of vehicles or purporting to limit, prohibit or direct the parking of vehicles or vehicular traffic, except such signs as are placed in such streets by the officers of the City of Salina pursuant to this ordinance or other ordinances of said city or by or under the authority or direction of officers of the Bity of Salina or other police regulations, or signs placed in such street by,the State Highway Department, or other governmental authority, or to place in any part of any street, including the parkway in public sidewalk, any post, fence, wire or other obstruction of any kind, except such as may be specifically authorized or directed by the Board of Commissioners or by some duly authorized officer of the city, or othe# public authority, and no sign of any kind, and no such post, fence, wire or other obstruction of any kind except such as are hereby permitted shall be plaodd in any portion of any street including the parking and public sidewalks adjacent thereto. Section 23. Fire, Police and Ambulance Vehicles: Vehicles of the Police Department and Fire Department of the City of Salina, when responding to emergency callsp and ambulances when responding to emergency calls or when carrying passengers requiring emergency treatment shall have the right of way over all other vehicles in all streets, provided that such vehicles when traveling in response to such emergency call shall sound a siren to indicate the nattLre of any such vehicle, and provided further that the driver of any such vehicle shall use due care in operating such vehicle, and it shall be the duty of the driver of every other vehicle on any street* when the siren of any such emergency vehicle is sounded, to pull his vehicle as far to the right hand edge of such street as ips possible and bring such vehicle to a stop until such emergency vehicle has passed. No driver of any vehicle equipped with a siren as provided for herein shall sound such siren except at such times as are provided for herein, Section 24. Use of Sirens: It shall be unlawful for the owner or driver of any vehicle to equip or permit any such vehicle, except police, fire department or ambulance vehicles, to be equipped with a siren or with any horn producing a sound resembling that of a siren, such as is used by police, fire department and ambulance vehicles, or to use upon or in connection with any such vehicle any such siren or other horn which prodikaes a sound similar to that produced by any such siren. Section 28. Motor Drivers: It shall be unlawful for any person to drive or operate any motor vehicle on any street unless such person be duly licensed as required by the laws of the State of Kansas, or by the state of his residence* relating to the licensing of the drivers of motor vehicles and unless such persons shall have in their possession the license and/or badge required by the laws of the State of Kansas or such other state evidencing the right of such driver to operate the particular kind of vehicle which he may be then operating. Section 26. Age of Motor Drivers: It shall be unlawful for any person under the age of 13 years to drive or operate on any street in the City of Salina, any motor vehicle at any time or in any event and it shall be unlawful for any person to cause or permit any person under the age of 13 years to drive or operate or to be in possession of any motor vehicle on any street in any event; pro- vided that no person under the age of 16 years of age shall drive or operate or be permitted by any other person to drive or operate any motor vehicle on any street, unless such person under the age of sixteen years, and over the age of thirteen years, shall have been licensed as an operator by the State of Kansas, and shall have secured the written consent of parent or guardian of such person as required by law* Section 27. Drivers of Public or Common Carriers: It shall be unlawful for any person under the age of eighteen years to operate or drive, or for any person to cause, permit, or direct any person under the age of eighteen years to operate or drive on any street, a motor vehicle while in use as a public or common carrier of persons or property, and it shall be unlawful for any person under the age of 21 years to drive any motor vehicle while in use as a public passenger carrying vehicle. Section 28. Persons Prohibited from Driving: It shall be unlawful for any person who is an habitual drunkard or who is addicted to the use of narcotic drugs, or who h,s been adjudged insane, an idiot, imbecile, epileptic or feeble minded, and who has not at the time of the application been restored to competency by judicial decree or released from a hospital for insane or feeble minded by official certificate that such person is competent and capable,or for any person who is afflicted with or suffering from such physical or mental disability or disease as will serve to prevent such person from exercising reasonable and ordinary control over a motor vehicle while operating the same, to drive or operate any motor vehicle on any street, and it shall be unlawful for any person to cause, permit or direct any such person as above described to operate any motor vehicle on any street. Section 30. Taking or Moving Automobile: It shall be unlaw- ful for any person to enter or operate the motor vehicle of any other person, or to take or remove the automobile of any other person from any place where it has been left or kept b the owner or person in charge, without the consent of the owner or person in charge thereof, except by or under the direction of a police officer. Section 32. Motor Vehicle Lights: During the period between one half hour after