4702 Issue Refunding BondsORDINANCE N0. 4702 (Published in the Salina Journal ,9 ez_, b, 1936) AN ORDINANCE providing for the issuance of refunding bonds of the City of Salina, Kansas, in the aggregate amount of $700000.00 for the purpose.of refunding certain outstanding.bonds of such city in a like amount, to be designated as Series R-114. WHEREAS, there are at this time outstanding.bonded obligations of the City of Salina, Kansas, as hereinafter more specifically described which will mature on.the dates hereinafter set f_orth.during the year 1937 and for the payment of which at maturity there are not and will not be on the dates of maturity funds in the treasury of said city for the payment thereof, and it is hereby determined by the Board of Com- missioners of said city that it is necessary and for the best interest of said city to refund said indebtedness.and_of is-s-ue the refunding bonds of said city in the.amount of said outstanding bonds; and WHEREAS, all acts, conditions and things required by the constitution and laws of the State of Kansas, to exist, happen or be performed pre- cedent to the issuance of said refunding.bonds_of the City of Salina, Kansas,. in the amount of $700000.00, for such purpose, and in the issuance of the bonds hereby refunded, have happened and been per- formed in regular and due form, time and manner; NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of refui-ding and retiring the following described outstanding bonded obligations of the City of Salina, Kansas, to -wit: (a) Memorial Hall Bonds dated -January lst, 1921, in a denominations of $1000 each, bearing interest at the rate of 5-1/2% per annum, numbered from 221 to 240 inclusive, due January lst, 1937, authorized by ordinance No. 2386, aggregating - - - - - - - - - 20,000.00 (b) Refunding Bonds dated January 1st, 3.933, in de- nominations of $1000 each, bearing interest at the rate of 4% per annum,. numbered from 19 to 24 inclusive, due January lst, 19370 as authorized by ordinance No, 42202 aggregating - - - - - - - - - 6000.00 (c) Refunding Bonds dated January 1st, 1934, in de- nominations of $1000 each, bearing interest at the rate of 41% per annum, numbered from 13 to 18 inclusive, due January 1st, 1937, as authorized by ordinance No. 4332, aggregating - - - - - - - - - 6000.00 (d) Sewage Disposal Bonds dated January 10th, 19270 in denominations of $1000 each, bearing interest at the rate of 411% per annum, numbered from 64 to 70 inclusive, due January 14, 19370 authorized by ordinance No. 3224, aggregating - - - - - - - - - - 7000.00 (e) Storm Sewer Bonds dated March lst, 1932 numbered 43 to 52 inclusive in denominations of J1000 each, bearing interest at the rate of 441% per annum due March lst, 1937, as authorized by ordinance No. 4163, aggregating - - - - - - - - - - - - - - - - - 100000.00 (f) Refunding Bonds dated January lst, 1935 in de- nominations of $1000 each bearing interest at the rate of 3% per annum, numbered from 8 to 14 inclusive due July lat, 1937, Series R-109 as authorized by No. 4489, aggregating - - - - - - - - 7000.00 (g) Refunding Bonds dated January lat, 1936 in de- nominations of $1000 each, bearing interest at the rate of 24% per annum, numbered from 1 to 7 inclusive, due July 1st, 1937, Series R-111 as authorized by Ordinance No. 4590, aggrgAting - 7000.00 (h) Storm Sewer Bonds dated October lot, 1929, in de- nominations of $1000 each, bearing -interest at the rate of 4-3/4% per annum, numbered from 51 to 57 inclusive, due October lot, 19370 as authorized by Ordinance No. 3796, aggregating - - - - - - - $ 7000.00 there are hereby authorized to be issued, and the Mayor and City Clerk are hereby directed to sign and execute the negotiable coupon bonds of said city in the aggregate amount of $70,000,00, which amount does not exceed the amount of the above described outstand- ing bonds. Section 2. Said Refunding Bonds shall be designated as Series R-114 shall be dated January lot, 19370 shall bear interest at the rate of Two per cent per annum, payable July lot, 19370, and semi-annually thereafter on the first days of January and July of each year until the respective maturities