AN ORDINANCE creating and defining a certain lateral sanitary sewer
district in the City of Salina designated as Lateral Sanitary
j Sewer District No. 156# providing for the construction of a
lateral sanitary sewer in such district and for the cost there-
of and for the levying of special assessments against the property
in such district for the payment of such cost. .and for the issuing
of bonds therefor.

BE IT ORDAINED by the Board of Commissioners of the City of Salina,

Kansas:
Section 1• LATERAL SANITARY SEWER DISTRICT N0. 156. That there
be and there is hereby created a lateral sanitary sewer district in
the -City of Salina which shall be designated as Lateral Sanitary
Sewer District NO* 156, -and which shall include all of the following
described property in the City of Salina, to -wit:
Lots 8 to 14 inclusive, Block 110 Southern Heights Add.
Lots 1 to 7 inclusive, Block 120 Southern Height Add.
Lots 13 to 36 inclusive, Dimick+s Addition
Lots 13 to 24 inclusive, Block 20, Southern Heights Add.
Lots 1 to 12 inclusive, Block 21, southern Heights Add,
potion 2. That it is necessary and it is hereby ordered that a
lateral sanitary sewer with all necessary connnections, manholes,
flush tanks and other appurtenances be constructed and built in and
to serve said lateral sewer district No. 156 as created by Section 1
of this ordinance, along the following course, to -wit:
In Custer Street from the existing manhole at the intersection
of Venango Street south 1635 feet to a flush tank to be con-
structed at a point 50 feet north of the north line of Republic
Avenue.
Section 3• That the City Engineer shall on or before November
1, 1937 prepare and file in the office of the City Clerk plans and
specifications for the construction of Lateral Sanitary sewer provided
for in the preceding sections of this ordinance which shall be of
proper character to serve the property lying within the districts
within which such sewers are to be constructed and shall on or before
the same date prepare and submit to the Board of Commissioners detailed
estimates under oath of the cost thereof. That thereafter the City
Clerk shall advertise for three consecutive days in the official city
paper for sealed proposals for the building and construction of such
sewers according to such plans and specifications, which proposals
shall be filed with the City Clerk on or before the time fixed in such
notice, at which time the Board of Commissioners may let a contract
for the building and construction of such sewers to the lowest and
best responsible bidder therefor, provided, that such bid shall not
exceed the estimated cost thereof and provided further that said Board
shall reserve the right to reject any or all such proposals.

Section 4• That for the cost of building and constructing sucly
sewer special assessments shall be made for the full cost thereof,
on all lots or pieces of land within said Lateral Sanitary Sewer Dis-

trict, within which such sewer shall be built, according to the appraised
value thereof, without regard to the improvements or buildings thereon,
except such portion of such cost as may be secured from We Pe A. or any
governmental agency, and the City Engineer, City Manager, City Clerk and
City Attorney of Salina, Kansas, are hereby authorized and directed to
make and execute in behalf of said City all proper applications, reports
or other written instruments which may be requisite or necessary for the
purpose of securing contribution of funds from the We P, Ae or any other
governmental agency to be used for paying part of the cost of such Improve-,