sunset and one half hour before sunrise, every motor vehicle using any street in the City of Salina shall show two lamps on the front of such vehicle, (except motorcycles which shall show one lamp) emitting white light visible at a distance of 300 feet in the direction twward which such vehicle is proceeding and shall show at least one red light from the rear of such vehicle, and only from the rear, which shall be visible for at least 200 feet from the rear end of such vehicle. If any trailer.is attached to t1ae rear end of such vehicle, a red light as above described shall be attached to the rear end of any such trailer. Section 33. Bright Lights: No driver of any motor vehicle while operating on any street shall use -QnY headlightg unless the same are properly shaded or supplied with lenses of ground or frosted glass, or with dispersive lenses or glass or with a mechanical apparatus for turning down such illuminating lights, so that such lights will not blind or dazzle other users of the highway or make it unsafe for such Other users to ride, drive or walk thereon, and such lamps shall be adjusted by the proper direction of said lamps downward, and the adjustment of the bulb, so that the uppermost part of the light ray shall not rise above the level of the top of the front lamp, or glass opening, within a distance of 75 feet ahead of such vehicle. Section 34. Spot Lights: It shall be unlawful for the driver of any motor vehicle to direct the rays of a light known as a spot- light upon any street in the City of Salina, except vehicles operated by peace officers. Section 35. Horns or signals: Every motor vehicle used on any street in the City of Salina shall have a suitable horn or other adequate signal in good working order, capable of producing a sound of sufficient volume to give warning of the approach of such vehicle, to pedestrians and to the drivers of other vehicles, but the use of unnecessarily loud or raucous horns or other signals pro- ducing a sound of such volume or quality as to surprise or startle pedestrians or the drivers of other vehicles is hereby prohibited, Section 36, Brakes: vehicle operated on any street shall be equipped with good and sufficient brakes, which shall at all times be kept in good working order, and sufficient to enable the driver of such vehicle to properly control the same. Section 37. Riding on Runner Bo, etc: No person shall ride upon the running board or fenders of any vehicle or at any place in any vehicle other than in the space intended and provided for the carry&ng of passengers or property, except in case of emergency or when so directed by a police officer. Section 38. Arterial Highways: (a) The following named streets within the limits herein mentioned shall be and they are hereby designated as arterial highways, to -wit: Santa Fe Avenue from the south line of Qtis Street to the North line of claf lin Avenuet Iron Avenue from the east line of College Avenue to the west line of Marymount Road; Ninth Street from the North line of Euclid Avenue to the south line of Cloud Street, except at its intersection with Iron Avenue, MW x Ash Street from the east line of Seventh Street to the west line of Phillips Street, except at its intersection with Ninth Street; College Avenue From the north line of Llm Street to the south line of University Places except at Iron Avenue, Section 39. Vehicles Stop: No vehicles shall enter or cross any arterial highway as defined in the preceding section of this ordinance,(except at intersections controlled by the traffic signal lights ) without first coming to a full and complete stop upon arriving at the street line of such arterial highway, and such vehicle shall not enter such highway until danger of colliding with any vehicles on such arterial highway has passed. Section 40. Additional Stops: No vehicle shall enter any of the following named streets, from the streets hereinafter designated, without first being brought to a full and complete stop at the street line of the street which is to be entered, and until danger of colliding with vehicles lawfully proceeding along such streets has passed, to -grit: Ash Street* from Columbia Avenue (south side only from Penn Avenue, and from Third Street# Section 41. Stop Signs: It shall be the duty of the City Manager and Street Superintendent to procure and place at all intersections of other streets with arterial highways as defined by ordinance, and at all other intersections where vehicles are required to stop, except at exits from alleys and private driveways into streets, appropriate signs bearing the word "STOP" visible to the drivers of vehicles approaching the intersections where such vehicles are required to stop. Section 42. Stop at Alleys and Driveways: No person shall drive or back any vehicle from any alley or private driveway into any street without first bringing such vehicle to a complete stop M l• before crossing the sidewalk line, if there is a sidewalk along such street, or before entering the travelled portion of the street if there be no sidewalk along such street, and after stopping the driver of such vehicle shall not enter the street until danger of colliding with traffic lawfully proceeding along such street has passed. Section 43. metering Alleys or Driveways: It shall be un- lawful for any person driving any vehicle to enter any alley or mato private driveway from any street, when crossing any sidewalk or the space in any such alley or private driveway used by pedestrians as a sidewalk or cross -walk agross such alley or driveway, at a rate of speed greater than ten miles per hour, Section 44. Slog Signs: Wherever at any intersection or