AN ORDINANCE providing for and authorizing the issuance of Improve-
ment Bonds in the City of Salina, Kansas, in the sum of 044,373.31
to pay the cost of improving certain streets in said city to be
designated as Series P-118.
'c'JHEREAS, pursuant to proceedings duly had according to law, contracts
have been let and performed for the construction of the following
street improvements in said city or such improvements have been con-
structed by said city under the direction of its City Engineer accord-
ingly to law within the estimated cost thereof after the advertisement
for and rejection of bids where no bids were received within the
engineer+s estimate, to -wit:
Curbing, guttering and grading of Kansas Avenue from Elm
Street to a point 500 ft. north of Elm Street as provided
for by Resolution No. 637 and Ordinance No. 4573.
Curbing, guttering and grading of Sheridan Avenue from
Crawford Avenue to Republic Avenue as provided for by
Resolution No. 636 and Ordinance No. 4574.
Curbing, guttering and grading of Phillips Street from
Charles Street to Crawford Avenue as provided for by
Resolution No. 644 and Ordinance No. 4716.
Curbing, guttering and grading of K'rwin Avenue from
Ninth Street to Highland Avenue as provided for by
Resolution No. 645 and Ordinance No. 4716.
Curbing, guttering and grading of Oakdale Avenue from

Recurbing and reguttering and grading and paving a portion
of Eighth Street from Iron Avenue to Walnut Street as pro-
vided for by Resolution No. 671 and Ordinance No. 4716, and
WHEREAS, the total cost of said improvements has been ascertained and
the total portion thereof to be paid by a general tax to be levied
upon taxable property within said city for the improvement of the
squares and areas formed by the crossing of streets and alleys and
for the improvement of any of said streets where the same is through
or adjacent to property of the city or of the federal government to
be paid by the city at large as provided by law for which the city
is liable and for which bonds will be issued as hereinafter provided
for, has been ascertained and is hereby determined to be the sum of
�;6, 832.54, and it is hereby found and determined that the repair and
general improvement funds of said city are insufficient to meet the
cost and expense of such portion of any of said improvements as might
otherwise be paid therefrom; and
WHEREAS, that portion of the cost of said street improvements to be
paid by special assessments levied upon the lots and pieces of ground
liable for the payment of said street improvements has been ascertained
and is hereby found and d etermined to be the sum of y 43,138.07 which
said last amount has been heretofore duly assessed and apportioned to
the several lots and pieces of ground liable therefor, payable in in-
stallments according to law and as provided in the ordinances of said
city relating thereto duly passed and approved, of which amount the
sum of �?�5,587.30 has been paid to said city by the owners of property
liable therefor, leaving a balance of said sum for which bonds will
be issued in the sum of 037,540.77; and
10,`HEREAS, the total cost of said improvements for which bonds will be
issued exclusive of the amount heretofore paid in cash by the property
owners has been and is now hereby determined to be the sum of $44,373.31;
NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:

Section 1. That the foregoing preambles be and they are hereby
adopted as a part of this ordinance and that for the purpose of pro-
viding funds to pay the cost of the improvements hereinbefore, and
in the ordinances and resolutions hereinbefore referred to, described,
there shall be issued and there hereby are issued Internal Improve-
ment Bonds of the City of Salina, Kansas, in the total principal
sum of $44,373.31, which shall consist of 45 bonds numbered from
one to 45 inclusive, all dated May 1st, 1938, which shall bear in-
terest at the rate of two per cent per annum from and after said
date until the respective maturities of said bonds, payable semi-
annually, said interest to be evidenced by interest coupons as here-
in provided for, and said bonds shall become due serially in de-
nominations as follows:
No. 1 for $373.31 due May 1st, 1939
Nos. 2, 3, 4 & 5 for $1000 each due May lst, 1939
Nos. 6. 70 8 & 9 for $1000 each due May 1st, 1940
Nos. 10, 11, 12 and 13 for $1000 each due May 1st, 1941
Nos. 140 15, 16 and 17 for ,1000 each due May 1st, 1942
Nos. 18, 19, 20 and 21 for ,1000 each due May lst, 1943
Nos. 22, 23, 24 and 25 for $1000 each due May lst, 1944

