AN ORDINANCE providing for the construction of a certain storm sewer
in the City of Salina to be designated as Storm Sewer 9A and pro-
viding for the manner in which such improvement is to be done and
the manner of payment of the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1, Storm Sewer 9A. That it is necessary and it is hereby
ordered that a Storm Sewer which is hereby designated as Storm Sewer
9A, together with all necessary inlets, connections, and other
appurtenances be constructed in the City of Salina, Kansas along the
following course to -wit:
Beginning at an inlet to be constructed at the intersection of
College Street and Cedar Street thence north in College Street an
18" sewer 367 feet to a manhole to be constructed at Walnut Street
and College Street; also beginning at an inlet on University Place
thence west in University Place a 12" sewer 85 feet to a manhole
to be constructed at College Street and University Place, thence
south in College Street an 18" sewer 395 feet to the above mentioned
manhole at Walnut Street and College Street. Also beginning at an
inlet on Walnut Street between College Street and the Missouri
Pacific Railroad Right-of-way thence east in Walnut Street a 12"
sewer 305 feet to an inlet to be constructed at College Street and
Walnut Street, thence east in Walnut Street a 24" sewer 340 feet to
a manhole to be constructed at Walnut Street and Phillips Street;
also beginning at an inlet to be constructed on Phillips Street
between Cedar Street and Walnut Street, thence north in Phillips
Street a 12" sewer 202 feet to the above mentioned manhole at Walnut
Street and Phillips Street, thence east in Walnut Street a 27" sew_,r
395 feet to a manhole to be constructed at Walnut Street and Baker
Street; also beginning at an inlet to be constructed on University
Place then east in University Place a 12" sew6r 150 feet to a manhole
to be constructed at University Place and Baker Street, thence south
in Baker Street a 12" sewer 400 feet to the above mentioned manhole
at Walnut Street and Baker Street, thence east in Walnut Street a
30" sewer 265 feet to a manhole to be constructed at Walnut Street
and Twelfth Street, thence east in Walnut Street a 30" sewer 215 feet
to a manhole to be constructed at Eleventh Street (N) and Walnut
Street, thence east to Walnut Street a 30" sewer 230 feet to a manhole
to be constructed at Eleventh Street (S) and Walnut Street, thence east
in Walnut Street a 33" sewer 322 feet to a manhole to be constructed
at Tenth Street and Walnut Street, thence east in Walnut Street a
33" sewer 280 feet to a manhole to be constructed to the west line
of Ninth Street, thence east in Walnut Street a 33" sewer 100 feet
to a manhole to be constructed to the east:line of Ninth Street,
thence east a 36" sewer 237 feet to a manhole to be constructed
at Eighth Street and Walnut Street, thence east in Walnut Street

a 36" sewer 253 feet to an existing manhole at the southwest corner
i
of the intersection of Seventh Street and Walnut Street located on
the existing 42" storm sewer in Seventh Street; also beginning at
i
an inlet to be constfucted on Tenth Street between Walnut Street
I
and Iron Avenue, thence south a 12" sewer 320' to an existing man-
hole at 'Tenth Street and Walnut Street on the existing 16" storm
sewer in the Walnut Street, together with the necessary inlets,
inlet connections, manholes, overflow connections and other accessories.
Section 2. That on or before October 9th, 1933, the City Engineer
shall prepare and file in the office of the City Clerk detailed plans
and specifications for the construction of the storm sewer provided
for in Section 1 of this ordinance with vitrified and concrete sewer
pipe or any combination of such type of sewer, or such other types
j of construction as said engineer may deem advisable, and on or before
the same date shall prepare and file in the office of the City Clerk
under oath, detailed estimates of the cost thereof. After such plans
and specifications and estimates of the cost shall have been filed

