4670 Levy AssessmentsORDIivAiXE NO. 4670 (Publishet_ in the Salina _ Journal 0,�e-g;zzi 1 � i "I9.m-s ) AN ORDINANCE relating to certain sasements heretofore acquired by the City of Salina, Kansas, by condemnation for sanitary sewers and water mains* yEEREAS, pursuant to the provisions of Ordinance No, 3914 the City of Salina, Kansas, acquired by condemnation an easement over, along and in certain private property in the North one-half of the North one- half of the Southeast Quarter of the Southeast Quarter of Section 23, Township 14 South, Range 3.West of the Sixth P*M* in Saline County, Kansas, and located within the City of Salina, Kansas, for the purpose of constructing therein sanitary sewers and water mains, and WHEREAS. since the condemnation of said easement said land in which said easement lies has been platted by the owner or owners thereof as Blocks 1, 2 and 3 of Beverly Manor in such manner that said ease- ment so acquired lies in, through and under Lots 4 and 9 in Block 1, and Lots 4 and 9 in Block 2 of said Blocks 1, 2 and 3 of Beverly Manor and in such location that any residence buildings constructed on said lots will be located on the land through, in and under which said easement lies, and over the sanitary sewer which has heretofore been constructed by the City of Salina within the land so acquired, and nAHEREAb, the City of Salina does not need or contemplate the use of any of said land for any purpose other than for the purpose of keeping, operating and maintaining the sanitary surer which has been constructed thereon, NOW THEIREFORE BE IT ORDAITyED by the Board of Corunissioners of the City of Salina, Kansas: Section 1. That the City of Salina, Kansas hereby releases and abandons all of its rights in and to the easement so acquired by it as aforesaid under the provisions of said Ordinance No. 3914 in, through and under said Lots 4 and 9 in Block 1 and Lots 4 and 9 in Block 2 of Blocks 1, 2 and 3 in Beverly Manor, except the right to keep, operate and maintain the existing sanitary sewer which has been laid through and under said lots, which sewer lies at a depth of approximately 10 feet below the surface of said lots, the operation and maintenance of such sewer to be in such manner that the sane will not interfere wit# the construction and use of residence buildings over said existing sanitary sewer and in and over the land included within the easement above described, provided that the city shall and does hereby reserve the right to enter upon said premises for the purpose of making any necessary repairs to such sewer, such repairs to be made in such manner as not to interfere with or injure the foundation walls of any residence building constructed on said lots or any other portions of such structure except the basement floors thereof in the event that any repairs may become necessary thereunder and provided further and this ordinance is adopted on the condition that the owners of lots adjacent to lots above described shall have the right to connect to the sanitary sewer lying under said lots at points not more than 10 feet from the rear ends of such lots. 354 Section 2.