other place on any street the volume or condition of the traffic is such, in the judgment of the City Manager and the Chief of Police, as to make the same necessary for the safety of traffic, or wherever on any street the Board of Commissioners may order the same, signs shall be placed in such streets bearing the word "SLOW". Whenever any such sign is placed in any street, the same shall be deemed to be a warning to all traffic approaching such sign that a dangerous or hazardous /condition exists, and it shall be the duty of the driver of any vehicle approaching such sign or entering any intersection where such sign is placed to slow down the speed of his vehicle to such speed as is reasonable under the circumstances in view of the condition of traffic at such place, and so as to have his vehicle under sufficient control to avoid any collision with any other vehicle, person or object, and he shall not increase the speed of his vehicle until the danger thereof has passed. Section 45, Two Hour Parking: No person shall park or leave or cause or permit to be parked or left, any vehicle for more than two hours at any one time, and in any one place, between the hours of 7 o'clock A. M, and 7 o'clock P. M. on any day of the week except Sunday on any of the following streets in the City of Salina between the limits hereinafter mentioned, to -wit: 5°. On Santa Fe Avenue from Ash to 375 feet south of Walnut s On Fifth Street from Ash Street to Walnut Street, On Seventh Street from Ash Street to Walnut Street, On Iron Avenue from Fourth Street to Eighth Street, On Walnut Street from Fifth Street to Seventh Street, On Ash Street Prom Fifth Street to Seventh Street, provid®d; that the parking limits herein provided for shall not apply where other limits within the zones hereby created are other- wise specifically provided for by ordinance. Section 46, Fifteen Minute Parking Zones: The City Manager shall and he is hereby authorized and directed to designate and haQe marked three zones on each side of each block on Santa Fe between Ash Street and Walnut Street, and two zones on the west side and one zone on the east side of Fifth Street between Iron Avenue and Ash Street, and two zones on each side of Fifth Street between Iron Avenue and Walnut Street wit# parking spaces in each of such zones for five cars, and one Zone in each block on each side of Iron Avenue between Fifth Street and Seventh Street, with parking spaces in each of such zones for three cars, and all of the south side of Iron Avenue between Seventh Street and the alley west of Seventh Street, and all of the west side of Seventh Street between Iron Avenue and the driveway south of the Post Office building, and after such zones are designated and marked it shall be unlawful for any person to park or leave or cause or permit to be parked or left in any one space in any such zone, any vehicle for more than fifteen minutes at one time, between the hours of 9 o►clock A. M. and 7 o'clock P. M.s Section 47, Thirty Minute Psarrkir °#ones TWO . . parking zones for five cars each, are hereby established on each side of Santa Fe Avenue in the City of Salina between Ash Street have and Elm Street. The City Manager shall dekignate and.1marked such zones, and after they are so marked, it shall be unlawful for any person to park or leave or cause or permit to be parked or left in any space in any such zone, any vehicle for more than thirty minutes at any one time between the hours of 7 o'clock A. M., and 7 ofelock P. M. Section 48. Marking of Vehicles: The Chief of Police shall cause all vehicles parked on that portion of the streets designated in Sections 45 to 47, inclusive, of this ordinance, to be marked in such manner as to distinguish such vehicles during the hours in which the parking requirements within such limits are effective, and any person who shall remove, erase, or destroy or cause to be re- moved, erased or destroyed any mark placed upon any such vehicle or upon the tires thereof by any police officer, otherwise than for the Purpose and in the course of complying with the provisions of this ordinance, shall be deemed guilty of a violation of this ordinance, Section 49. Taxicab and Bus Parking: It shall be unlawful for any person to use any part of any street for the parking of any taxicab or for a taxicab stand or station except as specifically prescribed or designated in the ordinances of the City of Salina relating to taxicabs, and it shall be unlawful for any person to use any portion of any street for the parking of any passenger carrying bus or stage or as a station or stand for any such bus or stage except as specifically prescribed or designated by an ordinance of the City of Salina relating thereto or as permitted In any franchise ordinance or agreement duly entered into between the Board of Commissioners of said city and owners or operators of any such bus or stage. Section 50, Truck Parking: It shall be unlawful for any person to park or leave any combination of vehicles commonly known as a truck and trailer or truck and semi -trailer on any portion of any street in the City of Salina where angle parking is required by ordinance at any time either for loading or unload- ing property or for any other purpose. It shall be unlawful for any person to park or leave any vehicle of any kind having a total length of more than 18 feet on any street in the City of Salina where 'angle.