AN ORDINANCE providing for the issuance of refunding bonds of the
1 City of Salina, Kansas, in the aggregate amount of $720000.00
for the purpose of refunding certain outstanding bonds of such
city in a like amount, to be designated as Series R-111.
WHEREAS, there are at this time outstanding bonded obligations of
the City of Salina, Kansas, as hereinafter more specifically des-
cribed which will mature on the dates hereinafter set forth during
the year 1936 and for the payment of which at maturity there are not
and will not be on the dates of maturity funds in the treasury of
said city T'or the payment thereof, and it is hereby determined by
the Board of Commissioners of said city that it is necessary and
for the best interest of said city to refund said indebtedness and
to issue the refunding bonds of said city in the amount of said
outstanding bonds; and
WFiFREAS, all acts, conditions and things required by the constitution
and laws of the State of Kansas, to exist, happen or be performed
precedent to the issuance of said refunding bonds of the City of
Salina, Kansas, in the amount of $721,000.00, for such purpose, and
In the issuance of the bonds hereby refunded., have happened and
been performed in regular and due form, time and manner; NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas;
Section 1. That for the purpose of refunding and retiring
the following described outstanding bonded obligations of the City
of Salina, Kansas, to -wit:
(a) Memorial Hall Bonds dated January 1st, 1921, in
denominations of 1000 each, bearing interest at
the rate of 5-1/2, per annum, numbered from 201
to 220 inclusive, due January lst, 1936, authorized
by ordinance No. 2386, aggregating - - - - - - - - 20,000.00
(b) Refunding Bonds dated January let, 1933, in de- i
nominations of $1000 each, bearing interest at
the rate of 4% per annum, numbered from 13 to 18
inclusive, due January let, 1936, as authorized

(c) Refunding Bonds dated January let, 1934, in de-
nominations of 11000 each, bearing interest at
the rate of 44% per annum, numbered from 7 to 12

(d) Sewage Disposal Bonds dated January 10th, 1927,
In denominations of $1000 each, bearing interest

(f) Refunding Bonds dated January 1st, 1935, in de-
nominations of $1000 each bearing interest at
the rate of 3% per annum, numbered from 1 to 7

(g) Sewer Repair Bonds dated August 1st, 1929, in
denominations of $1000 each, bearing interest
at the rate of 4 per annum, numbered from
14 to 15 inclusive, due August let, 1936, as
authorized by ordinance No. 3736, aggregating 2000.00

(h) Storm Sewer Bonds dated October Sat, 1929, in
denominations of $1000 each, bearing interest
at the rate of 4-3/4% per annum, numbered from
44-50 inclusive, due October lst, 19360 as
authorized by ordinance No. 3796, aggregating - 7000.00
(i) Funding Bonds dated June lst, 1933, in denomina-
tions of $1000 each, bearing interest at the rate
of 4 per annum, numbered from 8 to 14 inclusive
due October lst, 1936, as authorized by Ordinance
No. 4275, aggregating - - - - - - - - - - - - - - $ 7000.00
there are hereby authorized to be issued, and the Mayor and City Clerk
are hereby directed to sign and execute the negotiable coupon bonds of
said city in the aggregate amount of $72,000.00, which amount does not
exceed the amount of the above described outstanding bonds.
Section 2. Said Refunding Bonds shall be designated as Series
R-111, shall be dated January 1st, 1936, shall bear interest at the
rate of 2-1/4 per cent per annum, payable July 1st, 1936, and semi-
annually thereafter on the first days of Januaryand July of each year
until the respective maturities of the bonds herein authorized, for
which interest coupons shall be attached in the form provided by law,
authenticated by the lithographed or printed facsimile signatures of
the Mayor and City Clerk. Said bonds shall be signed by the Mayor,
attested by the City Clerk and have the seal of the City affixed there-
to. Said bonds shall be registered by the City Clerk of the City of
Salina, Kansas, and by the Auditor of the State of Kansas, such registra-
tion to be evidenced by certificates of the City Clerk and the State
Auditor duly endorsed on said bonds.
Section 3. Said Refunding Bonds and interest coupons thereon
shall be payable at the office of the State Treasurer in the City of
Topeka, Kansas. Said bonds shall be in the denominations of $1000 each,
and shall become due and payable as follows:
Nos* l to 7 inclusive, for $1000 each, due July 1, 1937
Nos. 8 to 14 inclusive, for $1000 each, due July 1, 1938
Nos. 15 to 21 inclusive, for $1000 each, due July 1, 1939
Nos. 22 to 28 inclusive, for $1000 each, due July 1, 1940
Nos. 29 to 35 inclusive, for $1000 each, due July 1, 1941
Nos. 36 to 42 inclusive, for $1000 each, due July 1, 1942
Nos. 43 to 49 inclusive, for $1000 each, due July 1, 1943
Nos. 50 to 56 inclusive, for $1000 each, due July 10 1944
Nos. 57 to 64 inclusive, for $1000 each, due July 1, 1945
Nos. 65 to 72 inclusive, for $1000 each, due July 1, 1946
Section 4. The form of said bonds shall be substantially as
follows:

