AN ORDINANCE relating to and apportioning and levying special assess-
ments on certain lots and pieces of ground in the City of Salina
to pay the cost of curbing and guttering Custer Street from Craw- i
ford Avenue to Republic Avenue; Eleventh free rom- Frost Street
to Republic Avenue; Phillips Streetrom escott to Charles Street,*
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section le That for the purpose of paying for that part of the
cost of improvements of certain portions of certain streets as herein-
after set forth in the following sections of this ordinance which is
chargeable to the private property in the assessment districts for each
of such improvements, repseetively, as set forth in the following sec-
tions of this ordinance and which cost is hereby determined to be the
sums hereinafter set forth in the following sections of this ordinance

with respect to each of such 3xnprovements, there are hereby levied and
assessed on the property liable therefor, being all of the lots and pieces
i
of ground lying on either side of said streets so improved, respectively
i
to the middle of the block for the distance improved according to the
I
appraised valve of such lots and pieces of ground with respect 'to each
i
such improvement, without regard to the buildings or improvements there-
on, special assessments covering the cost of such work and improvements,
said special assessments being based on the special valuation and appraise-
ment of said lots and pieces of ground heretofore made by three disin-
terested appraisers appointed by the Board of Commissioners of the City
i
of Salina, Kansas, with respect to each such improvement, which said
appraisements are hereby referred to and made parts of this ordinance,
and the several amounts levied, apportioned and assessed against the j
lots and pieces of g round for each of such improvements, respectively,
for the puuposes aforesaid are hereby found and determined to be the
i
amounts set forth in the following sections of this ordinance with respect
to each of such improvements*

Custer Street from the south line of Crawford Avenue to the north lime
of Republic -Avenue which is chargeable against the private property i

Section 5. Said amounts levied, apportionedand assessed afore-
said shall be due and collectible in ten equal installments the
first becoming due with the taxes levied for the year 1937 and one
of said installments falling due each and every year thereafter until
all are paid, and all to be collected with interest as in this
ordinance provided; PROVIDED HOWEVER, that the owner of any piece
of property liable for any such assessment may redeem his property
from such liability by paying into the City Treasury the entire
amount chargeable against the same, as in this ordinance designated
at any time withing thirty days after the
publication of this ordin-
ance and before the issuance of the bonds of said city in payment
of the balance of the cost of said improvements, and the property
so paid on shall not thereafter be liable for any further assess-
ments for the cost of said improvements nor for any part of said
;ponds.
Section 6. There is hereby further levied and assessed against
each lot and piece of ground described in this ordinance four
percent interest per annum on all of said installments therein
mentioned from the date of the bonds which may be issued at the
end of thirty days as specified in the preceding section hereof,
as by law provided, to the time of collection of the last install -
went as provided by law, which said interest shall be collected
annually at the same time and in the same manner as said install-
ments are collected; and after the taking effect of this ordinance
it shall be the duty of the City Clerk of said city to annually at
the same time other taxes are certified and until all of said assess -
meets so apportioned and levied herein have been certified, to certify
to the County Clerk of saline County, Kansas, a full list of all
property liable to assessment and taxation for such work and im-
provement, except such property on which the special assessments
aforesaid have been paid in full as hereinbefore provided, together
with the respective amounts due on each of such lots and pieces of
ground, which amounts shall include the annual installments of such
special assessments together with the interest for one year at the
rate of 4 percent per annum on all unpaid balances of such assess-
ments at the beginning of each such year as aforesaid, and such
amounts so certified as herein provided for shall be placed upon
the tax roll by the County Clerk of Saline County, Kansas, and
collected as all other taxes are collected.
Section 7. This ordinance shall take effect and bein force
from and after its publication in the official city paper.

Sect_on 5. Said amounts levied, apportioned and assessed
a'oresaid shall be due and collectible in ten equal installments

after until all are paid, and all to be collected with interest as
in this ordinance provided; PROVIDED 1' OVJE`J??_, that the owner of

designated at any time within thirty days after the publication of

Section 6. There is hereby further levied and assessed
against each lot and piece of ground described in this ordinance

mentioned froir' the date of the bonds which r.1ay be issued at the end
o. thirty days as specified in the preceding section hereof, as by
law y-rovided, to the tine of collection of the last inda'.1 lment as
provided by law, which said interest shall be collected �u-nually
at the same tire and in the same manner as sai'I inst,allr-enis are
collected; and after the taking; effect cf tllis ordinance it shall
be the duty of the City Clerk of said city to annually at the same
t3 -me other taxes are certified and u -,-til all of said assecsments
so apportioned and levied herein have been cer''ified, to certify
to the County Clerk of Saltine County, Kansas, a full list of all
property liable to assessraent and taxation for such vii ark and im-
prover,ent, e --.:sept such property on which the special assessments
aforesaid have been paid in full as hereinbefore provided, together
z,ith t' -e respective amounts due on each of such lots and pieces of
ground, which amounts shall include the annul installments of such
special assessments together with the interest for one year at
the rate of 4 percent per annum on all unpaid balances of such
assessments at the beginning of each such year as afore.aid, and
such amounts so certified as herein provided for shall be placed
upon the tax roll by the County Clerk of Saline County, Kansas
and collected as all other taxes are collected.
Section 7. This ordinance shall ta' e effect and be in force
from and after its publication in the official city paper.