- parking of vehicles is required by ordinance, except temporarily for the purpose of loading or unloading merchandise and then only when the use of such vehicle for such purpose does not :interfere. with :the re$ul" traffic on such street. Any projection or extension from the rear of any vehicle whether a part of such vehicle Or of the contents thereof shall be ddemed Vo be included in the total length of such vehicle under the provisions of. .this ordinance and in the case of a horse drawn vehicle the distance from the horses heads to the rear end of the vehicle or any extension thereof shall be included in the length of such vehicle. All ve- hicles above referred to when parked or left in any street in the City of Salina (except as herein specifically permitted) shall be parked or left in some portion of the street where parking parallel with the curbing is required by ordinance and when so parked or left such vehicle shall have its right wheels next to and not more than from the one foot/curb line of such street. Section 51. Use of Alleys by Trucks: It shall be unlawful -on,account of the danger to other traffic and to property of other ........ ., pers6ns cawed,thereby and the hazard to other traffic when such vehicle are driven into -or fr alle s for an °� alleyso y person to drive or cause to b e driven into or to stand - M any; alley in the City of Salina., where the width of such alley is not mank--than .10 feet any xcombination of vehicles commonly known as _fii'�rsk and trailer or truck and semi -trailer. Section 52. Parking on Bridges: It shall be unlawful for persons to stop or park any vehicle on any bridge in the City of Salina except in case of emergency. Section 53. No Parking Zones at :Schools: There are hereby created "No Parking' zones 20 feet in length along the curb line immediately in front of and adjacent to the entrance or entrances of every school building in the City of Salina and on the north side of Mulberry Street adjacent to the Washington High School Building, and on the west side of Ninth Street adjacent to the grounds of the Bartlett School, and it shall be unlawful for any d person to park any vehicle in any such "No Parking" zone, Section 54, "No Parking" Signs: Each zone or place on any street in the City of ,Salina where parking is prohibited under the Provisions of this ordinance or any other ordinance of said city shall be plainly marked and designated by signs or by having marked on the curb the words "No Parking" and this ordinance s shall not be effective at any such zone or place unless the same is so marked, except in case of parking near a fire hydrant. Section 55, All Night Truck Parking: It shall be unlawful for any person to use any street in the City of Salina for what is commonly known as the ail -night parking of any truck or com- mercial -vehicle, or to park or permit any such truck or commercial vehicle to stand all night on any street; and no such truck or commercial vehicle.bhall be parked or kept all night in any drive- way or front yard of an private y P premises in the City of Salina, in any Residential District as defined by the Zoning Ordinance of said City or amendments thereto, between the street line and the building set back line as defined by such zoning ordinance. in a Section 56. Parking on Sidewalk or Drivewa s and tAlsY— ial�l•be unld'ful for any person to park any vehicle on any public :fide - walk or so that any part of such vehicle or the Contents thereof extends across such sidewalk, or to park any vehicle in or in front *XXX of any private driveway without the consent of the owner It shall be unlawful or person entitled to the use of such driveway acre to park: any vehicle in any alley, except for the purpose of loading or un- loading merchandise or other property from or onto premises adjacent to such ally, and then only for such time as is reasonably necessary to complete such loading or unloading. Section 57. Removal of Vehicles: Any vehicle parked on any street in violation of the provisions of this ordinance may be removed by or under the direction of any police officer to any proper parking space or to the police station, and the owner of such vehicle shall pay the reasonable cost of such removal in addition to any fine which may be assessed for any violation of this ordinance. Section 58. Penalty: Any person\1ho shall violate or shall cause Permit or direct the violation of `1i7 of the provisions of this ordinance or who shall fail, neglect or refuse to comply with or abide by any of the provisions directions or requirements contained in this ordinance shall be deemed guilty of misdemeanor �r and upon conviction shall be fined not less than 1 00 0 � r more than $100 for each defense or be punished by imprisonment for not more than 30 days, or may be punished by both such fine and imprisonment for each such offense; y $: , provided however, that an person who shall violate any of the provisions of Section 29 of this ordinance shall be punished by fine of not less than $100.00 nor more than $500.00 or by imprisonment for not less than 30 days and not more than six months for each offense, or by both such fine and imprisonment. Section 59. If any section, part or clause of this ordinance shall be held to be invalid for any reason, the same shall not affect any other section, part or clause hereof, it being the intention of the Board of Commissioners to adopt each section, Part or clause of this ordinance separately and independently of any other section, part or clause hereof. Section 60, Ordinances Repealed: That Ordinances numbered 19830 2053, 3037,30490 30710 31409 31730 3317, 33360 3356, 3640, 3667, 3822038829 39340 39841, 4051, 4056, 41080 41122 41590 42610 4280, 4305, and any other ordinances or parts of ordinances speci- fically in conflict with any of the provisions of this ordinance, insofar as they so conflict, be and they are hereby repealed.
