AN ORDTNANCE providing for the construction of certain storm sewers
in the City of Salina to be designated as Storm Sewers No, 10-B
and Ido 10-C and providing for the letting; of contract for such con-
struction and for the payment of the cost thereof.
BE IT ORDAINED by the Board of Comnissioners of the City
Kansas: of Salina,
Section 1. That it is necessary and it is hereby ordered storm
sewers which are hereby designated as Storm Sewers Zto. 10-B and No.
10-C together with all necessary inlets, inlet connections, manholes,
connecting lines and other appurtenances be constructed in the City
of Salina along the following courses, to -wit:
No. 10-B beginning at an inlet manhole to be constructed at the
northeast corner of the intersection of K.irwin Avenue and Tenth
Street; thence as a 12 inch sewer running; gest in K!.rwin Avenue a
distance of 544 ft. to a manhole to be constructed at the intersection
of Kirwin Avenue and PershinZ Street;thence north in Pershing Street
as a 15 inch sewer a distance of 342 feet to a manhole to be con-
structed at the intersection of Pershing Street and Jewell Avenue;
thence north in Pershing Street as an 18 inch sewer a distance of
639 ft. to a manhole at the intersection of Pershing Street and Sunset
Drive.
No. 10-C beginning at a manhole to be constfucted at the inter-
section of Funston Street and Jewell Avenue; thence east in Jewell
Avenue as a 15 inch sewer a distance of 603 ft. to a manhole to be
constructed in Storm Sewer No. 10-B at the intersection of Jewell
Avenue and Pershing Street,
Sectinn 2. That on or before the 21st day of March 1938, the
pity Engineer shall prepare and file in the office of the City Clerk
detailed plans and specifications for the construction of the storm
sewers provided for in Section 1 of this ordinance with vitrified
and/or concrete sewer pipe or any combination of such types of sewer
pipe and on or before the same date shall prepare and file in the
office of the City Clerk, under oath, detailed estimates of cost
thereof. After such plans and specifications and estimates of cost
shall have been filed, the City Clerk shall advertise by advertisements
published in the official city paper for at least three consecutive
days for sealed proposals for the building and construction of such
storm sewers and at the time and place mentioned the Board of Com-
missioners, may contract with the lowest and best responsible bidder
therefor for the building and construction of stich storm sewers, but
the richt to reject any and all bids shall be and is hereby reserved;
and provided further that if no responsible person shall propose to
enter into a contract at a price not exceeding; the estimated cost
the Board of Commissioners may proceed to construct said improvements
within the estimated cost thereof and shall purchase the necessary
tools, apparatus and materials and employ the necessary labor for the
purpose of constructing the same.
Section 3. That for the payment of the cost of such work except
such part thereof as may be paid from funds furnished by any Federal
or State Agency or except for such labor as may be furnished by any
Federal or State Agency, the Board of. Commissioners shall issue Improve-
ment Bonds of the City of Salina, Kansas, in an amount not to exceed
the total cost of such work and improvements, except as herein pro-
vided, to be payable in ten approximately equal annual installments
and to bear interest at not to exceed 5% per annum from the date of
such bonds, and for the purpose of paying; such bonds and interest as
they severally mature, the Board of Commissioners shall annually levy
a tax upon all real and personal property in the City of Salina in an
amount sufficient to pay the annual installments of such principal and
interest, and that pending the issue of such bonds, temporary notes
shall be issued according to law, to pay the cost of such work,
Section 4. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
