That Section 3 of Ordinance No* 2948 be and the F same is hereby amended to read as follows: „Section 2. No license for the operation of any taxicab in the City of Salinas Kansas shall be issued until the applicant or applicants. therefor shall .file with the City Clerk -.a -written applica- tion containing a description of such vehiele,.the make and type thereof, its motor and serial numbers, its state license number, 9 and the name of the insurance carrier.carrying-the _liability in- surance on such taxicab as required in this ordinance, and the number of the insurance policy, and _such other . informat ion as may be required, on a printed form furnished by the City for such pur- pose, and any license for the opera tion of any such taxicab shall apply to and cover only the specific vehicle described in such appli- cation, until on application duly made therefor by the same owner t and operator the right to transfer such license to another vehicle i be granted by the Board of Connissionerse The application shall be signed by the owner or owners of the vehicle described in the applica- tion and by any other person, firm or corporation or association in any manner interested in the direction, operation or control thereof or under whose name it is operated and s u j p such*1- person, firm or corporation or association shall b�`descr:,b in such application, and in any license issued pure' t tbereto, as the operator, and if any license is issued to the mm14"and operator of such taxicab, i a such license shall be issued to and in the name of such owner and such operator and upon the transfer of ownership of such vehicle by the owner to any other person, or if the person described as owner in the license is not in fact the owner of such vehicle, or upon such operator ceasing to have any interest in the direction, opera- tion or control thereof, or if it ceases to be operated under the name of the operator named in the license, any license so issued shall ipso facto be immediately cancelled and such taxicab shall not thereafter be operated by any person, as owner or otherwise, under such license and it shall be unlawful for any person to use, drive or operate either as owner or operator, or as agent, employee or manager of any owner or operator, any taxicab within the City of Salina which shall not have been duly licensed on or which any license has been cancelled or which has ceased to be operated by the owner 198 i and operator.named in the license, and both the owner and. operator, if they be different persons, and any person driving the same shall be deemed' guilty of . s violation of this ordinance If any . such taxicab is operated in the violation of _ any_ of . the provis.ions_.. of this_ section. The applicant or applicants for any such license shall at the time.the application is filed with the City Clerk -pay to the City Clerk the fee for such license as now or hereafter provided for by ordinance, and the City Clerk shall thereupon after inspection and approval of such vehicle by the license inspector as provided by ordinance, present such application to the Board of Corzm'.ssioners at the next regular meeting of such Board. The Board of Commissioners shall, if they consider. that the public conven- ience and necessity require the licensing of such taxicab, in addition to any other taxicabs which may at that time be operating.under licenses issued by the city, and if they deem the applicants therefor to be of good moral character and that they and any persons employed by them will operate the taxicab for which a license is desired properly and for the best interests of the public, and that they will obey and con- form to the ordinances of such c 1 ive to the operation of taxi- cabs and all other ordinances of" ity, grant a license to such applicant or applicants coveAn&,,the taxicab described in said applica- tion, and direct the �y ';,40rk to issue such license; Provided, however,, that the Board of Co'ioners shall not issue or have in effect at any one time licenses f*'taxicabs in a number in excess of the number of taxicabs which the Board of Commissioners may deem necessary for the best interests and convenience of the inhabitants of the City of Salina and the general public, or in such number that the owners and operators of the licensed taxicabs might in the opinion of the Board of Commissionerej be apt to engage in practices which would be detrimental to the best interests of the City and its inhabitants and the general public, and shall reject and deny any application in the event that they consider that the granting of such license would increase the number of taxicabs licensed to operate in the City of Salina beyohd the number necessary for the best interests and convenience of the inhabitants of said city and the general public, or if fox, any other reason they deem that the granting of such license would be detrimental to the public interest." Section 2• Section 4 of ordinance No. 2948 be and the same is amended to read as follows: "Section 4. It shall be unlawful to operate a taxicab for hire or permit the same to be operated in the City of Salina, nor shall any license for the operation thereof be granted by the Board of Commissioners of said city, until the applicant or applicants for a license shall