Section 5• After the passage and publication of this ordinance
the Board of Commissioners shall appoint three disinterested appraisers
who after having taken an oath to make a true and impartial appraisement
of all lots or pieces of land liable to taxation ,.for the cost of such
Improvements,, shall within five days after having been notified of their
appointment proceed to appraise all of the lots or pieces of land within
such districts liable to assessment and taxation as aforesaid, without
regard to the buildings or improvements thereon, and after making said
appraisements shall return the same to the Board of Commissioners of said
City and said Board shall designate a time for holding a special meeting
of said Board for the purpose of hearing any complaints that may be made
as to the value of any lot or piece of land appraised as aforesaid, of
which special session due notice shall be given in the official city
paper, and at which special session said Board may alter any valuation
of any lot or piece of land if, in their opinion, the sauce has been
appraised too high or too low,
Section 6e The special assessments herein provided for may be
paid by the person liable therefor in ten approximately equal annual
installments but the owner of any property liable to such assessment
may within thirty days from the date of determining the amount assessed
against his property pay the same in full and his property shall not be
liable for any assessment for the cost of such improvements, and bonds
as hereinafter provided for shall be issued for the amount of the assess-
ments remaining unpaid at the end of thirty days from the time such
assessment is fixed*
Section 7e For the purpose of paying for the work and improvements
in this ordinance provided for, the Board of Commissioners are hereby
authorized and directed to issue Improvement Bonds of the City of Salina
in an amount not to exceed the cost of such improvements, or such part of
such cost as may be in excess of any funds received from the We Pe Ae or
any other governmental agency which may contribute to the cost of
such improvements and to run for a period of ten years and be pay-
able in ten approximately equal annual installments, together with
interest not to exceed five per cent per annum, which bonds shall
be issued and payable according to law; and for the purpose of pay -
Ing the principal and interest on said bonds as they severally become

due and payable the Board of Commissioners shall apportion and assess
against the lots and pieces of land within the taxing district of
such improvements special assessments covering the cost of the im-
provements constructed within or for such districts, respectively,
as herein provided for, and the apportionment therein contained
shall hold good for all of the installments that are to be collected
from the specific property chargeable with said improvements. Such
assessment and apportionment ordinance shall contain the total amount
of tax apportioned to such tract of land within the taxing district
and shall state the number of annual installments in which such tax
{ is to be collected; and thereafter the City Clerk shall annually at
the same time other taxes are certified, certify to the County Clerk
of Saline County, Kansas, as a full list of all property liable for
such work and improvements, together with the respective amounts due
on each of said tracts of land, which amounts shall include the annual
installments and interest on all unpaid balances for one year at the
rate of not to exceed five per cent (5%) per annum on such amounts so
certified, which shall be collected as other taxes are collected.
Section 8. Zhis ordinance shall take effect and be in force
from and after its publication in the official city paper.

AN ORDINANCE creating and defininE/4-ertain lateral sanitary

Lateral Sanitary Sewer District No. 156, providing for

BE IT ORDAINED.by the Board of Commissioners of the City of
Salinas Kansas'
Section 1. LATERAL SANITARY SEWER DISTRICT NO. 156 .
That there be and there is hereby created a lateral sanitary
sewer district in the City of Salina which shall be designated
as Lateral Sanitary Sewer District No. 156, and which shall
include all of the following described property in the City of
Salina, to -wit:
Lots 8 to 14 inclusive, Block 11, Southern Heights Add,
Lots 1 to 7 inclusive, Block 12, Southern Heights Add.
Lots 13 to 36 inclusive, Dimick's Addition
Lots 13 to 24 inclusive, Block 20,Southern Heights Add.
Lots 1 to 12 inclusive, Block 21, Southern Heights Add,
Section 2. That it is necessary and it is hereby
ordered that a lateral sanitary sewer with all necessary con-
nections, manholes, flush tanks and other appurtenances be con-
structed and built in and to serve said lateral sewer district
No. 156 as created by Section 1 of this ordinance, along the
following course, to -wit:
In .Custer Street from the existing manhole at
the intersection of Venango Street south 1635
feet to a flush tank to be constructed at a point
50 feet north of the north line of Republic
Avenue.
Section 3. That the City Engineer shall on or before
November 1,1937 prepare and file in the office of the City Clerk plans
and specifications for the construction of Lateral Sanitary Sewer
provided for in the preceding sections of this ordinance which
shall be of proper character to serve the property lying within
the districts within which such sewers we to be constructed and
shall on or before the same date prepare and submit to the Board
of Commissioners detailed estimates under oath of the cost thereof.
That thereafter the City Clerk shall advertise for three consecu-
tive days in the official city paper for sealed proposals for the
building and construction of such sewers according to such plans
and specifications, which proposals shall be filed with the City
Clerk on or before the time fixed in such notice, at which time
the Board of Commissioners may let a contract for the building; and

