AN ORDINANCE creating and defining certain lateral sanitary sewer dis-
tricts in the City of Salina designated as Lateral Sanitary
Sewer District No. 17, 158, 175, 1760 177 and 178, providing
for the construction of lateral sanitary sewers in such dis-
tricts and for the cost thereof and for the levying of special
assessments against the property in such districts for the
payment of such cost, and for the issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Lateral Sanitary Sewer District No. 17. That there
be and there is hereby created a lateral sanitary sewer district in the
City of Salina which shall be designated as Lateral Sanitary Sewer Dis-
trict No. 17, and which shall include all of the following described
property in the City of Salina, to -wit:
Lots 1 to 20 inclusive in Block 6, and Lots 1 to 30
inclusive in Block 14 in Pacific Addition in Salina,
Kansas.
Section 2. That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connections, manholes,
flush tanks and other appurtenances be constructed and built in and to
serve said lateral sewer district No. 17 as created by Section 1 of
this ordinance, along the following course, to -grit:
In the alley between Seventh and Eighth Streets beginning
at a manhole to be constructed at a point 10 feet south
of the south line of Pacific Avenue, thence south on the
center line of said alley a distance of 1080 feet as an
a" sewer to a manhole to be constructed in the intersection
of said alley and the alley running east and west north of
Grand Avenue, thence east on the center line of said alley
last mentioned a distance 75 feet as an 811 sewer to a flush
tank to be constructed in said alley and running west from
the manhole to be constructed in the intersection of said
alleys along the center line of said east and'west alley
a distance of 75 feet as a 611 sewer*
Section 3. Lateral Sanitary Sewer District No. .158. That
there be and there is hereby created a lateral sanitary sewer dis-
trict in the City of Salina which shall be designated as Lateral
Sanitary Sewer District No. 158, and which shall include all of
the following described property in the City of Salina, to -wit:
All of Lots 9 to 16 inclusive in Block 13, Lots 1 to 11
inclusive, Block 17, Lots 12 to 22 inclusive, Block 18s
Lots 13 to 24 inclusive, in Block 22; and Lots 1 to 12
inclusive in Block 23, all in Southern Heights Addition
In Salina, Kansas.
Section 4. That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connections,Manholes,
flush tanks and other appurtenances be constructed and built in and to
serve said lateral sewer district No. 158 as created by Section 3 of
this ordinance, along the following course, to -wit:
Beginning at an existing manhole in Merrill Street 5
feet south and 5 feet west of the intersection of the
center lines of Merrill and Venango Streets, thence
south in Merrill Street parallel with and 5 .feet west
of the center line of Merrill Street a distance of 1710
feet as an 8" sewer to a flush tank to be constructed
at the intersection of Merrill and Republic Streets.
Section 5• Lateral Sanitary Sewer District Noe 175. That
there be and there is hereby created a lateral sanitary sewer
district in the City of Salina which shall be designated as Lateral
Sanitary Sewer District No. 175, and which shall include all of
the following described property in the City'of Salina, to -wit:
Lots 17 to 34 inclusive in Block 4 in Riverside Addition
in the City of Salina, Kansas,
Section 6. That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connections, man-
holes, flush tanks and other appurtenances be constructed and
built in and to serve said lateral sewer district No. 175 as
created by Section 5 of this ordinance, along the following course,
to -wit:
i In the alley between Kansas Avenue and DesMoines Avenue
E beginning at an existing manhole 375 feet north of the
north line of Elm Street, thence north in said alley
480 feet as an 811 sewer to a flush tank to be constructed
in the center of said alley south of Riverside Drive.
Section 7. Lateral Sanitary Sewer District No. 1769 mat
there be and there is hereby created a lateral sanitary sewer dis-
trict in the City of Salina which shall be designated as Lateral
Sanitary Sewer District No. 176, and which shall include all of
the following described property in the City of Salina, to -wit:
Lots 1 to 10 inclusive in Block 11 in Oakdale Addition
In the City of Salina, Kansas.
Section 8. That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connections, man-
holes, flush tanks and other appurtenances be constructed and built
in and to serve said lateral sewer district No. 176 as created by
Section 7 of this ordinance, along the following course, to -wit:
Beginning at the existing manhole in Columbia Avenue
140 feet south of the south line of Gypsum Avenue,
thence southeast a distance of 6.8 feet as an 8" sewer
to a manhole to be constructed In the center line of
an alley at the west line of Columbia Avenue, thence
east on the center line of said alley a distance of
304 feet as an 8" sewer to a flush tank to be con-
structed in said alley west of Kansas Avenue.
Section 9. Lateral Sanitary Sewer District No. 177. That
there be and there is hereby created a lateral sanitary sewer dis-
trict in the City of Salina which shall be designated as Lateral
Sanitary Sewer District No. 177, and which shall include all of the
following described property in the City of Salina, to -wit:
Lots 1 to 13 inclusive and Lots 15, 18 and 20 in Block
3, and Lots 1 to 20 inclusive in Block 11, in Pacific
Addition (except such portion of any of said lots as
has been condemned for street purposes).
Section 10• That it is necessary and it is hereby ordered that
a lateral sanitary sewer with all necessary connections, manholes,
flush tanks and other appurtenances be constructed and built in and
to serve said lateral sewer district No. 177 as created by Section
9 of this ordinance, along the following course, to -wit:
Beginning at the existing manhole on Pacific Avenue
at its intersection with the alley running north and
south between Ninth Street and Tenth Street, thence
west in Pacific Avenue a distance of 330 feet as a
10" sewer to a manhole to be constructed at the inter-
section of Pacific Avenue to the alley running north and
south between Tenth and Eleventh Streets, thence south
in the center of alley last mentioned a distance of
1074 feet as an 8" sewer to a flush tank to be con -
strutted in said alley.
Section 11. Lateral Sanitary Sewer District No. 178. That
there be and there is hereby created a lateral sanitary sewer dis-
trict in the City of Salina which shall be designated as lateral
Sanitary Swer District No. 178, and which shall include all of
the following described property in the City of Salina, to -wit:
Lots 1 to 8 in Block 1, and Lots 1 to 8 in Block 10,
Southern Heights Addition; Lots 7, S, 9 and 10, in
Crawford Addition; Lots 5, 6, 7 and 8 in Block 1 in
Brown's Addition; Lots S. 9, 10 and 11 in Block 2 in
Brown's Addition; Lots 1 and 2 in Van's Replat of a
part of Block 1 in Fairview Addition, and Lots 10,
11, 12, 13 and 14 in Block 1 in Fairview Addition in
the City of Salina, Kansas.
Section 12* ghat it is necessary and it is hereby ordered that
a lateral sanitary sewer with all necessary connections, manholesy
flush tanks and other a,opurtenances be constructed and built in and
to serve said lateral sewer district No. 178 as created by Section 11
of this ordinance, along the following course, to -wit:
Beginning at the existing manhole at the intersection of
Sherman and venango Streets said manhole being 5 feet
south and 5 feet west of the intersection of the center
lines of said streets, thence north in Sherman Street
5 feet west of and parallel with the center line of said
street a distance of 845 feet as an 8" sewer to a flush
tank to be constructed in Sherman Street approximately
50 feet south of the south line of Crawford Street*
Section 13• That the City Engineer shall on or before