deposit with the City Clerk a policy of liability 'yy' P y 5 _J�l z 7 E1 V insurance issued to and covering such applicants and covering the taxicab described in their application, in such form as shall be j acceptable to and approved by the Board of Commissioners, and issued i by an insurance company or association approved by the Board of Commissioners and in such amount as the Board of Com- missioners may deem sufficient to adequately protect the interests of the public, which liability insurance policy shall wind the company i or association issuing the same to pay compensation for injuries to or death of persons and for loss of or damages to property resulting 1 from the negligent operation of such taxicab, and shall make such { additional arrangements for the protection of the public, supple- menting such insurance policies, as the Board of Commissioners shall require and approve. Any such insurance policy shall have incorporated therein, or attached thereto by endorsement thereon, recitals to the t effect that the policy is issued in accordance with and under the requirements of the ordinances of the City of - alma pertaining .�J Vii thereto and that it is issued for the beneflt( - d for the purpose of protecting the public, including-passengefs therein, against in- juries or damages resulting fry the operation of said taxicab and w that it shall remain effective:urrtil cancelled as herein provided for, irrespective of any statements, declarations, misrepresentations, acts or omissions of the assured or of any agent, servant, employee W representative of assured, either in the application for said policy I or in the schedule of statements or declarations contained or referred I to in said policy, including statements as to ownership, or made, committed or omitted before or after the occurance of any injury or i damages caused by the operation of any such vehicle, and shall provide e that no cancellation of the policy or any endorsement thereon shall I be effective until the expiration of ten days after notice of such cancellation shall have been delivered to the City Clerk, and such other recitals as may be approved by and required by the Board of i Commissioners. Section 3. That Section 1 of Ordinance No. 3306 be and the same is hereby amended to read as follows: i "That no taxicab licensed to operate in the City of Salina in accordance with the Ordinance of said city pertai ereto shall � w be permitted to stand when unemployed at an3rf pac,on the public streets of said city except at such places as shay be designated for I such purpose from tine to time by they 13oaa'd 'of Commissioners of said Ci and allotted b the Board of C City y q issioners to the owner or owners of any such licensed taxicabs, such space to be so allotted only in 2t) such location as the Board of Commissioners may deem to be for the public interest and convenience; Provided, that space for not to exceed one taxicab may be allotted in front of or adjacent to the main entrance of each hotel in the city, and in front of each ground floor place of business actually used and maintained by any owner or operator as a taxicab office. _No such space shall be allotted to the owner or operator of any taxicabs by the Board of /Commissioners, in that portion f r��� of any street in front of or ad jaeeiif) private property unless the owner and the ground floor lessetk pP such private property shall join with the owner or: +operator of such taxicabs in an application for the allotment of such 'space; provided that the joining of such owner and lessee of the Apperty with the owner or operator of any such taxi- cabs shall not in itself require the granting of such applications and provided further that no space for any taxicab stand shall be designated or located on Santa Fe Avenye between Elm Street and Mulberry Street or on Iron Avenue between Fourth Street and Eighth Street, and any space allotted in any street may beby the Board of Commissioners vacated and restored to the use of the general public at any time, on notice to the owner or operator of any such taxicab. Section 4. That Section 2 of Crdinanc N 14625 as amended by Section 1 of ordinance No* 4633 be and tY>s s hereby amended to read as f ollowws : , a. Section 2. That the mkp ii .rates of fare for the transportation of passengers in any taxicab lensed by the City of Salina shall be as follows: Zone One shall consist of all of the City of Salina except that part lying east of Delaware street and north of Euclid Avenue and the fare from any point in Zone One, to any other point in Zone One shall be 10¢ for each passenger, except that from the.Union Station to any point in Zone One the rate of fare shall be 15 for each passenger. No license for the operation of any taxicab in the City of Salina, Kansas shall be issued until the applicant or applicants therefor shall file with the City Clerk a written applica- tion containing a description of such vehicle, the make and type thereof, its motor and serial numbers, its state license number# and the name of the insurance carrier carrying the liability in- surance on such taxicab as required in this ordinance, and the number of the insurance policy, and such other information as may be required, on a printed form furnished by the City for such