AN ORDINANCE ratifying and confirming a contract for the building and
construction of Storm Sewer Number 17-B, and providing for the
issuance of temporary notes to pay the cost thereof pending
issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the acceptance by the City of Salina of the
proposal of H. J. Taylor Construction Company of Salina, Kansas, here-
inafter referred to as the "Contractor" as submitted to the Board of
Commissioners on February 18, 1935, which is hereby found and determined
to be the lowest and best bid for such works, and the contract awarded
by the Board of Commissioners of said city to said contractor and signed
on behalf of the City of Salina by the Mayor on February 18, 19350 for
the construction of Storm Sewer Number 17-B, as provided for in Ordinance
Number 4510 at and for the unit prices contained in said proposal, which
proposal andcontract are hereby referred to and made parts of this
ordinance, be and the same is hereby ratified and confirmed, said pro-
posal being within the estimated cost of said improvements as shown by
the sworn estimate of the City Engineer filed in the office of the City
Clerk, which estimate is hereby referred to and made a part of this
ordinance.
Section 2. That said Storm Sewer Number 17-B shall be built
and constructed in accordance with the plans and specifications there-
for prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the proposal of said contractor and under
the terms of said contract entered into between the City and said
contractor on February 18, 19350 which said plans, specifications,
proposal and contract are hereby referred to and made parts of this
ordinance, said work to be done and the material, equipment, appliances
and appurtenances necessary and required in connection therewith to
be performed and furnished in accordance with said plans and specifica-
tions, conditioned however upon the furnishing by the contractor of the
contract, maintenance and statutory bonds within the time required by
said contract.
Section 3. That temporary notes signed by the Mayor and
attested by the City Clerk be issued from tip to time as the work
progresses in the manner and form as required by law, the total amount
thereof not to exceed the contract price for such work, such notes to
bear interest not to exceed four per cent per annum and to be issued
in suc)a amounts and at such time as money for the payment of the cost
of such work may be required, such notes to be issued to said contract-
or and to be redeemed and cancelled at the time that permanent bonds
are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

BE IT OrdLnINED by the Board of Commissioners of the City of Salina,
