AN ORDIYANCE relating to and apportioning and levying special assess-
ments on certain lots and pieces of ground in the City of Salina
to pay the cost of re -paving Ninth Street from the south line of
Ash Street to the south line of North Street (west of Ninth Street)
In the City of Salina, Kansas, and assessing against certain rail-
road companies the cost of constructing railroad crossings across
said street, and relating to and providing for the collection and
payment of such assessments. j
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for the purpose of paying for that part of the

cost of repaving Ninth Street from the south line of Ash Street to
the south line of North Street (west of Ninth Street) in the City
of Salina, Kansas.. which is chargeable to private property and which
cost according to the final estimate of cost as submitted bTT the City
Engineer and approved by the Board of Commissioners exclusive of the
I
cost of railroad crossings, the amount chargeable to the Waterworks
Department, and to the city at large, and the Public Works Adminis-
tration grant allotment, is hereby determined to be the sum of
$'7716.82, there are hereby levied and assessed on the property liable
i
therefor, being all the lots and pieces of ground lying on either side
of said street above mentioned to the middle of the block, for the
distance improved as aforesaid according to the appraised value of such
lots and pieces of ground without regard to the buildings or improve-
ments thereon, special assessments covering the cost of such work and
improvements, said special assessments being based on the special
i
valuation and appraisement of said lots and pieces of ground hereto-
fore made by three disinterested appraisers appointed by the Board
i
of Commissioners of the City of Salina, Kansas, which said appraise-
ment is hereby referred to and made a part of this ordinance, and
lots and pieces of ground for the purpose aforesaid are hereby found
and determined to be as follows:

Section 2. That for the purpose of paying that part of
the cost
of constructing railroad crossings across Ninth Street within
the
limits above described., after crediting against the total cost
of
such crossings the grant allotment of 30% received or to be received
from the Federal Emergency Administration of Piibllc Works which
cost
exclusive of said Public Works Administrat-J"on grant allotment
has been
determl.ned and found to be the sutras hereinafter set forth in
accordance
with the final estimate of cost of the City Egineer, as approved
by
the Board of Commissioners., there are hereby levied and assessed
against the following named railroad companies the following
amounts.,
which amounts shall be a lien upon the property and franchises
of
such railroad companies and the same are hereby assessed and taxed
against the property of such companies in the same manner as other
taxes are levied against the property of such companies to -wit:

Section 3. Said amounts levied., apportioned and assessed aforesaid
shall be due and collectible in ten equal installments, the first
becoming due with the taxes levied for the year 1934 and one of
said installments falling due each and every year thereafter until
all are paid, and all to be collected with interest as in this
ordinance provided; PROVIDED HOWEVER, that the owner of any piece
of property liable for any such assessment or any railroad company
against which the cost of such railroad crossings or the cost of
any such improvements has been assessed, may redeem his or their
prorerty from such liability by paying into the City Treasury the
entire amount chargeable against the same, as in this ordinance
designated, at any time within thirty days after the publication
of this ordinance and before the issuance of the bonds of said
city in payment of the balance of the cost of said improvements,
and the property so paid on or any railroad company which has paid
the assessment levied by this ordinance, shall not thereafter be
liable for any further assessments for the cost of said improvements.
Section 4. There is hereby further levied and assessed against
each lot and piece of ground described in this ordinance, and upon each
railroad company assessed for the cost of such improvements, 3� per
cent interest per annum on all of said installments therein mentioned
and on all of such assessments, as specified in the preceding sec-
tion hereof, as by law provided, which said interest shall be collected
annually at the same time and in the same manner as said installments
are collected; and after the taking effect of this ordinance, it shall
be the duty of the City Clerk of said city annually, at the same time
other taxes are certified, and until all of said assessments so
apportioned and levied herein have been certified, to certify to the
County clerk of Saline County, Kansas, a full list of all property
liable to assessment and taxation for such work and improvement, and
of all such railroad company assessments, except such property on
which the special assessments aforesaid have been paid in full as
hereinbefore provided, and except such railroad company assessments
as shall have been paid in full, together with the respective amounts
due on each of such lots and pieces of ground, which amounts shall
include the annual installments of such special assessments together
with the interest for one ,year at the rate of 32- per cent per annum,
on all unpaid balances of such assessments at the beginning of each
such ,year as aforesaid, and such amounts so certified as herein pro -
tided shall be placed upon the tax roll by the County Clerk of Saline
County Kansas and collected as all other taxes are collected.

Section 2. That for the purpose of paying that part of the cost
of constructing railroad crossings across Ninth Street within the
lirl is above described, after crediting against the total cost of
such cDossings the grant allotment of 30% received or to be received
from the Federal Emergency Administration of Public Works, which cost
exclusive of said Public Works Administration grant allotment has been
determined and found to ba the sums hereinafter set forth in accordance
with the final estimate of cost of the City Engineer, as approved by
the Board of commissioners, there are hereby levied and assessed
against the following named railroad companies the following amounts,
which amounts shall be a lien upon the property and franchises of
such railroad companies and the same are hereby assessed and taxed
against the property of such companies in the same manner as other
taxes are levied against the property of such companies to -wit:

Chicago,Rock Island & Pacific Railway Co. 306.00
The Atchison,Topeka & Santa Fe Railway Co. 1587.37

Section 3. Said amounts levied, apportioned and assessed aforesaid
shall be due and collectible in ten equal installments, the first be-
coming due with the taxes levied for the year 1934 and one of said
installments falling due each and every year thereafter until all are
paid, and all to be collected with interest as in this ordinance pro-
vided; PROVIDED HOWEVER# that the owner of any piece of property liable
for any such assessment or any railroad company against which the cost
of such railroad crossings or the cost of any such improvements has been
a ssessed, may redeem his or their property from such liability by pay-
ing into the City Treasury the entire amount chargeable against the
same, as in this ordinance designated, at any time within thirty days
after the publication of this ordinance and before the issuance of the
bonds of said city in payment of the balance of the cost of said improve -
any railroad company which has paid
nents, and the property so paid on
the assessment levied by this ordinance, shall not thereafter be liable
for any further assessments for the cost of said improvements.
Section 4. there is hereby further levied and assessed against
each lot and piece of ground described in this ordinance,and.upon each
railroad company assessed for the cost of such improvements, 31 per cent
interest per annum on all of said installments therein mentioned and
on all of such assessments,as specified in the preceding section hereof,
as by law provided, which said interest shall be collected annually
at the same time and in the same manner as said installments are
collected; and after the taking effect of this ordinance it shall be
the duty of the City �'lerk of said city annually, at the same time
other taxes are certified, and until all of said assessments so
apportioned and levied herein have been certified, to certify to the
County Ulerk of Salz.ne County, Kansas, a full list of all property
liable to assessment and taxation for such viork and improvement, and
of all such railroad company assessments, except such property on which
the special assessments aforesaid have been paid in full as hereinbefore.
provided, and except such railroad company assessments as shall have
been paid in full, together with the respective amounts due on each
of such lots and pieces of ground, which amounts shall include the
annual installments of such special assessments together with the
interest for one year at the rate of 32 per cent per annum, on all
unpaid balances of such assessments at the beginning of each such
year as aforesaid, and such amounts so certified as herein provided
shall be placed upon the tax roll by the County Clerk of Saline County,
Kansas and collected as all other taxes are collected.
Section 5. This ordinance shall take effect and be in full force
from and after its publication once in the official city paper.
