4686 Improvement Bonds C-113ORDINANCE N0.4686 (Published in the Salina Journal'36) AN ORDINANCE providing for and authorizing the issuance of Improve- ment Bonds of the City of Salina, Kansas, in the sum of $11,305.50, to pay the cost of acquiring by tondeimnation and appropriation certain lands for the purpose of opening, widen- ing and extending certain streets in the City of Salina.. Kansas, to be designated as Series C-113. WHEREAS, purusant to Resolution No. 665 and Resolution No. 669 heretofore duly passed and adopted by the Board of Commissioners of the City of Salina, Kansas, certain lands within the City of Salina have been appropriated and condemned for the purpose of opening, widening and extending certain streets within said city, such streets to be known as and used for U.S.Highway 81 by-pass and for a connecting link in U.S. Highway 40, and 1AMREAS, in the manner provided by law, comtzissinners have been duly appointed by the Judge of the District Court of Saline County, Kansas, for the purpose of appraising the value of the lands so appropriated and condemned of the City of Salina -for the purpose aforesaid and to assess damages for the taking and appropriation of said lands, and any other damages, if any, done to the owners of such lands by reason of such appropriation and to assess against the City of Salina the amount of the benefit to the public generally by reason thereof and to assess the remainder of the cost of such condemnation against the specific private property within the City of Salina, Kansas, lying within the benefit district fixed and determined by the Board of Commissioners of said city which may be especially benefited thereby, and WHEREAS, said commissioners so appointed having duly taken and subscribed their oath as provided by law and having duly notified the owners of the lands to be taken and condemned and all other persons interested, of the time and place, when and where said commissioners would meet for the purpose of viewing and appraising said lands and assess the damages and benefits on account of such condemnation and appropriation, did on the 16th day of October, 1936 file in the office of the City Clerk as provided by law the report of the damages and benefits so awarded and assessed by them as provided by law, and WHEREAS, by the report of said commissioners. so made and filed by them as aforesaid, it has been determined that the cost of acquiring said lands by condemnation and appropriation as afore- said is the sum of $11,305.50, and WHEREAS, the Board of Commissioners of the City of Salina, deem it necessary in order to pay for the lands so appropriated and con- demned for the opening, widening and extending of certain streets as aforesaid, that they issue and sell the negotiable bonds of the City of Salina, Kansas, to obtain the necessary funds therefor in a sum not to exceed the cost thereof to -wit, the sum of $11,305.50, all as authorized by Section 12-671 R.S. 19230 NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: SECTION 1. That for the purpose of providing funds to pay the cost of condemning and appropriating certain lands in the City of Salina for the purpose of opening, widening and extending eer- tain streets in said city as hereinbefore described, there shall be issued and there hereby are issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sun of $11,305.50, which issue shall consist of 12 bonds numbered from 1 to 12 inclusive, all dated October 20, 1936, which shall bear interest at two (2%) percent per annum from and after said date until the respective maturities of said bonds, payable semi- annually, to be evidenced by interest coupons as herein provided for, and said bonds shall become due serially in denominations as follows: • No. 1 for $305.50, due October 20, 1937 No. 2 for $1000 due October 20, 1937 No. 3 for $1000 due October 20, 1938 No. 4 for $1000 due October 20, 1939 No. 5 for $1000 due October 20, 1940 No. 6 for $1000 due October 20, 1941 No. 7 for,$1000 due October 200 1942 No. 8 for $1000 due October 200 1943 No. 9 for $1000 due October 20, 1944 No. 10 for $1000 due October 20, 1945 Nos. 11 & 12 for $1000 each due October 20, 1946 Section 2. Said bonds shall be signed by the Mayor and shall be i attested by the signature of the City Clerk, and the corporate seal of the City shall be affixed thereto. Said bonds shall have attached there- to interest coupons representing the interest thereon and said interest coupons shall be in the form provided by law, and shall bear the fac- simile signatures of the Mayor and City Clerk of said city,and said bonds i shall be registered in the office of the City Clerk and State Auditor as required by law. Section 3. Said bonds shall be designated as Series No. 0-113, and shall be in the form and shall contain recitals substantially as f ollows : UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE - CITY OF SALINA Series C-113 INTERNAL IMPROVEMENT BOND No. KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be in- debted and for value received hereby promises to pay to the bearer the sum of DOLLARS in lawful money of the United States of America, on the first day of 19 _, with interest thereon from the date hereof at the rate of percent per annum, payable semi-annually on the days of and in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity* This bond is one of a series of 12 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of $11,305.50 issued by the City of Salina, Kansas, for the purpose of paying the cost of appropriating and condemning certain lands in the City of Salina, Kansas, for the purpose of opening, widening and extending certain streets of said city as provided for and authorized by and in full compliance with the provis`.ons, restric- tions and limitations of the constitution and laws of the State of Kansas, including Sections 12-671 and 26-201 to 26-204 inclusive, Revised Statutes of Kansas 1923s and such Sections as amended, and all other provisions of the laws of said state applicable thereto and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all- acts, condi- tions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist.in due and regular form and manner as required by the Constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor -and its corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the fac-simile signatures of said officers, and this bond to be dated the day of 1936.