KNOW ALL MEN BY THESE PRESENTS: That the City of Salina
Saline County, State of Kansas, is indebted to and promises to
ppy the bearer the sum of One Thousand Dollars in lawful money
of thA United States of America, on the first day of July 19
with interest thereon at the rate of two and one-fourth per cent
per annum, payable semi-annually on the first days of January
and July of each year, upon the presentation and delivery of the
proper coupons hereto annexed signed by the Mayor and Clerk of
said city. Both principal and interest of this bond are payable
at the office of the State Treasurer, in the City of Topeka,
Kansas, and said city is hereby held and firmly bound and its
faith and credit and all of the resources of said City are hereby
pledged for the prompt payment of this bond and interest at
maturity.
THIS BOND is one of a series of seventy-two bonds numbered
from One (1) to Sevent two (72) inclusive, aggregating Seventy-
two Thousand Dollars 072,000.00) of like tenor and effect except
as to maturity, issued by the City of Salina.. Kansas, for the
purpose of refunding certain outstanding bonded indebtedness here-
tofore legally created by said city, and is issued under authority
of and in conformity with the provisions restrictions and limita-
tions of Chapter 10, Article 1, Revised Statutes of Kansas, 1923,
and all acts amendatory, complementary, and supplemental thereto,
and such bonds and the interest thereon are to be paid by the City
of Salina, Kansas.
AND IT IS HEREBY CERTIFIED AND RECITED that all actsp condi-
tions, and things required to be done precedent to and in the issu-
ance of said bonds, have been properly done, happened and performed
in regular and due form as required by law, and that the indebtedness
which is refunded by this series of bonds, is a constitutional, sub-
sisting and legal obligation of said City and that neither the in-
debtedness which is refunded nor this series of bonds exceed any
statutory or constitutional limitation.
IN TESTIMONY WHEREOF, we, the undersigned officers of the City
of Salina, Kansas, being duly authorized to execute this obligation
on its behalf, have hereut:nto set our official signatures and caused
the seal of the said city to be hereunto affixed, and caused our
officialsignatures to be lithographed or printed on the coupons
hereunto attached, this first day of January, 1936.

Section 5, The City of Salina, Kansas, hereby assures and
promises the holders of any and all bonds and interest coupnns
issued ander the provisions of this ordinance that said city will
make prompt payment of the same when due, and it is hereby made
the duty of the proper city officials to make provision for such
payment and to levy annually upon all of the taxable property in
said city, a tax sufficient to pay the interest and principal of
said bonds as they severally mature, and the full faith, credit
and all of the resources of the City of Salina, Kansas, are hereby
irrevocably pledged to the prompt pay#ent of said bonds and in-
terest coupons when due.
Section 6, When issued said bonds shall be offered for
sale and sold, in the manner provided by law, in such amounts
from time to time as may be -necessary to take up and retire the
bonds hereby refunded as such bonds respectively mature, and in
time to pay and retire such refunded bonds at their respective
maturities.
Section 7. This ordinance shall -be in force and take
effect from and after its publication once in the official city
paper.
