4605213 ORDINANCE NO. 4605 AN ORD IIdANCE prohibiting electrical interference with radio reception, and providing for punishment for the violation thereof. BE IT ORDAINED by the Board of Commissioners of the City of Sal -na', Kansas. Section 1. That it shall be unlawful -for any person, firm. copartnership, association, or corporation knowingly or wantonly to operate or cause to be operated, any wire or wires for carrying electric energy, or any machine, device, apparatus, or instrument of any kind whatsoever within the corporate limits of the City of Salina, Kansas, the operation of which shall cause reasonably preventable eledtrical interference with radio reception, within said municipal limits; Pro- vided, however, that x-ray pictures, examinations, or treatments may be made at any time if the machines or apparatus used therefor are properly equipped to avoid all unnecessary or reasonably preventable interference with radio reception and are not negligently operated. Section 2. The building inspector of the City of Salina or any police officer of said city or any person designated by the �,overn- ing body of such city for such purpose, shall have the right at any reasonable hour to enter any place of business or other premises in the Uity of Salina for the purpose of inspecting or locating or attempting to locate any wires, machine, device, apparatus or instru- ment of any kind whatsoever, which is or may be kept or operated on any such premises in violation of the provisions of this ordinance, and any person who shall prevent or attempt to prevent such building inspector or police officer or any person designated by the governing body of such city for such puvpose, from entering any premises in the City of Salina for such purpose shall be deemed guilty of a violation of this ordinance. Section 3. That this ordinance shall not be held or con- strued to embrace or cover the regulation of any transmitting, broadcasting or receiving instrument, apparatus, or device used or useful in interstate commerce or the operation of which in- strument, apparatus, or device is licensed or authorized by or under the provisions of any act of the congress of the United States. Section 4. That every person, copartnership, assocation, firm or corporation violating, or who shall cause, permit or direct the violation of any of the provisi )ns of this ordinance, or who shall permit to be kept or operated on any premises in said City, under the control of, or in the possession of, any such person, copartnership, association, firm or corporation any machine, device, apparatus or instrument, the operation of whicta is in violation 214 of any of the provisions of this ordinance shall, upon conviction, be punished by a fine of not more than Twenty -.five 0,21.00) dollars, Each day during; which such vicln.tion continues shall constitute a separate offense. BE IT ORDAINED by the Board of Commissioners of the Uity of Salina, Kansas: Section 10 That it shall be unlawful for any person, firm, copartnership, association, or corporation knowingly or wantonly to operate or cause to be operated, any wire or wires for carrying electric energy, or any machine, device, apparatus, or instrument of any kind whatsoever within the corporate limits of the City of Salina, Kansas, the operation of which shall cause reasonably preventable electrical interference with radio reception, within said municipal limits; Provided, however, that x-ray pictures, examinations, or treatments may be made at any time if the machines or apparatus used therefor are properly equipped to avoid all un- necessary or reasonably preventable interference with radio re- ception and are not negligently operated. Section 4. That every person, copartnership, association, firm or corporation violating, or who shall cause, permit or direct the violation of any of the provisions of this ordinance, or who shall permit to be kept or operated on any premises inlaid City, under the control of, or in the possession of, any such person, copartnership, association, firm or corporation any machine, device, apparatus or instrument, the operation of which is in violation of any of the provisions of this ordinance shall, upon conviction, be punished by a fine of not more than Twenty-five ($25.00) dollar4q, Each day during which such violation continues shall constitute a separate offense.
