All ORDIYATICE providing for and levying a license tax upon all persons,
copartnership or corporation engaging in the calling, trade or
occupation of operating or conducting auctions of merchandise; regula-
ting the conduct of such calling, trade or occupation and pro-
viding a penalty for the violation of this ordinance and re-
pealing certain ordinances or parts of ordinances of the City
of Salina.

any auction sale or gaging in the calling, trade or occupation
men-tioned in this ordin ce shall employ or permit any person to conduct
any such auction sale s an auctioneer unless such auctioneer shall

for by any then existi ordinance of the City of Salina, which shall
be in addition to any 1'cense tax provided for by this ordinance.
Section 5. It s 11 be unlawful for any auctioneer conducting
any such auction sale, o for any person, copartnership or corporation
engaging in a calling, t de or occupation of operating or conducting
any such auction sale or y agent, employee, represdntative member,
or officer thereof to caus , permit, direct or sanction any such
auctioneer to misrepresent he quality, make or value of any article
offered for sale at auction r to misrepresent or mis-state the price
at which such article was r larly priced prior to such auction sale.
Section 6. It shall unlawful for any person, copartnership,
or corporation engaging in co ducting; any such auction sale or for
any agent, employee, represen Live, member or officer thereof to
permit any boisterous or disor erly conduct on. any premises at which
any such auction sale is being aid..
Section 7. It shall be lawful for any person, copartnership,
or corporation conducting any s h auction sale or any agent, employee,
representative, member or office thereof or for any auctioneer con-
ducting such auction sale to refu e to sell to the highest bonda-fide
bidder any article offered for sa at any such auction sale on which
there has been at least two bona-f e bids by persons not interested
in such sale, or to bid up(;n or ca e to be bid in for or on behalf
of any such person, copartnership o corporation any article offered
for sale, or to engage in the practi e of what is commonly known as
"bye-bidding" at any such auction sa .
Section S. The license tax p vided for in Section 1 of th5_s
ordinance shall be:

Section 9. Any person, copartne hip or corporation or any
person as agent, representative, employ , member or officer of any
such person, copartnership or corporatio who shall violate or who
shall cause, direct permit or sanction t violation of any provisions
of this ordinance shall be deemed guilty a misdemeanor and for each
such offense shall be punished by a fine o not less than $25.00 or

more than $100.00, or by im sonment for not more than 30 days,

ORDINANCE N0, 4394.
AN ORDINANCE providing for and levying a license tax upon all
persons, copartnership or corporation engaging in the calling,
trade or occupation of operating or conducting auctions of
�.., merchandise; regulating the conduct of such calling, trade
'\ or occupation and providing a penalty for the violation of
this ordinance and repealing certain ordinances or parts of
ordinances of the City of Salina.
BE IT ORD AINED by the Board of Commissioners of
Kansas: the City of Salina,
Section 1. That no person, copartnership or corporation as
owner, agent or otherwise shall engage in the calling, trade or
occupation of operating or conducting an auction or any stock of
merchandise or any part thereof from any place of business of any
such person, firm or corporation or from any other place in the City
of Salina, nor shall any person, firm or corporation as owner, agent
or otherwise engaged in the calling, trade or occupation of selling
goods, wares and merchandise at auction within the City of Salina,
except in accordance with the regulations herein provided for and
unless and until any such person, copartnership or corporation shall
have first paid to the City of Salina a license tax for each day upon
which any such auction is to be operated or conducted or upon which
any such calling, tpade or occupation is to be engaged in and without
first securing a license to operate such auction or to engage in such
calling, trade or er Occupation as hereinafter provided for in this ordi-
nance, the amount of such license tax to be as in this ordinance herein-
after provided for.
Section 2. Before any such license shall be issued, the
person, copartnership or corporation applying for the same shall file
with the City Clerk a written application signed and sworn to b
person making the same for himself or as a member of such copartnership the
or as an officer of any such corporation in which applicationsuch
such
applicant shall state the place at which such auction is to be held or
such calling, trade or occupation is to be engaged in, the date that
such auction is to be commenced and the number of days for which a
license is desired, the kind and nature of merchandise that is to be
sold at such auction and the name of person or persons who will act as
auctioneer or auctioneers.
Section 3. When such application has been filed and the
license tax has been paid to the City Clerk as provided for in this
ordinance, the City Clerk shall issue to the applicant a license to
enga,e in such calling, trade or occupation for the time mentioned in
such application, and at the location mentioned therein.
Section 4. No person, copartnership or corporation conducting
any auction sale or engaging in the calling, trade or occupation men-
tioned in this ordinance shall employ or permit any person to conduct
any such auction sale as an auctioneer unless such auctioneer shall
first secure a license and pay the license tax therefor as provided for
by any then existing ordiancne of the City of Salina, which shall be
in addition to any license tax provided for by this ordinance.
Section 5. It shall be unlawful for any auctioneer conducting
any such auction sale, or for any person, copartnership or corporation
engaging in a calling, trade or occupation of operating or conducting
any such auction sale or any agent, employee, representative member,
or officer thereof to cause, permit, direct or sanction any such
auctioneer to misrepresent the quality, make or value of any article
offered for sale at auction or to misrepresent or mis-state the price
at which such article was regularly priced prior to such auction
sale.
Section 6. It shall be unlawful for any person, copartnership,
or corporation engaging in conducting any such auction sale or for
any agent, employee, representative, member or officer thereof to
permit any boisterous or disorderly conduct on any premises at which
any such auction sale is being held.
Section 7. It shall be unlawful for any person, copartnership, or
corporation conducting any such auction sale or any agent, employee,
representative, member or officer thereof or for any auctioneer con-
ducting such auction sale to refuse to sell to the highest bona-fide
bidder any article offered for sale at any such auction sale on
which there has been at least two bona-fide bids by persons not
interested in such sale, or to bid upon or cause to be bid in for
or on behalf of any such person, copartnership or corporation any
article offered for sale, or to engage in the practice of ghat is

Section 8. The license tax provided for in Section 1 of
this ordinance shall be:
$25.00 for each day or part thereof on which any such auction
sale is held or on which any merchandise shall be offered for sale
Section 9. _ Any person, copartnership or corporation or any
person as agent, representative, employee, member or officer of
any such person, copartnership or corporation, who shall violate
or who shall cause, direct, permit or sanction the violation of
any provisions of this ordinance shall be deemed guilty of a misde-
neanor and for each such offense shall be punished by a fine of not
less than $25.00 or more than $100.00, or by imprisonment for not
more than 30 days, or by both such fine and imprisonment, and each
day or part thereof upon which any violation of this ordinance shall
continue shall be deemed a separate offense.
Section 10. That Ordinance Number 3486 of the City of Salina
be and the same is hereby repealed.
Sec tion 11. This ordinance shall take effect and be in
force from and after its publication once in the official city paper.
