4563106 ORDINANCE N0. 4563 (First published in the Salina Journal August 13th, 1935) AN ORDINANCE relating to and regulating public dances, public dance halls, and places where public dancing is permitted or carried on, providing for a license tax therefor and repealing Section 1 and Section 2 of Ordinance No. 2414 being Sections 14-301 and 14-302 of Revised Ordinances 1925, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it shall be unlawful for any person, persons, club, society, or organization or the members, officers or directors thereof to conduct or operate any public dance as now or hereafter defined by Ordinance, or any dance hall or room or other place where public dancing is permitted, which shall be deemed to include any restaurant, dining room or other place where dancing is permitted in connection with the serving of food or drinks, whether or not any charge is made for such dancing in addition to the charge made for food and drinks served in any such place, which for the purposes of this and other ordinances of the City of Salina shall be deemed a public dance hall, without complying with all of the rules, regulations and require- ments now or hereafter provided for by ordinance with respect to public dances, and with the requirements and provisions provided for in this ordinance, and without first securing a license as provided for in this ordinance. Section 2. That no public dance hall shall be operated, and no public dance shall be given, and no public dancing as defined in Section 1 of this ordinance or as otherwise now or hereafter provided by ordinance, shall be permitted, in any building which is located within 50 feet of any dwelling house or other building occupied exclusively for residence purposes, within the City of Salina, Kansas, and no license as provided for in this ordinance, and no permit as now or hereafter provided for or required by ordinance, shall be issued for the operation. or a public dance hall to any person or persons, club, society or organization, or the members, officers, or directors thereof, except in conformity with the provisions and requirements of this ordinance or any other ordinance now or hereafter in effect. Section 3. Before any such license is issued, the person or persons, club, society or organization or the members, orficers or directors trnereof, applying for the same, shall file with the City Clerk, an application for such license wnich shall state the name of the applicant, and the location of the place where any such public dance is to be ;riven or wnere any such public dance hall is to be op -;rated, or where any such public dancing is to be permitted, with sucn auditional details with respect thereto as may be required by the City Glork, and shall pay to the City Clerk a license tax for the same as follows: 107 - _ ..... _ For one year, $100.00; for six months $50.00; for a single day or night y3.00; and in cases where a permit is required by ordinance from the Board of Public Welfare, shall exhibit such permit to the j City Clerk. Vection 4. If, upon the filing of such application and the payment of such license fee, it appears to the City Clerk that under the provisions of this and other ordinances of said city, the applicant is entitled to a license, the City Clerk may issue such license to such applicant, or if the City Clerk is not satisfied from such application that the applicant is entitled to a license, he shall refer such application to -the Board of Commissioners, who shall either approve or reject such application. If the application is approved by the Board of Commissioners, the City Clerk shall issue such license, and if the application is rejected no license shall be issued, and the amount deposited with the City Clerk as a license fee shall be re- turned to the applicant. The Board of Commissioners shall have the right at any time, if such board is satisfied that any licensee is violating any of the provisions of this or any other ordinance of the City of Salina, or that any public dance or dancing is being I conducted contrary to the provisions of this or any other ordinance of the City of Salina, to revoke any license issued, whether the same was issued with or without the approval of the Board of Commissioners. s Section 5. No license issued under the provisions of this ordinance shall be in any manner assignable or transferable, and no such license shall be issued to or permitted to be held by any person i or persons who are not of good moral character, or for the operation i or conduct of any public dance or public dance hall orfir any public a dancing in any place where the ordinances of the City of Salina or the laws of the State of Kansas are violated. Fach yearly license issued hereunder shall expire on December 31st following the date of issue and each six months license shall expire on the 31st day of July, or on the 31st day of December, following the date of such issue. Section 6. Any person who shall violate or who shall cause, permit or direct the violation of any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than $25.00 nor more than $100.00 for each offense, and each separate violation and each day upon which any such violation is caused or permitted to exist, shall be deemed a separate offense. 108 Section 7, That Sections 1 and 2 of Ordinance No. 2414 being Sections 14-301 and 14-302 Revised Ordinances 1925, be and the same are hereby repealed.
