AN ORDINANCE providing for the repair and reconstruction of certain
portions of a certain sewer in Ash Street in the City of Salina
and of a certain portion of the sewage flow line connecting the
sewage pumping station it the terminus of said Ash Street sewer
and the sewage disposal plant and providing for the payment of
the cost of such improvements by the city at large and for the
issuance of general improvement bonds of said city to pay such
cost.
WHEREAS, a certain portion of the main sanitary sewer in Ash Street
in the City of Salina, between DesMolnes Avenue and Ohio Street and
a portion of said sewer lying west of the Ash Street bridge across
the Smoky Hill River and a certain portion of the sewage flow line
connecting the sewage pumping station at the eastern terminus of the i
Ash Street sewer and the sewage disposal plant, are in need of re-
pair and reconstruction by reason of damage caused thereto by flood
waters, and

WHEREAS, in the judgment of the governing body of the City of Salina
such portions of said sewers should be repaired and reconstructed
in the manner provided by law; and
WHEREAS, said sewers serve a substantial portion of said city and
in the judgment of the governing body of said city the cost of repairing
and reconstructing the same slgrould be borne by the city at large; and
WHEREAS, the general fund of said city is insufficient to pay such
cost and such gover ning body deems it necessary to issue general
improvement bonds in said city in the manner provided by law to pay
such cost, NOVI THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the foregoing preambles be and they are hereby
adopted as a part of this ordinance and that the main sanitary sewer
in Ash Street in the City of Salina between DesMoines and Ohio Street
in said city and a portion thereof lying west of the Ash Street bridge
across the Smoky Hill River and a portion of the sewage flow line
between the sewage pumping station at the eastern terminus of said
Ash Street sewer and the sewage disposal plant be repaired and re-
constructed to such extent as may be necessary within the limits
above mentioned.
Section 2. That on or before the 8th day of August, 1938 the
City Engineer shall prepare and file with the City Clerk plans
and specifications for the repair and reconstructing of the portions
of said sewers described in Section 1 hereof, together with a de-
tailed estimate of the cost thereof, under oath, and thereafter the
City Clerk shall advertise in the off ical city paper for three con-
secutive days for sealed proposals for the construction of such
work according to the plans and specifications of the City Engineer.
Upon receipt of such proposals the governing body shall let a con-
tract for such work and improvements to the lowest responsible
bidder therefore, if there be any whose bid does not exceed the
estimate of the City Engineer, but the city shall reserve the right
to reject any or all bids and if no bid shall be received within
such estimate the governing body shall have the power to do such
work and make such improvements within the estimated cost thereof
as provided by law.
Section 3. That for the purpose of paying the cost of
work and improvements, general improvement bonds in an amount
not to exceed the contract price for such work or the cost thereof
if done by the city, shall be issued and sold in the manner pro-
vided by law and for the purpose of paying such bonds and interest
as the same become due and payable, the Board of Commissioners
shall levy a general tax upon all taxable property in the City
of Salina in the time and manner provided by law.
Section 4. This ordinance shall take effect and be in
force from and after its publication in the official city paper.
