4642286 ORDINANCE N0. 4642 (Publ;,shed in the Salina Journal June 9,, 1936) AN ORDINANCE providing for and requiring the construction of certain concrete sidewalks in certain streets in City of Salina, Kansas. WHEREAS, petitions duly signed as required by law have been filed in the office of the City Clerk praying for the construction of certain sidewalks along certain streets and in front of and abutting upon certain property mentioned in the following ordinance, which petitions have been considered by the Board of Commissioners of the City of Salina and found to be sufficient and the sidewalks to be constructed as herein- after described are deemed to be necessary by the Board of Commissioners, and WHEREAS, certain existing sidewalks in the City of Salina as hereinafter described have been found and are hereby determined to be defective and it is deemed necessary by the Board of Commissioners of said city that new sidewalks.be constructed in place thereof; NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That concrete sidewalks of the width and thickness hereinafter prescribed shall be and the same are hereby ordered to be constructed and laid along certain parts of certain streets in the City of Salina, Kansas, as hereinafter defined, including sidewalk approaches at the intersections of streets and across unpaved streets andportions thereof, between the points hereinafter set forth and including side- walks across and between certain railroad tracks as hereinafter mentioned, said sidewalks, except at approaches at intersections and across unpaved streets, and except between railroad tracks as hereinafter mentioned, to be in front of and abutting upon the lots hereinafter mentioned to -grit: A concrete sidewalk 4 feet wide and 4 inches thick (except across existing driveways and across unpaved streets where the same shall be 6 inches thick) along the north side of Iron Avenue from the west line of Lot 6, Surveyors Plat Noe 8 to the west pavement line in Marymount Road and lying in front of and abutting upon the south side of Lots 1, 2, 32, 4, and 6 in Surveyors Plat Noe 8 (except the east 60 feet of the west 210 feet of said Lot 1 in Surveyors Plat Noe 8 where there is an existing concrete sidewalk) and in front of and abutting upon Lots 1 & 3 in Surveyors Plat No, 34, the inside line of said sidewalk to be two feet from the property line* A concrete sidewalk 6 feet wide and four inches thick (except across existing driveways and across unpaved streets a portion thereof were the same shall be 6 inches thick) along the east side of Santa Fe Avenue from the south curb line of Lincoln Avenue to the north curb line of Pine Street and lying in front of and abutting upon the west side of Lot 1, Lots 8 to 12 inclusive, Lot 14, the north 8 feet of Lot 15 and the north 5 feet of the south 7 feet of Lot 16 in Block 10 Calkins Addition, Lots 1,.30 5, 7, 9, 11 and 13, the north 10 feet and the south 6 feet of Lot 15, the north 8 feet and the south 3 feet and the north 9.5 feet of the south 22.5 feet of Lot 17 on Santa Fe Avenue in the original 28% town of Salina, except across railroad tracks and 20 inches each side thereof where plank sidewalks shall be constructed as hereinafter provided for, and including concrete sidewalks between the tracks of the Union Pacific Railroad Company in its right-of-way where the s same enters and goes through Block 10, Calkins Addition, and between the railroad tracks where the same go through the intersection of Santa Fe Avenue and North Street, and between the railroad tracks where the same go through Lots 3, 5 and on Santa Fe Avenue in the original town of Salina. A concrete sidewalk 8 feet in width and 6 inches in thick- ness along the east side of Santa Fe Avenue between the railroad tracks at the east side of the intersection of Pine Street and Santa Fe Avenue. A concrete sidewalk 15.5 feet in width and 4 inches thick (except at existing driveways where it shall be 6 inches thick) along the east side of Santa Fe Avenue in front of and abutting upon Lot 19 and the north 21.5 feet of Lot 21 on Santa Fe Avenue in the original town of Salina, and at the east side of intersection of Fine Street and Santa Fe Avenue (five feet in length) between the south railroad tracks in said intersection and the north line of said Lot 19 on Santa Fe Avenue. A concrete sidewalk 8 feet in width and 4 inches thick (except at existing driveways where the same shall be 6 inches thick) along the east side of Santa Fe Avenue in front of and abutting upon the south 8 feet Lot 21, the north 32 feet of Lot 23, north 17 feet of south 19 feet of Lot 25, the south 44 feet Lot 27, all of Lot 29, the north 9 feet and the south 32 feet of Lot 31, and all of Lot 33 on Santa Fe Aenue in original town of Salina and between the rail- road tracks where the same enter Lot 21 Santa Fe Avenue• A concrete sidewalk six feet in width and 4 inches thick (except at existing driveways where the same shall be six inches thick) along the west side of Santa Fe Avenue in front of and abutting upon the south 27 feet Lot 24, the north 11 feet (north of railroad tracks) of Lot 250 Lots 42, 43 and the south 9 feet of Lot 44 in Block 9, Calkins Addition, and between the tracks of the Union Pacific Railroad Company in its right-of-way where the same enters and goes through Block 9, Calkins Addition and between the railroad tracks at the west side of intersection of North Street and Santa Fe Avenue, and in front of and abutting upon Lots 2, 40 6, 8, 100 120 14, the south 20 feet of Lot 16, and Lot 18 on Santa Fe Avenue original town of Salina, except across railroad tracks 1 and 20 inches on each side thereof where planks sidewalks shall be constructed as hereinafter provided for• A concrete sidewalk 15.5 feet wide and 6 inches thick along the west side of Santa Fe Avenue in front of and abutting