AN ORDIT;AYCE amending Section 16 -Section 19 and Section 22 of Ordinance
No. 2948 being an ordinance relating to taxicabs and regulating
the conveyance of passengers for hire in the City of Salina, and
providing for the 13censing of taxicabs and the drivers thereof,
and repealing said original section.
RE IT ORDAINED by the Board of. Commissioners of the City of Salina,
Kansas:
Section 1. That Section 16 of Ordinance No, 2948, being Section
14-616 Revised Ordinances 1925, be and the same is hereby amended. to
read as follows:
"Section 16. It shall be unlawful for any person to drive in
the Cit -Y of Salina any taxicab unless such taxicab shall have been
licensed as provided for in this ordinance or in other ordinances of
the City of Salina, and it shall be unlawful for any person to drive
any taxicab within the City of Salina until such person shall have
first secured from the city a taxicab driver's license. No taxicab
drivers' license shall be issued to any person under the age of 21
,years nor to any person unless such person is, in the judgment of the
Board of Commissioners of said city, a. person of good character and
otherwise fit and qualified to drive a taxicab. Every applicant for
a taxicab drivers' license shall. file with the City Clerk an applica-
tion therefor in whiting, signed by the applicant, stating his name,
age, present address and occupation, his residence and occi.ipation for
the preceding two years, his state chauffeur's license number, and such
other information as may bre reol?ired. The City Clerk shall refer such
application to the Chief of t'olice who s'n€_1l make such investigation
as he deems necessary concerning the character of sacli applicant and
his fitness to drive a taxicab in the City of Salina, and shall endorse
on such application his recorimendation that the license ap7)li.ed for be
either granted or rejected and shall return to the some to the City
Clerk, vrho ,,,hall present the same to the Board. of Commissioners at
their next regular meeting, and said Board shall then, or after such
further investigation as the board deems necessary, approve or reject
such application. If approved by the Board of Corm-�issi oners, the City
Clerk shall be authorized to issue to the applicant a license to drive
a taxicab in the City of Salina until the 31st day of December next
following the date of the issuance of such license, unless s -oner
suspended or revoked, as provided for in this or in other ordinances
of said city. For each taxicab drivers' license, the applicant shall
pad to the City Clerk, at the tir^e the application is filed, a license
fee of $1.00 which shall be refunded to the applicant if his application
is rejected. In addition to the ma.nrer and causes hereinafter in this
ordinance, or in order ordinances of said city provided for, any to„icab
drivers license or any taxicab license may at any time be revoked or

suspended by the Board of Commissioners of said city if the Board
of Commissioners in their judgment, after a complaint has been made

f.nd a hearing has been granted to any such licensee, shall find
that such licensees by reason of his character, habits, ab-lity
to drive, offenses against the traffic ordinance or other ordinances
of said city, or violation of law, or the condition of his taxicab
is unfit or unqualified to drive and/or operate a taxicab, or that
the cnnti hued operation of any such taxicab or the continued driving
of any taxicab by any such licensed taxicab :'.river, will be detrimental
to the best interests and safety of the City of Salina and the Tjublic,
and such revocation or suspension shall be for such period of time
and iu)on such conditions as the Board of Commissioners may prescribe."
Section 2. That section 19 of Ordinance No. 2948, being Section
14-619 Revised Ordinances 1925 shall be and the same is hereby amended
to read as follows:
"Wection 19. Yp person shall drive, use or permit to be used in

the City of Salina, any taxicab which is in an unclean or unsanitary
condition, and no person_ while intoxicated or under the influence of
intoxicating liquor, or whose person. or clothing are unclean, shall
drive any taxicab within the City of Salina;"
Section 3. That Section 22 of Ordinance No. 2948, being Section
14-622 Revised Ordinances 1925 shall_ be and the same is hereby amended
to read as follows:
"Section 22. Any person who shall violate or who shall cause,
permit: or direct the violation of any of the foregoing provisions
of this ordinance (being Sections 1 to 21 inclusive, of Ordinance
No. 2948, as amended) or who shall fail refuse or neglect to comply
with any of such provisions of this ordinance, shall be deemed �7,iilty
of a misdemeanor and upon conviction thereof shall be punished by a
fine of not less than �25.00 nor more than $100.00 for each offense,
or by imprisonment for not more than 30 days, or by both such fine
and imprisonment, and each day during which any such violation,
failure or refusal shall continue, shall constitute a separate and
distinct offense; provided that if any violation of any provisions
of this ordinance shall also constitute a violation of any other
ordinance, noth_i_n.!g in this or:]inarce contained shall be deemed to
prevent the prosecution of any person under the provisions of any
other ordinance; and provided further, that the conviction of any
licensed taxicab driver of being intoxicated or driving a tax --cab
while into-.,- 1cated by any court, shall automatica11,7 cancel and
revoke his taxicab driverts license and shall automatically cancel

and revoke any taxicab license for any taxicab then o.,med and/or
operated by any such person, and any such license shall be suspended
pending an appeal from any such conviction."
Section 4. That original Sections 16, 19 and 22 of Ordinance No.

2948, being Sections 14-1616, 14619 and 14-622 Revised Ordinances of
1925 be and the same are hereby repealed..
Section 5. This ordin-nce shill talce effect and be in force from
and after its publication once in the official city paper.
