4347 Issue Relief Highway Bonds126 ORDINANCE NO. 4347 �uhlished it tom_ Sal3nA1 nal - _� i AN ORDINANCE providing for the issuance of "Relief Highway Bonds" of the City of Salina, Kansas, in the amount of $25,000.00 under the authority of Chapter 94 of the Laws of Kansas, Special Session, 1933, and providing for the sale of said bonds; the manner of which the proceeds thereof shall be used, and the method of retiring such I bonds. WHEREAS, pursuant to the provisions of Chapter 94 of the Laws of Kansas, Special Session, 1933, (House Bill No. 49) the Board of County Commissioners; of Saline County, Kansas, did at a regular session of said Board of Com- missioners, duly held on December 13, 1933, duly adopt a resolution as contemplated by Section 1 of said Act by which 35 per cent of the county and township road fund derived from special taxes on motor vehicles and on motor fuels as provided for in sub -section 2 of Section 1 of Chapter 241, Laws of Kansas 1933, and amendments thereto, has been set aside to be used for road and highway purposes in the construction, maintenance and operation of County roads and township roads and city streets, avenues or boulevards, by the county or city respectively, or to pay for bonds and interest thereon issued for such purpose, as provided for in said Act, and subject to all of the provisions of restriction thereof, true and correct copies of which resolution duly certified by the County Clerk of said county have been duly filed in the office of the City Clerk of the City of Salina, and of the State Treasurer of the State of Kansas, j and of the Auditor of the State of Kansas; and -WHEREAS, the county and township road fund of Saline County derived from the source provided for in said sub -section 2 of Section 1 of Chapter 241, Laws of Kansas, 1933, as amended, based on the present assessed valuation of said county, is $54,108.08 per year, and the 35 per cent of suc)a fund set aside to be used for road and highway purposes as contemplated by said Chapter 94 of the Laws of Kansas Special Session, 1933, (House Bill No. 49) by reason of the resolution aforesaid, will amount to $18,937.82 per ,year, based on the present assessed valuation of said county; and WHEREAS, the population of Saline County, Kansas as determined by the federal census of 190 was 29,337 and the population of the City of Salina, a city of the first class in Saline County, Kansas, as determined by said federal census of 1930 was 20,155 or 68.7 per cent of the total population of said county, by reason of which as provided for in Section 1 of said Chapter 94 Laws of Kansas, Sgecial Session 1933, (House Bill No. 49) 68.7 per cent of said sum of $18.0937.82 or a sum of w13,010.28 per year (based on the present assessed valuation of said county) will be apportioned to the City of Salina by the State Treasurer of the State of Kansas and distributed to the City of Salina or held by the State Treasurer to pay bonds and interest in the event bonds are issued by the City of Salina as contemplated by said Act; and t;Jfi'�.R'AS, the Board of Commissioners of the City of Salina, its governing body, have determined and do now determine that it will be for the best interest of said city and of those for whose benefit said Act was passed by the legislature of the State of Kansas, and who are on the relief rolls and who are able to and will work on the construction, maintenance and operation of streets and avenues in the City of Salina, that bonds in the total principal sum of 5p25,000.00 to bear interest at the rate of 4-1/4 per cent per annum, payable semi-annually, be issued in anticipation of the sums to be set aside and apportioned to the City of Salina as afore- said for such purposes, the amount of which bonds and all interest to accrue thereon will not exceed the total estimated amount to be set aside and apportioned to the City of Salina during a period of six years as pro- vided for in said Act; NOVi' UIERT 0RE BE IT ORDI',INED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That all of the foregoing preambles to this ordinance be adopted and considered to be a part of this ordinance. Section 2. That the City of Salina, Kansas shall issue its bonds in the amount of X259000.00 which shall be known as "Relief Highway Bonds" and which shall be dated January lst, 1934 and shall bear interest at the rate of 4-1/4 per cent per annum, payable semi-annually on the first days of July and January each ,year from date of issue to date of the respective maturities of said bonds, which interest shall be evidenced 127 by interest coupons annexed thereto as hereinafter provided, and said bonds shall be numbered from one to 25 inclusive, shall be in denominations of $1000.00 each, and shall mature as follows: No. 1 to 4 inclusive to mature January 13, 1935 No. 5 to 8 inclusive to mature January 19 1936 No. 9 to 12 inclusive to mature January 1, 1937 No. 13 to 16 inclusive to mature January 1, 1938 No. 17 to 20 inclusive to mature January 1, 1939 No. 21 to 25 inclusive to mature January 1, 1940 Section 3. Said bonds shall be issued under the provisions and authority of Chapter 94 Laws of Kansas, Special Session, 1933, (House Bill No. 49) for the purpose of creating a fund to be known as the "Relief Highway Fund" and said bonds shall be sold in the manner provided for by law and the proceeds of such bonds and any money received from