pur- pose, and any license for the operation of any such taxicab shall apply to and cover only the specific vehicle described in such appli- cation, until on application duly made therefor by the same owner and operator the right to transfer such license to another vehicle be granted by the Board of Commissioners. The application shall be signed by the owner or owners of the vehicle described in the applica- tion and by any other person, firm or corporation or association in any manner interested in the direction, operation or control thereof or under whose name it is operated and such additional persons firm or corporation or association shall be described in such application, and in any license issued pursuant thereto, as the operator, and if any license is issued to the owner and operator of such taxicab, such license shall be issued to and in the name of such owner and such operator and upon the transfer of ownership of such vehicle by the owner to any other person, or if the person described as owner in the license is not in fact the owner of such vehicle, or upon such operator ceasing to have any interest in the direction, opera- tion or control thereof, or if it ceases to be operated under the name of the operator named in the license, any license so issued shall ipso facto be immediately cancelled and such taxicab shall not thereafter be operated by any person, as owner or otherwise, under such license and it shall be unlawful for any person to use, drive or operate either as owner or operator, or as agent, employee or manager of any owner or operator, any taxicab within the City of Salina which shall not have been duly licensed on or which any license has been cancelled or which has ceased to be operated by the owner and operator named in the license, and both the owner and operator, if they be different persons, and any person driving the same shall be deemed guilty of a violation of this ordinance if any such taxicab is operated in the violation of any of the provisions of this section. The applicant or applicants for any such license shall at the time the application is filed with the City Clerk pay to the City Clerk the fee for such license as now or hereafter provided for by ordinance, and the City Clerk shall thereupon after inspection and approval of such vehicle by the license inspector as provided by ordinance, present such application to the Board of Commissioners at the next regular meeting of such Board. The Board of Commissioners shall, if they consider that the public convenience and necessity require the licensing of such taxi- cab, in addition to any other taxicabs which may at that time be operating under -licenses issued by the city, and if they deem the applicants therefor to be of good moral character and that they and any persons employed by them will operate the taxicab for which a license is desired properly and for the best interests of the public, and that they will obey and conform to the ordinances of such city relative to the operation of taxicabs and all other ordinances of said city, grant a license to such applicant or applicants covering the taxicab described in said application, and direct the City Clerk to issue such license; Provided, however, that the Board of Com- missioners shall not issue or have in effect at any one time licenses for taxicabs in a number in excess of the number of taxicabs which the Board of Commissioners may deem necessary for the best interests and convenience of the inhabitants of the City of Salina and the general public, or in such number that the owners and operators of the licensed taxicabs might in the opinion of the Board of Commissioners be apt to engage in practices which would be detrimental to the best interests of the City and its inhabitants and the general public, and shall reject and deny any application in the event that they consider that the granting of such license would increase the number of taxicabs licensed to operate in the City of Salina beyond the number necessary for the best interests and con- venience of the inhabitants of said city and the general public, or if for any other reason they deem that the granting of such license would be detrimental to the public interest." Section 2• Section 4 of Ordinance No. 2948 be and the same is amended to read as follows: "Section 4• It shall be unlawful to operate a taxicab for hire or permit the same to be operated in the City of Salina, nor shall any license for the operation thereof be granted by the Board of Commissioners of said city, until the applicant or applicants for a license shall deposit with the City Clerk a policy of liability insurance issued to and covering such applicants and covering the taxicab described in their application, in such form as shall be acceptable to and approved by the Board of Commissioners, and issued by an insurance company or association approved by the Board of Commissioners and in such amount as the Board of Com- missioners may deem sufficient to adequately protect the interests of the public, which liability insurance policy shall bind the company or association issuing the same to pay compensation for injuries to or death of persons and for loss of or damages to property resulting from the negligent operation of such taxicab, and shall make such