j as aforesaid, and after such plans and specifications have been
approved by the Board of Commissioners, the City Clerk shall advertise
by advertisements published in the official city paper for at least
three consecutive days for sealed proposals for the building and
construction of such storm sewer and that at the time and the place
mentioned in such notice the Board of Commissioners may contract
with the lowest and best responsible bidder therefor for the build -
Ing and construction of such storm sewer, but the right to reject
any and all bids shallbe and is hereby reserved. Any contract

awarded for such work shall provide for the furnishing by the con-
tractor of performance and maintenance bonds and for a statutory

bond in such amounts and with such conditions as may be required and
approved by the Board of Commissioners. All bonds so required shall
be filed by such contractor and approved by the Board of Commissioners
before any such work shall be commenced. The contractor shall be re-
quired to carry and pay for workmen's compensation insurance covering
the labor on such work.

Section 3. Thirty per cent of the cost of the construction of

such storm sewer or so much thereof as can be secured for such purpose
shall be paid for from money to be secured from the Federal Emergency
Administration of Public Works under the terms of the National Industrial
Recovery Act of the Congress of The United States approved June 16,
1933, and for the purpose of securing such money as a grant from such
Federal Emergency Administration the Mayor, City Clerk, City Engineer
and other proper officials of the City of Salina are hereby authorized
and directed to make and execute such applications, statements, and to
furnish such other information as may be required by the administrator
of the Federal Emergency Administration of Public Works in order to
comply with the provisions of said Act and the regulations thereunder.
The remainder of the cost of the construction of such sewer shall be
paid by the City of Salina as herein after provided.
Section 4. For the purpose of paying that part of the cost of
such improvements as is to be paid for by the City of Salina the Board
of Commissioners shall issue improvement bonds of the City of Salina,
Kansas in an amount not to exceed the total cost of such work and
improvements, to be payable in ten approximately equal annual instal-
ments and to bear interest not to exceed 5% per annum from the date
of such bonds and for the purpose of paying such bonds and interest as
they severally mature, the Board of Commissioners shall annually levy
a tax upon all real and personal property in the City of Salina in an
amount sufficient to pay the annual instalments of such principal and
interest, and that pending the issuance of such bonds temporary notes
shall be issued according to law to pay the cost of such work.
Section 5. This ordinance shall take effect and be in force`'rom
and after its publication in the offi&ial city paper.

to an existing manhole at Tenth Street and Walnut Street on the
existing 18" storm sewer in the Walnut Street, together with the
necessary inlets, inlet connections, manholes, overflow connections
and other accessories.
Section 2. That on or before October 9th 19339
the City Engineer shall prepare and file in the office of the
City Clerk detailed plans and specifications for the construction
of the storm sewer provided for in Section 1 of this ordinance
with vitrified and concrete sewer pipe or any combination of
such type of sewer, or such other types of construction as said
engineer may deem advisable, and on or before the same date
shall prepare and file in the office of the City Clerk under
oath, detailed estimatat of the cost thereof. After such plans
and specifications and estimates of the cost shall have been
filed as aforesaid, and after such plans and specifications have
been approved by the Board of Commissioners, the City Clerk shall
advertise by advettisements published in the official city paper
for at least three consecutive days for sealed proposals for the
building and construction of such storm sewer and that at the
time and the place mentioned in sue# notice the Board of Com-
missioners may contract with the lowest and best responsible
bidder therefor for the building and construction of such storm
sewer, but the right to reject anand all bids shall be and is
hereby reserve Any contract awarded for such work shall pro-
vide for the furnishing by the contractor of performance and
maintenance bonds and for a statutory bond in such amounts and
with such conditions as may be required and approved by the Board
Of Commissioners. Allbonds so required shall be filed by such
contractor and approved by the Board of Commissioners before any
such work shall be commenced. The contractor shall be required
to carry and pay for workmen's compensation insurance covering
the labor on such work.
Section 3. Thirty per cent of the cost of the construction
of such storm sewer or so much thereof as can be secured for such

the cost of such work,
Section 5. This ordinance shall take effect and be in
force from and after itspublication in the official city paper.