Section 2. Said bonds shall be signed by the Mayor and shall
be attested by the signature of the City Clerk and the corporate
seal of the city shall be affixed thereto, said bonds shall have
attached thereto interest coupons representing the interest there
on, which coupons shall be in the form provided by law and shall
bear the fac-simile signatures of the Mayor and City Clerk of said
city and said bonds and interest coupons shall be registered in the
Offices of the City Clerk and the State Auditor as required by law.
Section 3. Said bonds shall be designated as Series P-118 and
shall be in the form and shall contain recitals substantially as

KNO1V ALL TJEN BY THESE PRESENTS, That the City of Sallina, in the
County of Saline, State of Kansas, acknowledges itself to be indebted
and for value received hereby promises to pay to the bearer the slam of
Dollars
in lawful money of the United States of America, on the first day
of J. with interest thereon from the date here-
of at the rate of percent per annum,
payable semi-annually on the first days of and
in each year, on presentation and surrender of the interest coupons
hereto annexed as said coupons severally become due, both principal
and interest of this bond being payable at the office of the State
Treasurer of the State of Kansas, in the Cit; of Topeka, Kansas.
And said City of Salina, Kansas, is held and firmly bound by these
presents and the full faith, credit and resources of said city are
hereby irrevocably pledged for the payment of said principal and
interest at maturity.
This bond is one of a series of 45 bonds of like date and tenor,
excepting; denomination and maturity, aggregating the principal sum
of y44,373.31 issued by the City of Salina. Kansas, for the purpose
of paying the cost of constructing certain paving, curbing,and gutter-
ing impprovements in said city by the authority of and in full com-
pliance with the provisions, restrictions and limitations of the
constitution and laws of the State of Kansas, including Sections
10-101 to 10-115, 12-601 to 12-608, and 13-1012, General Statutes
of Kansas 1935, and such sections as amended, and all other pro-
visions of the laws of said state applicable thereto, and this
bond and all other bonds of this series, and all interest thereon
are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, condi-
tions and things required to be done and to exist precedent to and
in the issuance of this bond have been properly done and performed
and do exist in due and regular form and manner as required by the
constitution and laws of the State of Kansas, and that the total
indebtedness of said city, including this series of bonds, does not
exceed any constitutional or statutory limitation.
IN I-VITNESS WHEREOF, the said City of Salina, Kansas, has executed
this bond by causing it to be signed by its Mayor and its corporate
seal to be hereto affixed, attested by its City Clerk and the coupons
hereto attached to be sued with the fac-simile signatures of said
officers, and this bond to be dated the first day of 1938.

Section 4. The Mayor and City Clerk are hereby authorized
and directed to prepare and execute the bonds hereinbefore des-
cribed and to advertise and sell the same in the manner provided
I by law, and, when duly executed and registered to deliver said
bonds to the purchaser or purchasers thereof.
Section 5. The full faith, credit and resources of the City
of Salina, Kansas, shall be, and the same are hereby irrevocably
pledged for the prompt payment of said bonds and all :interest
thereon, The Board of Commissioners of the City of Salina, Kansas,
shall. annually make provision of the payment of the principal and
interest on said bonds as the same become due by levying taxes
nd assessments upon the property liable therefor as provided by
law.
Section 6. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

been ascertained and is hereby found and determined to be the
sum of $43,138.07 which said last amount has been heretofore
duly assessed and apportioned to the several lots and pieces of
ground liable therefor, payable in instalLments according to
law and as provided in the ordinances of said city relating
thereto duly passed and approved, of which amount the sum of
68,687.30 has been paid to said city by the owners of property
liable therefor, leaving a balance of said sum for which bonds
will be issued in the sum of $37,540,77; and
WHEREAS, the total cost of said improvements for which bonds
will be issued exclusive of the amount heretofore paid in cash
by the propert owners has been and is now hereby determined to
be the sum of 144.,373,31; NOW THEREFORE
BE IT ORDAINED by the Board of Co=, issioners of the City of Salina,
Kansas:
Section 1. That the forgoing preamble4be and they are hereby
adopted as a part of this ordinance and that for the purpose of
providing funds to pay the cost of the improvements hereinbefore��
and in the ordinances and resolutions hereinbefore referred to,,,
sFd described, there shall be issued and there hereby are issued
Internal Improvement Bonds of the City of Salina, Kansas, in the
total principal sum of $44,373,31, which shall consist of 45 bonds
