AN ORDINANCE ratifying and confirming a contract for the building
and construction of reinforced concrete foundations for a
1,000,000 gallon elevated water storage tank as provided
and authorized by Ordinance No. 4538

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:

Section 1. That the acceptance by the City of Salina of
the proposal of T. R. Johnson and E. 0. Johnson, co-partners,
doing business as Johnson Bros, Construction Company of Salina,
Kansas, hereinafter referred to as the 'contractor" as submitted
to the Board of Commissioners October 28th, 1935, which is hereby
found and determined to be the lowest and best bid for the building
and construction of reinforced concrete foundations including
steel reinforcing, forming, and placing of anchor bolts (said
anchor bolts to be furnished by the tank contractor under the

provisions of Section 1 of saidproposal) complete, and all ex-
cavation and backfill including sheeting, shoring, flushing,
tamping and disposal of excess material, all as described in
Section 2 of said proposal, being the foundations to be used
in connection with the construction and erection of a 1,000,000
gallon elevated steel water storage tank as provided for and
authorized by Ordinance No. 4538 of the City of Salina, Kansas,
and the contract awarded by the Board of Commissioners of the
City of Salina to said contractor and signed on behalf of the
City of Salina by its Mayor on October 28, 1935, as authorized
by the Board of Commissioners on said date at and for the unit
prices contained in said proposal, which proposal and contract
are hereby referred to and made parts of this ordinance be and
the same are hereby ratified and confirmed, said proposal being
within the estimated cost of said improvements as shown by the
sworn estimate of the City Engineer filed in the office of the
City Clerk, which estimate of cost is hereby referred to and
made a part of this ordinance.
Section 2. That said reinforced concrete foundations shall
be built and constructed in accordance with the plans and speci-
fications therefor prepared by the City Engineer and on file in
the office of the City Clerk which plans and specifications are
hereby referred to and made parts of this ordinance and in accord-
ance with the proposal of said contractor and under the terms of
said contract hereinabove referred to, said work to be done and
the material, equipment, appliances and appurtenances necessary
and required in connection therewith to be performed and furnished
in accordance with said plans and specifications and in accordance

with the conditions of the Contract, Maintenance and Statutory Bonds
in the principal sum of $7467.00 in which said contractor is principal
and the Continental Casualty Company is surety, furnished by said
contractor and which have been heretofore presented to and duly
approved by the Board of Commissioners of said city.
Section 3. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

BE a -T ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the acceptance by the City of Salina of