February 21, 1938* prepare and file in the office of the City
Clerk plans and specifications for the construction of Lateral
Sanitary Sewers provided for in the preceding sections of this
ordinance which shall be of proper character to serve the property
lying within the districts within which such sewers are to be con-
structed and shall on or before the same date prepare and submit
to the Board of Commissioners detailed estimates under oath of
the cost thereof. That thereafter the City Clerk shall advertise
for three consecutive days in the official city paper for sealed
proposals for the building and construction of such sewers accord-
ing to such plans and specifications, which proposals shall be
filed with the City Clerk on or before the time fixed in such notice,
at which time the Board of Commissioners may let a contract for the
building and construction of such sewers to the lowest and best

responsible bidder therefor, provided, that such bid shall not
exceed the estimated cost thereof and provided further that said
Board shall reserve the right to reject any or all such proposals.
Section 14* that for the cost of building and constructing
such sewers special assessments shall be made for the full cost
thereof, on all lots or pieces of land within said. Lateral Sanitary
Sewer Districts, within which such sewer shall be built, according

to the appraised value thereof, without regard to the improvements
or buildings thereon, except such portion of such cost as may be
secured from W. P. A. or any governmental agency, and the City
Engineer, City Manager, City Clerk and City Attorney of Salina,
j Kansas, are hereby authorized and directed to make and execute
in behalf of said city all proper applications, reports or other

written instruments which may be requisite or necessary for the
purpose of securing contribution of funds from the W. P. A. or
any other governmental agency to be used for paying part of the
cost of such improvements*
Section 15. After the passage and publication of this

ordAnance the Board of Commissioners shall appoint three dis-
interested appraisers who after having taken an oath to make a
true and impartial appraisement of all lots or pieces of land
liable to taxation for the cost of such improvements, shall within
five days after having been notified or their appointment proceed
to appraise all of the lots or pieces of land within such districts
liable to assessment and taxation as aforesaid, without regard to

