AT,' ORDIT'110E providing for the issuance of refunding bonds of the
City of Salina, Kansas, in the aggregate.amount of $64,000.00
for the purpose of refunding certain outstanding; bonds of such
city in a like amount.
HTEREAS, there are at this time outstanding bonded obligations of
the City of Salina, Kansas, as hereinafter more specifically des-
cribed which will mature on the dates hereinafter set forth during
the year 1934 and for the payment of which at maturity there are not
and will not be on the dates of maturity funds in the city treasury
sufficient to pay the bonds so maturing and it is hereby determined
by the Board of Commissioners of said city that it is necessary and
it is for the best interest of said city to refund said indebtedness
and to issue the refunding bonds of said city in the amount of said
outstanding bonds; and
WHEREAS, all acts, conditions and things required by the constitution
and laws of the State of Kansas, to exist, happen or be performed
precedent to the issuance of said refunding; bonds of the City of
Salina, Kansas, in the amount of. ;;64,000.00 for such purpose, and
in the issuance of the bonds hereby refunded, have happened and been

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Ghat for the purpose of refunding and retiring
the following described outstanding bonded obligations of the City
of Salina, Kansas, to -wit:
(a) Memorial Hall Bonds dated January lst, 1921,
in denominations of $1000 each, bearing in-
terest at the rate of 5-1/2% per annum,
numbered from 161 to 180 inclusive, due
January lst, 1934, authorized by ordinance
Pyo. 2386, aggregating - - - - - - - - - - - $ 20,000.00
(b) Refunding Bonds dated January 1, 19332
Bond No. 1 for 4.1,090,57, ( of which $p1000.00
is to be refunded by the refunding bonds
authorized by this ordinance) and bonds
numbered 2 to 6 inclusive, for $1000.00

ing interest at the rate of 4% per annum, numbered
from 5 to 6 inclusive, due June lst, 1934,
authorized by ordinance No. 4065, aggregating - 2,000.00
(h) Sewer Repair Bonds dated August lst, 1929, in
denominations of $1000.00 each, bearing interest
at the rate of 4-1/2% per annum, numbered from
10 to 11 inclusive, due August 1st, 7.934, author-
ized by ordinance No. 3736, aggregating - - - - - $ 21000.00
(i) Storm Sewer Bonds dated October lst, 1929, in
denominations of X1000.00 each, bearing interest
at the rate of 4-3/4o per annum, numbered from
30 to 36 inclusive, due October 1st, 1934,
authorized by ordinance No. 3796, aggregating -P 7,000.00
(j) Storm Sewer Bonds dated November lst, 1930, in
denominations of $1000.00 each, bearing interest
at the rate of 4-1/4'� per annum, numbered from
12 to 15 :inclusive, due November lst, 1934,

(k) Flood Control Bond dated December lst, 1930,
in denomination of $500.00 bearing interest
at the rate of 4-1/4% per annum, numbered 4
due December lst, 19343, authorized by ordinance

there are hereb'r authorized to be issued, and. the Mayor and City
Clerk are hereb-- directed to sign and execute the negotiable coupon
bonds of said city in the aggregate amount of $64,000.00, which
amount does not exceed the amount of the above described outstand-
ing bonds.
Section 2. Said Refunding Bonds shall be rated January 1st,
1934, shall bear interest at the rate of four and cne-fourth per
cent per annum, payable Jul7 1st, 1934, and semi-annually there-
after on the first days of January and July of each year until
the respective maturities of the bonds herein a,athcrized, for
which interest coupons shall be attached, authenticated by the,
lithographed or printed facsimile signatures of the Mayor and
City Clerk. Said bonds shall be signed by the Mayor, attested
by the City Clerk and have the seal of the City affixed thereto.
Said bonds shall be registered by the City Clerk of t',e City C41
Kansas, and by the Auditor of the State of Kansas.
Section 3. Said Refunding Bonds and interest coupons there-
on shall be payable at the office of the State Treasurer in the
City of Topeka, Kansas. Said bonds shall be in the denominations
of X1000 each, except bonds numbered 64 and 65, which shall be for
x`:500.00 each, and shall become due and payable as follows:

KNOW ALL MEN B`:- THESE PRESENTS: That the City of Salina
Saline County, State of Kansas, is indebted to and promises to
pay the bearer the sum of
Dollars in lawful money of the United States of America., on the
_first day of January 19 , with interest thereon at the rate

and Clerk of said City. Both prinicipal and interest of this bond
are payable at the office of the State Treasurer, in the City of

by pledged for the prompt payment of this bond and interest at
maturity.
THIS BOND is one of a series of bonds numbered from One (1)
to Sixty-five (65) inclusive, aggregating Sixty Four Thousand
Dollars ($642000.00) of like tenor and effect except as to
maturity and amount, issued by the City of Salina, Kansas, for
the purpose of refunding certain outstanding bonded indebtedness
heretofore legally crea ted by said city, and is issued under
authority of and in conformity with the provisions, restrictions
and limitations of Chapter 10, Article 1, Revised Statutes of
Kansas, 1923, and all acts amendatory, complementary, and supple-
mental thereto, and such bonds and the Interest thereon are to be
paid by the City of Salina, Kansas.
AIdD I`1 IS HERE -DY CERTIFIED ATID R -"CITED that all acts, condi-
tions, and things required to be done precedent to and in the issu-
ance of said bonds, have been properly done, happened and performed
in re�7,ular and due form as required by law, and that the indebted-
ness 1,1rhich is refunded by this series of bonds, is a constitutional,
subsisting and .legal obligation of said City and that neither the in-
debtedness which is refunded nor this series of bonds exceed any
statutory or constitutional limitati-on,
IN TESTIMONY WHEREOF, we, the undersigned officers of the City
of Salina, Kansas, being duly authorized to execute this obli7at.ion
on. its behalf, have hereunto set our official signatures and caused
the seal of said City to be hereunto offixed, and caused our official
signatures to be lithographed as printed on the coupons hereunto
attached, this first day of January, 1934.

Section 5, The City of Salina, Kansas, hereby assures and
promises the holders of any and all bonds and interest coup --ns
issued under the provisions of this ordi�ance that said city
will make prompt payment of the same when due, and it is hereby
made the duty of the proper city officials to make provisions for
such payment and to levy annually upon all of the taxable property
in said city, a tax sufficient to pay the interest and principal
of said bonds as they severally mature, and the fail faith, credit
and all of the resources of the City of Salina, Kansas, are hereby
irrevocably pledged to the prompt payment of said '_,onds and in-
terest coupons when due.
Section 6. When issued said bonds shall be offered for
sale and sold, in the manner provided by law, in s,jch amounts from
time to time as may be necessary to take up and retire the bonds
hereby refunded as such bonds respec'ively mature, and in time to
pay and retire such refunded bonds at their respective maturities.
Section 7. This ordinance shall be in force and take effect
from and after its publication once in the official city paper.