of the bonds herein authorized, for which interest coupons shall be attached in the form provided by law, authenticated by the lithographed or printed facsimile signatures of the Mayor and City Clerk. Said bonds shall be signed by the Mayor, attested by the City Clerk and have the seal of the City affixed thereto. Said bonds shall be registered by the City Clerk of the City of Salina, Kansas, and by the Auditor of the State of Kansas, such registration to be evidenced by certi- ficates of the City Clerk and the State Auditor duly endorsed on said bonds• Section 3, Said Refunding Bonds and interest coupons there- on shall be payable at the office of the State Treasurer in the City of Topeka, Kansas. Said bonds shall be in the denominations of $1000 each, and shall become due and payable as follows: Nos. 1 to 7 inclusive, for $1000 each, due July 1, 1938 Nos. 8 to 14 inclusive, for $1000 each, due July 1, 1939 Nos. 15 to 21 inclusive, for $1000 each, due July 1, 1940 Nos. 22 to 28 inclusive, for $1000 each, due July 1, 1941 Nos. 29 to 35 inclusive, for $1000 each, due July 1, 1942 Nos. 36 to 42 inclusive, for $1000 each,, due July 1, 1943 Nos. 43 to 49 inclusive, for $1000 each, due July 12 1944 Nos. 50 to 56 inclusive, for $1000 each, due July 10 1945 Nos. 57 to 63 inclusive, for $1000 each, due July 10 1946 Nos. 64 to 70 inclusive, for $1000 each, due July i, 1947 Section 4• The form of said bonds shall be substantially as follows: rd 6 UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE REFUNDING BOND No. 735-Fles KNOW ALL MEN BY THESE PRESENTS: That the City of Salina ,Saline County, State of Kansas, is indebted to and promises to pay the bearer the sum of One Thousand Dollars in lawful money of the United States of America, on the first day of July 19 , with interest thereon at the rate of two per cent per annum, paya a semi-annually on the first days of January and July of each year, upon the presentation and delivery of the proper coupons hereto annexed signed by the Mayor and Clerk of said city. Both principal and interest of this bond are payable at the office of the State Treasurer, in the City of Topeka., Kansas, and said city is hereby held and firmly bound and its faith and credit and all of the resources of said City are hereby pledged for the.prompt payment of this bond and interest at maturity THIS BOND is one of a series of seventy bonds numbered from One (1) to Seventy (70) inclusive, aggregating Seventy Thousand Dollars ($70,000.00) of like tenor and effect except as to maturity, issued by the City of Salina, Kansas, for the purpose of refunding certain outstanding bonded indebtedness heretofore legally created by said city, and is issued under authority of and in conformity with the provisions, restrictions and limitations of Chapter 10, Article 1, Revised Statutes of Kansas, 1923, and all acts amendatory, complemen- tary, and supplemental thereto, and such bonds and the interest there- on are to be paid by the City of Salina, Kansasp AN IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions, and things.required to be done precedent to and in the issuance of said bonds, have been properly done, happened and performed in regular and due form as required by law, and that the indebtedness which is refunded by this series of bonds, is a constitutional, subsisting and legal obligation of said City and that neither the indebtedness which Is refunded nor this series of bonds exceed any statutory or consti- tutional limitation. The City of Salina, Kansas, hereby assures and promises the holders of any and all bonds and interest coupons issued under the provisions of this ordinance that said city will make prompt payment of the same when due, and it is hereby made the duty of the proper city officials to make provisions for such payment and to levy annually upon all of the taxable property in said city, a tax sufficient to pay the interest and principal of said bonds as they severally mature, and the full faith, credit and all of the resources of the City of Salina, Kansas, are hereby irrevocably pledged to the prompt payment of said bonds and in- terest coupons when due* Section 6.
