452923 (published in the Salina Journal April 16, 1935) AN ORDINANCE providing for and authorizing the issuance of Improve- ment Bonds of the City of Salina, Kansas, in the sum of $18,340.53, to pay the cost of improving certain streets in said city, to be designated as Series P-110. WHEREAS, pursuant to proceedings duly had according to law, con- tracts have been let and performed for the construction of the following street improvements to said city, to -wit; Repaving of Ninth Street from the south line of Ash Street to the south line of North (west of Ninth Street) ' as provided for by Resolution No. 578 and by Ordinance No, 4328. Recurbing of Ninth Street from thesouth line of Bishop Street to the south line of North Street (west of Ninth Street) as provided for by Resolution No. 579 and by Ordinance No. 4329. Curbing, guttering and paving of Unive-sity Place from the east line of Baker Street to the west line of: Twelfth Street as provided for by Resolution No. 573 and by Ordinance No. 4330. Curbing, guttering and paving of Columbia Avenue from the north line of Ash Street to the south line of Elm Street as provided for by Resolution No. 584 and by Ordinance No. 4331; and WHEREAS, the total cost of said improvements (after deducting the total amount furnished or to be furnished and paid to the City of Salina, Kansas by the Federal Emergency Administration of Public works as a grant allotment in connection with the construction of such improvement and after deducting the amount charged to and paid by certain Railroads for the paving of the railroad crossings across said street and the amount chargeable to and paid by the waterworks department for repaving over the water mains constructed by it In Ninth Street at the time of each repaving) has been ascer- tained and the total portion thereof to be paid by a general tax to be levied upon all taxable property within said city for. the improve- ment of the squared and areas formed by the crossing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city and including one-third of the remaining cost of such repaving on Ninth Street between the south line of Ash Street and the south line of North Street, west of ninth Street, to be paid by the City at large, as provided by law, (the repair and general improvement funds of said city being hereby found and determined to be insufficient to meet the cost and expense of such portion of repaving to be paid by the city at, large) , for which the city is liable and for which bonds will be issued as hereinafter provided for, has been ascertained and is hereby determ'ned to be the sum of $9,725.27; and WIMMEAS, the portion of said street improvements to be paid by special assessments levied upon the lots and pieces of ground liable for payment of said street improvements has been ascertained and is hereby found and determined to be the sum of $14,499.30 which said last amount has been bLeretofore duly assessed and apportioned to the several lots and pieces of ground liable there- for, payable in ten equal installments according to law and as pro- vided in the ordinances of the City of Salina relating thereto, duly passed and approved, of which amount the sum of $5884.04 has been paid by the owners of property liable therefor, leaving a balance for which bonds will be issued in the sum of $8,615.26 and; WHEREAS, the total cost of said improvements for which bonds will be issued exclusive of the amount heretofore paid in cash by the property owners has been and is now hereby determined to be the sum of $18,340.53, NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That for the purpose of provjding funds to pay the cost of Improvements hereinbefore described, there shall be issued and there hereby are issued Internal Improvement bonds of the City of Salina, Kansas, in the total principal sum of I18,340.53 which issue shall consist of 19 bonds numbered from 1 to 19 inclusive, 24 all dated December 1, 1934, which shall bear interest at the rate of two and one-half (2z) per cent per annum from and after said date until the respective maturities of said bonds, payable semi- annually, to be evidenced by interest coupons as herein provided for, and said bonds shall become due serially in denominations as follows; No. 1 for 340.53, due December 19 1935 N o.,2 for $1000 due December 1, 1935 No. 3 for 91000 due December 1, 1936 Nos. 4 & 5 for $1000 each due December 1, 1937 Nos. 6 & 7 for $1000 each due December 1, 1938 Nos. 8 & 9 for $1000 each due December 1, 1939 Nos. 10 & 11 for $1000 each due December 1, 1940 Nos. 12 & 13 for $1000 each due December 1, 1941 Nos. 14 & 15 for $1000 each due December 1, 1942 Nos. 16 & 17 for $1000 each due December 1, 1943 Nos..18 & 19 for $1000 each due December 1, 1944 Section 2. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk, and the corporate seal of the City shall be affixed thereto. Said bonds shall have attached thereto interest coupons representing the interest thereon and said interest coupons shall be in the form provided by law, and shall bear the fac-simile signatures of the Mayor and City Clerk of said city, and said bonds shall be registered in the offices of the City Clerk and State Auditor as required by law. Section 3. Said bonds shall be in the form and shall contain recitals substantially as followsi followsto be designated as Series p-110, to -wit; KNOW ALL MEN the County of Saline, indebted and for value bearer the sum of Series P-110 No. INTERNAL IMPROVEMENT BOND BY THESE PRESENTS, That the City of Salina, in State of Kansas, acknowledges itself to be received hereby promises to pay to the Dollars in lawful money of the Lrnited States of America, on the first day of December 19 , with interest thereon from the date hereof at the rate of tPao and one-half ( 22 ) percent per annum, payable semi- annually on the first days of June and December in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 19 bonds of like date and tenor, expecting denomination and maturity, aggregating the principal sum of $18,340.53 issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain paving, curbing and guttering improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-115, 12-601 to 12-608, and 13-1012, Revised Statutes of Kansas 1923 as amended, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, condi- tions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the said. City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the fac-simile signatures of said officers, and this bond to be dated the first day of December, 1934.