additional arrangements for the protection of the public, supplementing such insurance policies, as the Board of Uommissioners shall require and approve. Any such insurance policy shall have incorporated therein, or attached thereto by endorsement thereon, recitals to the effect that the policy is issued in accord- ance with and under the requirements of the ordinances of the City of Salina pertaining thereto and that it is issued for the benefit of and for the purpose of protecting the public, including passengers therein, against injuries or damages resulting from the operation of said taxicab and that it shall remain effective until cancelled as herein provided for, irrespective of any statements, declarations, misrepresentations, acts or omissions of the assured or of any agent, servant, employee or representative of assured, either in the applica. tion for said policy or in the schedule of statements or declarations contained or referred to in said policy, including statements as to ownership, or made, committed or omitted before or after the oenurance of any injury or damages caused by the operation of any such vehicle, and shall provide that no cancellation of the policy or any endorse- ment thereon shall be effective until the expiration of ten days after notice of such cancellation shall have been delivered to the City Clerk, and such other recitals as may be approved by and required by the Board of Commissioners. Section 3e That Section 1 of Ordinance No. 3306 be and the same is hereby amended to read as follows: "That no taxicab licensed to operate in the City of Salina in accordance with the Ordinance of said city pertaining thereto shall be permitted to stand when unemployed at any place on the public streets of said city except at such places as may be designated for such purpose from time to time by the Board of Commissioners of said city and allotted by the Board of Commissioners to the owner or owners of any such licensed taxicabs, such space to be so allotted only in such location as the Board of Commissioners may deem to be for the public interest and convenience; Provided, that space for not to exceed one taxicab may be allotted in front of or adjacent to the main entrance of each hotel in the city, and in front of each ground floor place of business actually used and maintained by any owner or operator as a taxicab office. No such space shall be allotted to the owner or operator of any taxicabs by the Board of Commissioners in that portion of any street in front of or ad- jacent to any private property unless the owner and the ground floor lessee of such private property shall join with the owner or operator of such taxicabs in an application for the allotment of such space; provided that the joining of such owner and lessee of the property with the owner or operator of any such taxicabs shall not in itself require the granting of such application, and provided further that no space for any taxicab stand shall be designated or located on Santa Fe Avenue between. Elm Street and Mulberry Street or on Iron Avenue between Fourth Street and Eighth Street, and any space allotted in any street may be by the Board of Commissioners vacated and restored to the use of the general public at any -time, on notice to the owner or operator of any such taxicab• Section 4. That Section 2 of Ordinance No. 4625 as amended by Section 1 of Ordinance No. 4633 be and the same is hereby amended to read as follows: Section 2. That the minimum rates of fare for the transporta- tion of passengers in any taxicab licensed by the City of Salina shall be as follows: Zone One shall consist of all of the City of Salina except that part lying east of Delaware Street and north of Euclid Avenue and the fare from any point in Zone One, to any other point in Zone One shall be 10� for each passenger, except that from the Union Station to any point in Zone One the rate of fare shall be 15¢ for each passenger. Zone Two shall consist of that part of the City of Salina lying east of Delaware Street and west of Marymount Road and the rate of fare from or to any point in Zone Two, to or from any other point in the city, shall be 15SC for one passenger and 5¢ for each additional passenger. Zone Three shall consist of that part of the City of Salina lying east of Marymount Road and the rate of fare from or to any point in Zone Three, to or from any other point in the city: shall be 20¢ for one passenger and 5¢ for each additional passenger. Zone Four shall consist of that part of the City of Salina lying north of Euclid Avenue and the rate of fare from or to a point in Zone Four, to or from any other point in the city, shall be 15� for one passenger and 5¢ for each additional passenger. Zone Five shall consist of all territory lying east of Ohio Street and north of the Smoky Hill River, and extending to the east and north boundaries of Cloverleaf Addition, and the rate of fare from or to in any point in Zone Five, to or from any point in the City of Salina, shall be 20¢ for one or two passengers and 10¢ for each additional passenger* Section 5* That original Sections 3 and 4 of Ordinance No* 2948, Section 1 of Ordinance No. 3306 and Section 2 of Ordinance No. 4625 as amended by Section 1 of Ordinance No* 4633, be and the s ame are hereby repealed.
