4610ORDINANCE N0, 4610 P,iblished in the Salina Journal January 23, _ 1936 AN ORDINANCE vacating a part of a certain alley in the City of Salina, � Kansas: BE IT ORDAIFED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the north 150 feet of the public alley, ten feet in width, which runs north and south from Iron Avenue to V!alnut Street, and which lies between, and parallel to, Seventh "treet and Eighth Street in the City of Salina, Kansgs, be and the same is here- by vacated as and for a public alley, and that that part of the alley so vacated as above described shall revert to and become a part of the lots lying on either side thereof and adjacent thereto, being Lots 110, 112 and 114 on Seventh Street, and Lots 109, 111 and 113 on Eigkith ;street, according to the recorded plat of the original town of Salina, in egi,.ial portions, as provided by law. Section 2. That the vacation of the portion of the alley as described and provided for in Sect= -on 1 of this ordinance shall take effect upon the condition that the owner of the following described real estate, to -wit: The north 10 feet of Lot 117 on Eighth Street to- gether with a part of said Lot 117 on Eighth Street described as follows: Commencing at a point on the east line of said Lot 117,, tan feet south of the northeast corner of said lot; thence west 20 feet on a line parallel with the north line of said lot; thence east and south on a curve having a 20 foot radius to a point on the east line of said Lot 20 feet south of pont of beginning; thence north 20 feet along the east line of said lot to point of beginning, shall convey to the City of S� Ana, KAnsas by good and sufficient deed, the property last hereinabove described for use as a p,,blic alley for tt:ia purpose of connecting the unvacated portion of the alley described in Section 1 hereof with Eighth Street, and for the purpose of providing an outlet from the unvacated portion of said alley. Section 3. This ordinance shall take effect from and after its publication in the official city paper, and after a certified copy thereof, with proof of publication, is recorded in the office of the Register of Deeds of Saline County, Kansas, and after the delivery and recording of the deed mentioned and provided for in Section 2 of this ordinance. That the North 150 feet of the public alley, ten feet in width, which runs north and south from Iron Avenue to Walnut Street, and which lies between, and parallel to, Seventh Street and Eighth Street in the City of Salina, Kansas, be and the same is hereby vacated as and for a public alley, and that that part of the alley so vacated as above described shall revert to and become a part of the lots lying on either side thereof and adjacent thereto, being Lots 110, 112 and 114 on Seventh Street, and Lots 109, 111 and 113 on Eighth Street, according to the recorded plat of the original town of Salina, in equal portions, as provided by law. SECTION 2.