the buildings or improvements thereon, and after making said appraise-
ments shall return the same to the Board of Commissioners of said city
and said Board shall designate a time for holding a special neeting
of said Board for the purpose of hearing any complaints that may be
made as to the value of any lot or piece of land appraised as aforesaid,
of which special session due notice shall be given in the official city
paper, and at which special session said Board may alter any valuation
of any lot or piece of land if, in their opinion, the same has been
appraised too high or too low.
Section 16• The special assessments herein provided for may
be paid by the person liable therefor in ten approximately equal annual
installments but the owner of any property liable to such assessment
may within thirty days from the date of determining the amount assessed
against his property pay the same in full and his property shall not
be liable for any assessment for the cost of such improvements, and
bonds as hereinafter provided for shall be issued for the amount of
the assessments remaining unpaid at the end of thirty days from the
time such assessment is fixed.
Section 17. For the purpose of paying for the work and improve -
meets in this ordinance provided for, the Board of Commissioners are
hereby authorized and directed to issue Improvement Bonds for the City
of Salina in an amount not to exceed the cost of such improvements#
or such part of such cost as may be in excess of any funds received
from the W Pe Ae or any other governmental agency which may contribute
to the cost of such improvements and to run for a period of ten years
and be payable in ten approximately equal annual installments, together
with interest not to exceed five per cent per annum, which bonds shall
be issued and payable according to law; and for the purpose of pay-
ing the principal and interest on said bonds as they severall become
due and payable the Board of Commissioners shall apportion and assess
against the lots or pieces of land within the taxing districts of such
improvements special assessments covering the cost of the improvements
constructed within or for such districts, respectively, as herein pro-
vided for, and the apportionment therein contained shall hold good for
all of the installments that are to be collected from the specific
property chargeable with said improvements. Such assessment and
apportionment ordinance shall contain the total amount of tax apportioned
to such tract of land within the taxing district and shall state the
number of annual installments in which such tax is to be collected;
and thereafter the City Clerk shall annually at the same time other
taxes are certified, certify to the County Clerk of Salina County,
Kansas a full list of all property liable for such work and improve -
meats, together with the respective amounts due on each of said
tracts of land, wliich amounts shall include the annual installments
and interest on all unpaid balances for one year at the rate of not
to exceed five per cent (.5%) per annum on such amounts so certified,
which shall be collected as other taxes are collected.
Section 18. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

built in and to serve said lateral sewer district No, 177 as
created by Section 9 of this ordinance, along the following
course, to -grit:
Beginning at the existing manhole on pacific Avenue
at its intersection with the alley running north and
south between Ninth Street and Tenth Street, thence
west in Pacific Avenue a distance of 330 feet as a
10" sewer to a man"aole to be constructed at the inter-
section of Pacific Avenue to the alley running north and
south between Tenth and Eleventh Streetsthence south
in the canter of alley last mentioned a 'distance of
1074 feet as an 8" sewer to a flush tank to be con-
structed in said alley.
Section 11• Lateral Sanitar9 Sewer District No* 178. That
there be and there is hereby created a lateral sanitary sewer
district in the City of Salina which shall be designated as
Lateral sanitary Sewer District NO* 178, and which shall include
all of the following described property in the City of Salina,

Section 12• That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connectionsi
manholes, flush tanks and other appurtenances be constructed
and built in and to serve said lateral sewer district No* 178
as created by Section 11 oft his ordinance, along the following
course, to -wit:
Beginning at the existing manhole at the intersection of
Sherman and Venango Streets said manhole being; 5 feet
south and 5 feet west of the intersection of the center
lines of said streets, thence north in Sherman Street
5 feet west of and parallel with the center line of
said street a distance of 845 feet as an 8" sewer to a
flush tank to be constructed in Sherman Street approximately
50 feet south of the south line of Crawford Street.
Section 13. That the City Engineer shall on or before Febru-
ar� 21st, 1938 , prepare and file in the office of the City Clerk
plans and specifications for the construction of Lateral Sanitary
Sewers provided for in the preceding sections of this ordinance
which shall be of proper character to serve the property lying
within the districts within which such sewers are to be constructed
and shall on or before the same date prepare and submit to the Board
of Commissioners detailed estimates under oath of the cost thereof.
That thereafter the City Clerk shall advertise for three consecu.

building and construction of such sewers according to such plans
and specifications,, which proposals shall be filed with the City
Clerk on or before the time fixed in such notice, at which time

Section 149 That for the cost of building and constructing
such sewers special assessments shall be made for the full cost
thereofs on all lots or pieces of land within said Lateral Sanitary
Sewer Districts$ within which such sewer shall be built$ according
to the appraised value thereoft without regard to the improvements
or buildings thereon.9 except such portion of such cost as may be
secured from We P. A. or any governmental ageneys and the City
Engineers City Managers City Clerk and City Attorney of Salinas
Kansas, are hereby authorized and directed to mare and execute
in behalf of said city all proper applications* reports or other
