Section 1. shat for the purpose of paying for the cost of building
and constructing Lateral Sanitary Sewers in Lateral Sewer Districts
numbered 172 and 173, as authorized by tr_e provisions of Ordinance No.
4650, the cost of which has been duly ascertained as shown by tiro City
Engineers Final Estimate of Cost, rl.ich ,_ as been duly approved by the
Board of Comriissioners, tere are hereby levied and assessed on the
property liable therefor, being all of the lots and pieces of ground
lying in the sever districts mentioned above as created by Ordinance
leo. 4650, according to the appraised value of such lots and pieces of
ground without regard to the buildings or improvements thereon, special
assessrlents covering the cost of such improverents constructed in paid
sewer districts, said special assessraents being based on the special
valuation and appraisement made by three disinterested appraisers
appointed by the 'Eoard of Corriissioners of the City of Salina, nansas,
which said appraisement is hereby referred, to and rade a part of this
ordinance, and the several amounts levied and apportioned a.-,airst the
lots and pieces of ground in said sewer districts for the purpose of
paying the cost of the iirprovements constructed in such districts being
hereby found and. determined to be as set forth in the following sections
of this ordinance.

Section 4, Said amounts levied, ayportioned and assessed
as aforesaid shall be due and collectible in ten equal installments,
the first becoming due with the tares levied for the year 1937 and
one of said installments falling due each and every year thereafter
until all are paid, and all to be collected with interest as in this
ordinance provided; PROVIDED, However, that the owner of any piece
of property liable for any such assessment may redeem his property
from such liability by paying into the City Treasury the entire
amount chargeable against the same as in this ordinance designated,
at any time within thirty days after the publication of this ordinance,
and before the issuance of the bonds of said city in payment of the
cost of said improvements, and his property so paid on shall not

said improvements nor for any part of said bonds.
Section 5. `i -here is hereb,- further levied and assessed against
each lot and piece of ground described in this ordinance not to
exceed 5% interest per annum on all of said installments herein
mentioned from tl.e date of the :onds which may be, issued at the
end of thirty days as specified in the preceding sect -.on hereof
as by law provided to t _e time of collection of the last ins .all-
rnent as provided by law, " _ich said interest shall be collected
annually at the same time and in the same manner as said instsll-
inents are collected, and after the taking effect of t1 is ordinance
it shall be the duty of the City Clerk of said City to annually
at the same ti,_ne other tares are certified, and until all of said
assessments so apportioned and levied herein have been certified
to certify to the County Clerk of Saline County, Kansas a full
list of all property liable to assesornent and taxation for such
work and improvements, except such property on which the special
assessments aforesaid have been paid in full as hereinabove pro-
vided, together with the respective amounts due on each of such
lots and pieces of ground, w1lich amounts shall include: the annual
installments of such special assessments together with the interest
for one year at the rate of not to exceed five per cent (5J) per
annum, the rate borne by the bonds to be issued on all vsapaid
balances of such assessments at tine beginning of each such year
as aforesaid, and such ariounts so certified as herein provided
shall be placed upon the tax roll by tl-.e County Clerk of Saline
County, Kansas and collected as all other taxes are collected.
Section 6. This ordinance shall take effect and be in force
from and after its publication in the official city paper,

AN ORDINANCE relating to and apportioning and levying special

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for the purpose of paying for the cost

of Ordinance No. 4650, the cost of which has been duly ascertained
as shown by the City Engineers Final Estimate of Cost, which has been
duly approved by the Board of Commissioners, there are hereby levied
and assessed on the property liable therefor, being all of the lots
and pieces of ground lying in the sewer districts mentioned above as
created by Ordinance No. 4650, according to the appraised value of
such lots and pieces of ground without regard to the buildings or im
provements thereon, special assessments covering the cost of such
improvements constructed in said sewer districts, said special
assessments being based on the special valuation and appraisement made
by three disinterested appraisers appointed by the Board of Commission-
ers of the City of Salina, Kansas, which said appraisement is hereby

Section 4.
Said amounts levied,
apportioned and assessed
as aforesaid shall be due and collectible
in ten equal installments,
the first becoming due with the taxes levied for the year 1937 and one
of said installments falling due each and every year thereafter
until all are paid, and all to be collected with interest as in this
ordinance provided; PROVIDED, However, that the owner of any piece
of property liable for any such assessment may redeem his property
from such liability by paying into the City Treasury the entire amount
chargeable against the same as in this ordinance designated, at any
time within thirty days after the publication of this ordinance, and
before the issuance of the bonds of said City in payment of the cost
of said improvements, and his property so t)aid on shall not thereafter
be liable for any further assessments for the cost of said improvements
nor for any part of said bonds.
Section 5. There is hereby further levied and assessed
against each lot and piece of ground described in this ordinance not
to exceed 5% interest per annum on all of said installments herein
mentioned from the date of the bonds which may be issued at the end of
thirty days as specified in the preceding section hereof as by law
provided to the time of collection of the last installment as provided
by law, which acid interest shall be collected annually at the same time
and in the same manner as said installments are collected, and after
the taking effect of this ordinance it shall be the duty of the
City Clerk of said City to annually at the same time other taxes
are certified, and until all of said assessments so apportioned
and levied herein have been certified to certify to the County
Clerk of Saline County, Kansas a full list of all property liable to
assessment and taxation for such work and improvements, except such
property on which the special assessments aforesaid have been paid in
full as hereinbefore provided, together with the respective amounts
due on each of such lots and pieces of ground, which amounts shall
include the annual installments of such special assessments together
with the interest for one year at the rate of not to exceed five
per cent (5%) per annum, the rate borne by the bonds to be issued
on all unpaid balances of such assessments at the beginning of each
such year as aforesaid, and such amounts socertified as herein pro-
vided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas and collected as all other taxes are collected.
Section 6. This ordinance shall take effect and be in force
from and after its publication in the official City paper.
