4681 Issue Improvement Bonds P-112377 ORDINANCE N0. 4681 ( Published in the Salina Journaln_ AN ORDINANCE providing for and authorizing the issuance of Improve- ment Bonds of the City of Salina, Kansas, in the sum of $13,682.36, to pay the cost of improving certain streets in said city, to be designated as Series P-112• WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements to said city, to -wit: Repaving of Santa Fe Avenue from the north line of Elm Street to the north right-of-way line of the main line right-of-way of the Union Pacific Railroad Company, as provided for by Resolution No. 625 and'by Ordinance No. 4554; Recurbing and reguttering of Santa Fe Avenue from a point 130 feet south of the south line of Pine Street to the south line of Lincoln Avenue, provided for by Resolution No. 631, and by Ordinance No. 4557; Paving of Tenth Street from the south line of Elm Street to the north line of Park Street as provided for by Reso- lution No. 629 and by Ordinance No, 4555; WHEREAS, the total cost of said improvements (after deducting the total amount furnished or to be furnished and paid to the City of Salida, Kansas, by the Federal Emergency Administration of Public Works as a grant allotment in connection with the construction of such improvement and after deducting the amount charged to and paid by certain Railroads for the paving of the railroad crossings across said street and the amount chargeable to and paid by the Waterworks Department for repaving over the water mains constructed by it in Santa Fe Avenue at the time of each repaving) has been aseertainee and the total portion thereof to be paid by a general tax to be levied upon all taxable property within said city for the improve- ment of the squared and areas formed by the crossing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city and in- cluding one-third of the remaining cost of such repaving on Santa Fe Avenue from the north line of Elm Street to the north right-of- way line of the main line right-of-way of the Union Jeacifie Rail- road Company, to be paid by the City at large, as provided by law, (the repair and general improvement funds of said city being hereby found and determined to be insufficient to meet the cost and expense of such portion of repaving to be paid by the city at large), for which the city is liable and for which bonds will be issued as here- inafter provided for, has been ascertained and is hereby determined to be the sum of $9884.64; and WHEREAS, the portion of said street improvements to be paid by special assessments levied upon the lots and pieces of ground liable for pay- ment of said street improvements has been ascertained and is hereby found and determined to be the sum of $12,249.64 which said last amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor, payable in ten equal installments according to law and as provided in the ordinances of the City of Salina relating thereto, duly passed and approved, of which amount the sum of $8451.92 has been paid by the owners of property liable therefor, leaving a balance for which bonds will be issued in the sum of $3797.72 and; WHEREAS, the total cost of said improvements for which bonds will be issued exclusive of the amount heretofore paid in cash by the proerty owners has been and is now hereby determined to be the sum of 913,683.36, NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of providing funds to pay the cost of improvements hereinbefore described, there shall be issued and there hereby are issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $13,682.36 which issue shall consist of 14 bonds numbered from 1 to 14 inclusive, all dated July 1, 1936, which shall bear interest at the rate of two percent per annum from and after said date until the respective 378 maturities of said bonds, payable semi-annually, to be evidenced by interest coup.ms as herein provided for, and said bonds shall become due serially in denominations as follows: No. 1 for $682.36, due July 1, 1937 No. 2 for $1000 due July 1, 1937 No. 3 for $1000 due July 1, 1938 i No.4 for $1000 due July 1, 1939 No. 5 for $1000 due July 1, 1940 i No. 6 for $1000 due July 1, 1941 s No. 7 for $1000 due July 1, 1942 No. 8 for $1000 due July 1, 1943 Nos. 9 & 10 for $1000 each due July 1, 1944 1 Nos. 11 & 12 for $1000 each due July 1, 1945 Nos. 13 & 14 for $1000 each due July 1, 1946 Section 2. Said bonds shall be signed by the Mayor and shall be i attested by the signature of the City Clerk, and the corporate seal of the City shall be affixed thereto. Said bonds shall have attached thereto interest coupons representing the interest thereon and said interest coupons shall be in the form provided by law, and shall bear the fac-simile signatures of the Mayor and City Clerk of said city, and said bonds shall be registered in the offices of the City Clerk and State Auditor as required by law, i Section 3. Said bonds shall be designated as Series No. P-112, and shall be in the form and shall contain recitals substantially as follows: UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA Series P-112 No. INTERNAL IMPROVEMENT BOND SNOW ALL MEN BY THESE PRESENTS, That the City of Salina in the County of Saline, State of Kansas, acknowledges itseltk to be indebted and for value received hereby promises to pay to the bearer the sum of Dollars in lawful money of the United States of America, on the first day of July, 19 , with interest thereon from the date hereof at the rate of percent per annum, payable semi-annually on the first days of July and January in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 14 bonds of like date and tenor, excepting denomination and maturity, aggregating the prin- cipal sum of $13,682.36 issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain paving, curbing and guttering improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and lags of the State of Kansas, including Sections 10-101 to 10-115, 12-601 to 12-608, and 13-1012, Revised Statutes of Kansas 1923 as amended, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, condi- tions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and laws of the state of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the said City of Salina..
