AN ORDINANCE EXTENDING THE TERM OF FRANCHISE ORDINANCE NUMBER
03-10124 GRANTING TO SOUTHWESTERN BELL TELEPHONE COMPANY L.P., d/b/a
AT&T KANSAS, A FRANCHISE FOR THE RIGHT TO CONSTRUCT, OPERATE,
W MAINTAIN AND EXTEND A TELECOMMUNICATIONS SYSTEM IN THE CITY OF
SALINA, KANSAS.

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

Section 1. Findings. The Governing Body makes the following findings:
A. The City of Salina, Kansas (the "City") has granted Southwestern Bell Telephone L.P.
d/b/a AT&T Kansas ("AT&T") a franchise pursuant to Ordinance No. 03-10124, passed by the City
on January 27, 2003 and published on January 31, 2003, (the "Franchise Ordinance");
B. The Franchise Ordinance granted to AT&T by the City expires on December 31, 2006;
C. There is insufficient time for the parties to negotiate a new franchise to become effective
on the expiration date of the Franchise Ordinance; and
D. The parties desire that the Franchise Ordinance continue in force and effect until a new
franchise is negotiated, adopted, and in force.
Section 2. Extension of Franchise Ordinance. Pursuant to K.S.A. 12-2001, the Franchise
Ordinance is extended and shall remain in full force and effect until June 30, 2007, or until a new
franchise between the parties takes effect, whichever comes first. Any payments due under the new
franchise shall be effective as of the adoption of the new franchise.
Section 3. Effective Date. That this ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