upon the south 23 feet of the north 30 feet of Lot 16, Santa Fe Avenue Original Town of Salina• A concrete sidewalk 15.5 feet wide and 6 inches thick along the west side of Santa Fe Avenue in front of and abutting upon Lot 20 and the north 23 feet of Lot 22 on Santa Fe Avenue original town of Salina and four feet lying between the south railroad track and the north line of said Lot 20 at the west side of the inte#section of Pine Street and Santa Fe Avenue, and 8 feet wide and 6 inches thick between the railroad tracks at the west side of the intersection of Pine Street and Santa Fe Avenue. A concrete sidewalk 8 feet wide and 4 inches thick (except at existing driveways where the same shall be 6 inches thick) along the west side of Santa Fe Avenue in front of and abutting upon the south 27 feet of Lot 22, all of Lot 24, the nortxll feet of Lot 26, south 26 feet of Lot 28, all of Lot 30, 32 and 34, the north 3 feet and the south 31 feet of Lot 36, north 5 feet and the south 28.5 feet of Lot 380 all of Lots 400 422 44 and 46 and the north 3 feet of Lot 48 on Santa Fe Avenue in original town of Salina, except across railroad tracks and 20 inches on each side thereof where plank sidewalk shall be constructed as herein provided for. Where any sidewalk herein provided for stops adjacent to any rail- road track a concrete header 14 inches deep shall be provided at such sidewalk end. 11hat plank railroad sidewalk crossings be constructed across all railroad tracks and for a distance of 20 inches on each side thereof, along the streets within the limits above mentioned, the same to be of a width equal to the sidewalks hereby ordered to be constructed adjacent thereto, and that all concrete sidewalks between any such tracks, and all plank sidewalk crossings across such tracks and 20 inches on each side thereof, as herein provided for, shall be paid for by the railroads owning and/or using such tracks• A concrete sidewalk 8 feet Side and four inches in thickness (except at existing driveways) along the north side of Ash Street in front of and abutting upon the south side of Lot 77 and 78 on Ash Street in original town of Salina. A concrete sidewalk 5 feet gide and 4 inches thick (except at existing drivewayv) along the west side of Eighth Street in front of and abutting upon the east side of the south 50 feet of Lot 78 on Ash Street in the original town of Salina• A concrete sidewalk 6 feet in width and 4 inches thick, along the south side of Ash Street in front of and abutting upon the north side of Lots 82 and 83 on Ash Street in original town of Salina. A concrete sidewalk 5 feet in width and 4 inches thick on the west side of Seventh Sfreet in front of and abutting upon the east side of Lots 68 and 70 on Seventh Street in Original town of Salina. j Section 2. That the sidewalks provided for in Section 1 of this ordinance shall be constructed and laid in accordance with the pro- visions of Ordinance No. 2407 and Ordinance No. 3509 and in accordance with the plans and specifications for concrete sidewalks filed in the office of the City Mgineer and in the office of the City Clerk pur- suant to the provisions of said Ordinance No. 3509, except as here- in otherwise specifically provided for, which plans and specifications have been and are now hereby approved, the same to be constructed at the grades to be furnished by the City Engineer• Section 3• That the owners of each of the lots and parcels of land described in the preceding section of this ordinance be and they are hereby ordered to construct in front of and abutting upon said lots or parcels of land, and along the street hereinabove mentioned, sidewalk as above provided for, and.if any one of them shall fail within 15 days from and after the publication of this ordinance to construct such sidewalk, the City Engineer shall pre- pare and file with the City Clerk detailed estimated under oath of the cost of constructing such sidewalks and the Board of. Commissioners of said city, shall proceed to construct or cause to be constructed such sidewalk as herein provided for and may let a contract therefor, at a cost not to exceed the estimate of the City Engineer, and shall assess the cost thereof against such lots and parcels of land upon which such sidewalks shall abutt, according to the front foot thereof, and such cost so assessed shall be duly certified by the City Clerk to the County Clerk of Saline County to be collected as other taxes and assessments are collected in one annual installment• Section 4• This ordinance shall take effect and be in force from and after its publication once in the official city paper. A concrete sidewalk 5 fe�::t wide and 4 inches thick (except at existing driveways) along the west side of Eighth Street in front of and abutting upon the east side of the south 50 feet of Lot 78 on Ash Street in the original town of Salina. A concrete sidewalk 6 feet in width and 4 inches thick, `•. along the south side of Ash Street in front of and abutting upon the north side of Lots 82 and 83 on Ash Street in original town of Salina. A concrete sidewalk 5 feet in width and 4 inches thick on the west side of Seventh Street in front of and abutting upon the east side of Lots 68 and 70 on Seventh Street in Original town of Salina. Section 2. That the sidewalks provided for in Section 1 of this ordinance shall be constructed and laid in accordance with the provisions of Ordinance No. 2407 and Ordinance No. 3509 and in accordance with the plans and specifications for concrete sidewalks filed in the office of the City h- gineer and in the office of the City Clerk pursuant to the provisions of said Ordinance No. 3509, except as herein otherwise specifically provided for, which plans and specifications have been and are now hereby approved, the same to be constructed at the grades to be furnished by the City Engineer.
