AN ORDINANCE providing for and authorizing the construction of an
elevated water storage tank together with the necessary
appurtenances and connections with water mains, by the Water-
works Department of the City of Salina for the purpose of
furnishing additional fire protection and water supply for
the City of Salina, Kansas.

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas
Section 1. That the Board of Commissioners of the City of
I Salina deem it necessary and do hereby declare it to be necessary
that an elevated water storage tank together with the necessary
appurtenances and connections with water mains, be constructed

by the Waterworks Department of the City of Salina for the purpose
of furnishing additional fire protection and an additional supply
of water to the City of Salina and to its inhabitants, which are
hereby declared to be necessary for the preservation and protection
of the health, property and welfare of the people of the City of
Salina.
Section 2. That the Waterworks Department of the City of
Salina be and it is hereby authorized and directed to construct
or cause to be constructed in the manner herinafter provided for
an elevated water storage tank having a capacity of from 750,000
gallons to 1,000,000 gallons to be located at such place in the
City of Salina as may be hereinafter provided for by ordinance
and upon real estate to be acquired by the City of Salina for such
purpose, as may be hereafter authorized by ordinance, together with
the necessary appurtenances and connections with water mains, to be
built in accordance with specifications to be prepared by the City
Engineer of the City of Salina (as ea -officio Engineer for the
Waterworks Department of said city) and to be paid for as herein-
after provided for.
Section 3. That the City Engineer of the City of Salina be
and Ixe is hereby authorized and directed to prepare specifications
for an elevated water storage tank having the capacity above pro-
vided for together with the necessary appurtenances and connections
with water mains, which shall be filed in the office of the City
Clerkand submitted to the Board of Commissioners for their approval
on or before the 3rd day of June, 1935, and to prepare and file
in the office of the City Clerk on or before said date a detailed
estic-ate under oath of the cost thereof. After such specifications
have been filed and approved as aforesaid the City Clerk shall
advertise for at least three consecutive days in the official city
paper of the City of Salina for sealed proposals for the building
and construction of such improvements in accordance with the speci-
fications so prepared and filed by the City Engineer and at the time
and place specified in said notice such sealed proposals shall be
opened by the Board of Commissioners of said city and the Board of
Commissioners may let a contract for the construction of such improve-
ments to the lowest and best responsible bidder therefor, upon such
terms and conditions as the Board of Commi-ssioners may require, and
the Board of Commissioners shall and do hereby reserve the right to
reject any and all such proposals.
Section 4. That the City of Salina shall make application to
the Federal Emergency administration of Public Works for a grant
allotment to be applied to the payment of the cost of construction
of the elevated water storage tank together with the necessary
appurtenances and connections with water mains, herein provided for,
in the amount of 30% of the cost of such construction or such portion
thereof or such amount in excess thereof as may be secured for such
purpose from said Federal Emergency ,Administration of Public Works
or from such other Federal or State Agency as may have jurisdiction
or control over funds available for such purpose, and the City Manager
and City Engineer of the City of Salina and all other officers of
said city are hereby authorized and directed to make and execute on
behalf of the City of Salina all such applications, certificates or
other documents as may be required for the purpose of securing such
grant allotment in accordance with the regulations of the Federal
Emergency Administration of Public Works or such other Federal or
State Agency as may have jurisdiction or control over the furnishing
or distribution of such funds.
Section 5. The cost of constructing the improvements herein pro-
vided for, except that portion of such eost as may be secured from
the Federal Emergency Administration of Public Works or such other
Federal or State Agency as may have jurisdiction or control over
the furnishing or distribution of funds available for such purpose,
shall be paid out of the Waterworks Department Fund in the City
Treasury of the City of Salina, in which fund there is now on hand
and available for such purpose, out of the earnings of said Water-
works Department, and in the Sinking Fund provided for such purpose,
an amount sufficient to pay the cost of such improvements, together
with the cost of acquiring the real estate upon which such improve-
ments are to be located as herein above provided for.
Section 6. This ordinance shall take effect and be in force from
and after its publication in the official city paper.
