4650 Utility Improvements Walnut Grove Addition301 ORD I ivANCE NO. 4650 AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of Salina designated as Lateral Sewer Districts No. 172 and 173, providing for the construction of lateral sanitary sewers in such districts and for the cost thereof and for the levying of special assessments against the property in such districts for the payment of such cost, and for the issuing of bonds therefor. j BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District No. 172. That there E be and there is hereby created a lateral sanitary sewer district in 1 the City of Salina which shall be designated as Lateral Sanitary Sewer District No. 172, and which shall include all of the follow - Ing described property in the Cit g of Salina, to -wit: Lots 1 to 9 inclusive in Block 1; Lots 1 to 9 inclusive in Block 2; Lots 1 to 10 inclusive in Block 3; { Lots 1 to 10 inclusive in Block 4; Lots 11 2 and 3 in Block 5; Lots 11 2 and 3 in Block 6; all in Walnut Grove Addition in Salina, Kansas, and the lot marked "Reserve" lying between Lot'9, Block 2 and Lot 10 Block 4 and the lot marked "Reserve" lying between Lot 10, Block 4 and Lot 1, Block 6 in Walnut Grove Addition. Section 2• That it is necessary and it is hereby ordered that a lateral sanitary sewer with all necessary connections, manholes, r flush tanks and other appurtenances be constructed and built in and to sere® said lateral sewer district No. 172 as created by i Section 1 of this ordinance, along the following course, to -wit: Beginning at an existing manhole located in the center of Railroad Street at a point 45 feet north of the north property line of Walnut Street, thence sout# 85 feet as an 8 inch sewer to a manhole to be constructed in Walnut Street, thence west in Walnut Street 108 feet as an 8 inch sewer to a manhole to be constructed in Walnut Street, thence south in Clark Street 955 feet as an 8 inch sewer to a flush tank to be constructed at a point 85 feet south of the south line of Spruce Street extended east from Clark Street* Section 3. Lateral Sanitary Sewer District No. 173: That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be designated as Lateral Sanitary Sewer District No. 173, and which shall include all of the following described property in the City of Salina, too -wit: Lots 1, 2, 5 and 7, east 83.8 ft. Lots 8 and 9. Lots 10, 11, 13, 15, 17, 19 and 21, Block 7, Ninth Street Plat. Lots 2 4, 6 8 10, 12 140 160 18, 20 and 22, Block , Ninth Atreet Plat. Lots 1, 2 and 3, east 21.8 ft. Lot 4, Lots 7, 9, 11 and 13, Block 5, Fairview Addition. West 41.8 ft. Lot 2, Lots 3, 4, 60 8, 10 and 12, Block 6, Fairview Addition. Lots 13, 15, 170 19, 21 and 23, Block 10, Bachtolds Plat; Lots 14, 169 18, 200 22 and 24 Block.9 Bachtolds Plat. 30? Lots 1, 30 51 7, 9, 11, 13, 15 17, 190 21 and 23, Block 13, Bachtolds Plat; Lots 20 40 60 8, 100 120 140 160 18, 20, 22 and 24 Block 14, Bachtolds Plat. Section 4• That it is necessary and it is hereby ordered that a lateral sanitary sewer with all necessary connections, manholes, flush tanks and other appurtenances be constructed and built in and to serve said lateral sewer district No. 173 as created by Section 3 of this ordinance, along the following described course, to -wit: Beginning at an existing manhole in Tenth Street 30 feet south of the north line of Frost Street, thence south 1894 feet in Tenth Street as an 8'ineh sewer to a point 40 feet north of the north property line of Republic Avenue. Section 5• That the City Engineer shall on or before J%me 100 1936, prepare and file in the office of the City Clerk plans and specifications for the construction of Lateral Sanitary Sewers pro- vided for in the piece ing sections of thin ordinance which shall be of proper character to serve the property lying within the dis- tricts within which such sewers are to be constructed and shall on or before the same date prepare and submit to the Board of Com- miss'_oners detailed estimates under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewers according to such plans and specifica- tions, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest and best responsible bidder therefor, provided, that such bid shall not exceed the estimated cost thereof and provided further that said Board shall reserve the right to reject any or all such proposals* Section 6. That for the cost of building and constructing such sewers special assessments shall be made for the full cost thereof, on all lots and pieces of land within the said Lateral Sanitary Sewer Districts, within which such sewer shall be built, according to the appraised value thereof, without regard to the improvements or build- ings thereon. Section 7• After the passage and publication of this ordinance the Board of Commissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and impartial appraise- ment of all lots or pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointment proceed to appraise all of the lots or pieces of land within such districts liable to assessment and taxation as afore- 303 said, without regard to the buildings or improvements thereon, and after making said appraisements shall return the same to the Board of Commissioners of said City and said Board shall designate a time for holding a special meeting of said Board for the purpose of hear- ing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 8. 'The special assessments herein provided for may be paid by the person liable therefor in ten approximately equal annual installments but the owner of any property liable to such assess- ment may within thirty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such improve- ments, and bonds ashereinafter provided for shall be issued for the amount of the assessments remaining unpaid at the end of thirty days from the time such assessment is fixed. S„ction 9. For the purpose of paying for the work and improve- ments in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue Improvement Bonds of the City of Salina in an amount not to exceed the cost of such improvements and to run for a period of ten years and be payable in ten approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements special assessments covering the cost of such improvements, and the apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and appprtionment ordinance shall contain the total amount of tax apportioned to such tract of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts of land, which 304 amounts shall include the annual installments and interest on all un- paid balances for one year at the rate of not to exceed five per cent (5%) per annum on such amounts so certified, which shall be collected as other taxes are collected. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewers according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest and best responsible bidder therefor, provided, that such bid shall not exceed the estimated cost thereof and provided furhter that said Board shall reserve the right to reject any or all such proposals.
