4298 Issue Improvement BondsN ORDINANCE N0. 4298 (Published in the Salina Journal 1933) AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of $28,050.35, to pay the cost of improving certain streets in said city. WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the follow- ing street improvements in said city, to -wit: Repaving of Santa Fe Avenue from the north line of Elm Street to the south line of Walnut Street as provided for by Resolution No. 554 and by Ordinance No. 4835; Recurbing of Santa Fe Avenue from the north line of Ash Street to the south line of Walnut Street, as provided for by Resolution No. 555 and by Ordinance No, 4326; Recurbing of Santa Fe Avenue from the north line of Ash Street to the north line of Elm Street, as provided for by Resolution No. 557 and by Ordinance No. 4246; and WHEREAS, the total cost of said improvements has been ascertained, and the total portion thereof to be paid by a general tax to be levied upon all taxable property within said city for the improve- ment of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city and including one-third of the remaining cost of such repaving on Santa Fe Avenue between the north line of Elm Street and the south line of Walnut Street, (the repair and general improvement fund of said city being hereby found and determined to be insufficient to meet the cost and expense of such repaving) for which the city is liable and for which bonds will be issued as hereinafter pro- vided, has been ascertained and is hereby determined to be the sum of $15,597.00; and WHEREAS, the portion of said street improvements to be paid by special assessments levied upon the lots and pieces of ground liable for payment of said street improvements has been ascertained and is hereby found and determined to be the sum of $17,562.72, which said last amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable there- for, payable in ten equal installments according to law and as provided in the ordinance of the City of Salina relating thereto, duly passed and approved, of which amount the sum of $5,109.37 has been paid by the owners of property liable therefor leaving a balance for whicoL bonds will be issued in the sum of $12,453.35, and; WHEREAS, the total cost of said improvements for which bonds will be issued exclusive of the amount heretofore paid in cash by the proerty owners has been and is now hereby determined to be the sum of 128,050.35, NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Sectio, n 1. That for the purpose of providing funds to pay the cost of the improvements hereinbefore described, there shall be issued and there hereby are issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $28,050.35 which issue shall consist of ten bonds numbered from 1 to 29 inclusive, all dated September 1st, 1934, which shall be- come due serially in denominations as follows: R i No. 1 for $50.35 due September let, 1934 Nos. 2 and 3 for $1000 each, due September lots 1934 Nos. 4 and 5 for $1000 each, due September lot, 1935 Nos, 6, 7 and 8 for $1000 each, due September lot, 1936 Nos, 9, 10 and 11 for $1000 each, due September 1st, 1937 Nos, 120 13 and 14 for $1000 each, due September lot, 1938 Nos, 15, 16 and 17 for $1000 each, due September lots 1939 Nos, 18, 19 and 20 for $1000 each, due September let, 1940 Nos, 21, 22 and 23 for $1000 each, due September lot, 1941 Nos, 24, 25 and 26 for $1000 each, due September let, 1942 Nos, 279, 28 and 29 for $1000 each, due September lets 1943 All of said bonds shall bear interest at the rate of 4% per annums payable semi-annually on March let and September let in each year. Section 2. Said bonds shall be executed by the Mayor and shall be attested by the City Clerk, and the corporate seal of the City shall be affixed thereto. Said bonds shall have attached hereto interest coupons representing the interest thereon and said Interest coupons shall be in the form provided by law, and shall bear the fac-simile signatures of the Mayor and City Clerk of said city, and said bonds shall be registered in the offices of the City and State Auditor as required by law. Sectio Said bonds shall be in the form and shall contain recitals substantially as follows: Lll Noe INTERNAL IMPROVEMENT BOND KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be ind6lpted and for value received hereby promises to.pay to the bearer the sum of Dollars in lawful money of the United Sates of America, on the first day of September 19 , with interest thereon from the date hereof at the rate of lour per cent (4%) per annum, payable semi-annually on the first days of March and September in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, In the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity, This bond is one of a series of 29 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of $28,050.35 issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain storm sewers in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Section 12-608 Revised Statutes of Kansas 1923, and Sections 12-602 and 13-1012 Revised Statutes Supplement 19310 and all amendments thereof, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts condi- tions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation.