the State Treasurer by reason of said Act of the legislature shall be placed and separately kept in a special fund in the City Treasury to be known as the "Relief Highway Fund" and the monies in such fund shall only be used by the City of Selina for the purposes mentioned and provided for in said Chapter 94 of the Laws of Kansas, Special Session, 1933, to -wit: For road and highway purposes in the construction, maintenance and operation of streets and avenues in the City of Salina, Kansas; Provided that preference shall and must be given for labor in such construction, maintenance and operation to persons on the relief roll of the county who are physically able to and will work in such construction, maintenance and operation. Section 4. Said bonds shall be a general obligation of the City of Selina payable out of that portion of the revenue derived from the levy of special taxes by the State of Kansas on motor vehicles and on motor fuels which is and shall be alloted and distributed to the City of Salina by virtue of the provisions of Chapter 94 of the Laws of Kansas, Special Session, 1933, and by virtue of the adoption by the Board of Commissioners of Saline County, Kansas, of the resolution above referred to; and if said apportionment to the City of Salina is lessened at any time by any change in the assessed valuation of Saline County while any such bonds or interest thereon are unpaid, a ta,­ will and shall be levied by the governing body of the City of Salina, Kansas, upon all of the property in said city to pay and deficiency which may be caused by the lessening of such apportionment. 128 i Section 5. Said bonds shall be sinned on behalf of the City of. - Salina by its Mayor and the City Clerk shall attest the same by his signature and shall affix the seal of the City thereto and the interest coupons annexed thereto shall be signed with the printed fac-simile signatures of the Mayor and City Clerk. When so executed said bonds shall be registered in the office of the City Clerk and the office of Auditor of S,- ate of the State of Kansas, and shall bear the certificates of the City Clerk and State Auditor evidencing such registration. Section 6. The interest coupons annexed to said bonds shall be in the form provided by law and said bonds shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF ZIALINE C 17:Y OF SALINA No. 0 1000.00 RELIEF HIGHWAY POND KNOW ALL MEN BY HESE PREVENTS; That the City of Salina, Saline County, State of Kansas, is indebted to and promises to pay the bearer the sum of One Thousand Dollars in lawful money of the United States of America, on the first day of January, 19 , with interest thereon at the rate of four and one-fourth per cent ner annum, payable semi-annually on the first days of January and July of each year, upon the presentation and delivery of the proper coupons hereto annexed, signed by the printed fac-simile signatures of the Mayor and Clerk of said City. Both principal and interest of this bond are payable at the office of the State Treasurer, in the City of Topeka, Kansas, and said city is hereby held and firmly bound and its Faith and credit and all of the resources of said city are hereby pledged for the prompt payment of this bond and interest at maturity. THIS BOND is one of a series of bonds numbered from One (1) to Twenty-five (25) inclusive, aggregating Twenty Five Thousand Dollars ($25,000.00) of like tenor and effect except as to maturity, issued by the City of Salina, Kansas, for the purpose of raising funds for road and highway purposes in the construction, maintenance, and operation of city streets, avenues or boulevards in the City of Salina, Kansas, as authorzed by Chapter 94 of the Laws of Kansas, Special Session, 1933, and is issued under the authority of and in conformity with said Act and in conformity with the provisions, restrictions and limitations of said Chapter 94 of the Laws of Kansas, Special Session, 1933, Chapter 10, Article 19 Revised Statutes of Kansas, 1923, and all acts amendatory, complementary, and supplemental thereto, and all other statutes of the State of Kansas applicable thereto. Said bonds are a general obligation of the City of Sal na, Kansas, payable out of that portion of the revenue derived from the levy of special taxes by the State of Kansas on motor vehicles and on motor fuels for road and highway purposes wlich is and shall be allocated and distributed to counties as provided by sub -section 2 of Section 1 of Chapter 241, Laws of Kansas, 1933, and amendments thereto, and by the provisions of said Chapter 94, Laws of Kansas, Special Session, 1933, (House Bill No. 49) and if the apportionment to the City of Salina, Kansas, by virtue thereof, shall at any time while any of said bonds are unpaid be lessened by a change in the assessed valua- tion of Saline County, Kansas, a tax will be levied by the City of Salina upon all of the property in said city for the purpose of paying said bonds and interest thereon. AN IT IS HEREBY CERTIFIED AND RECITED that all acts, condi- tions, and things required to be done precedent to and in the is:,uance of said bonds, have been properly done, happened and performed in regular and due form as required by law, and that the indebtedness created by this series of bonds is a constitutional, subsisting and legal obligation of said city and does not exceed any statutory or constitutional limitation.