construction of such sewers to the lowest and bei`responsible bidder
therefor, provided, that such bid shall not exceed the estimated
cost thereof and provided further that said Board shall reserve
the right to reject any or all such proposals.
Section 4, That for the cost of building and constructin
such sewer special assessments shall be made for the full cost
thereof, on all lots or pieces of land within said Lateral Sanitary
Sevier District, within which such sewer shall be built, according
to the appraised value thereof, without regard to the improvements
or buildings thereon, except such portion of such cost as may be
secured from V1. P. A. or any governmental agency, and the City
Engineer, City Manager, City Clerk and City Attorney of Salina, Kansas,
are hereby authorized and directed to make and execute in behalf of
said City all proper applications, reports or other written instru-
ments which may be requisite or necessary for the purpose of se-
curing contribution of funds from the VI. P. A. or any other governmental
agency to be used for baying part of the cost of such improvement.
Section 5, After the passage and publication of this ordi-
nance the Board of Commissioners shall appoint three disinterested
appraisers who after having taken an oath to make a true and im-
partial appraisement of all lots or pieces of land liable to taxa-
tion for the cost of such improvements, shall within five days
after having been notified of their appointment proceed to appraise
all of the lots or pieces of land within such districts liable to
assessment and taxation as aforesaid, without regard to the build-
ings or improvements thereon, and after making, said apprais ements
shall return the same to the Board of Commissioners of said City
and said Board shall designate a time for holding a special meeting
of said Board for the pua�pose of hearing any complaints that may be
made as to the value of any lot or piece of land appraised as afore-
said, of which special session due notice shall be given in the of-
ficial city paper, and at which special session said Boa»d may alter
any valuation of any lot or piece of land if, in their opinion, the
same has been appraised too high or too low.
section 6. _ The special assessments herein provided for may be
paid by the person liable therefor in ten approximately equal
annual installments but the owner of any property liable to such
assessment may within thirty days from the date of determining "6fte
the amount assessed against his property pay the same in full and his
property shall not be liable for any assessment for the cost of such
improvements, and bonds as hereinafter provided for shall be issued
for the amount of the assessments remaining unpaid at the end of
thirty days from the time such assessment is fixed.
Section ?. For the purpose of paying for the work and
improvements in this ordinance provided for, the Board of Commis-
sioners are hereby authorized and directed to issue Improvement Bonds
of the City of Salina in an amount not to exceed the cost of such
improvements, or such part of such cost as may be in excess of any
fubds received from the W. P. A. or any other governmental agency
Which may contribute to the cost of such improvements and to run
for a period of ten years and be payable in ten approximately
equal annual installments, together with interest not to exceed
five per cent per annum, which bonds shall be issued and payable
according to law; and for the purpose of paring the principal and
interest on said bonds as they severally become due and payable the
Board of Coxmmis s loners shall apportion and assess against the lots
and pieces of land within the taxing district of such improvements
special assessments covering the cost of the improvements construct-
ed within or for such districts, respectively, as herein provided for,
and the apportionment therein contained shall hold good for all of
the installments that are to be collected from the specific property
chargeable with said improvements. Such assessment and apportionment
ordinance shall contain the total amount of tax apportioned to such
tract of land within the taxing district and shall state the number
of annual installments in which such tax is to be collected; and
thereafter the City Clerk shall annually at the same time other tax-
es are certified, certify to the County Clerk of Saline County,
Kans as a full list of all property liable for such work and improve-
ments, together with the eespective amounts due on each of said
tracts of land, which amounts shall include the annual installments
and interest on all unpaid balances for one year at the rate of not
to exceed five per cent (5%) per annum on such amounts so certified,
which shall be collected as other taxes are collected.
Section S. This ordinance shalltake effect and be in
force from and after its publication in the official City paper.
