districts in the City of Sall_na designated as Lateral Sanitary
Sevier Districts No. 15.4 and 174, providing for t'ie construction
of lateral sanitary sewers in such distracts and for t::, cost

Section 1. Lateral Sanitary_Sewer District No. 1501 That
there be and there is hereby created a lateral_ anitary sewer dis-
trict in the City of Salina which shall be designated as Lateral

AN ORDIT;ANCE creating and defining certain lateral sanitary sewer
districts in the City of _._Salina designated as La'-eral Sanitary
Sewer Districts No. 154 and -providing for the construction
of lateral sanitary sewers in such districts and for the cost
thereof and for the levying of special assessments against the
property in such districts for the payment of such cost, and

Section le Lateral Sanitary Sewer District No. 154. That
there be and there is hereby created a lateral sanitary sewer
district in the City of Salina which shall be designated as Lateral
Sanitary Sewer District No. 154, and which s1kall include all of
the following described property in the City of Salina, to -wit:

Section 3. Lateral Sanitary Sewer District No. l 4. That
there be and there is hereby created a lateral sanitary sewer dis-
trict in the City of Salina which shall be designated as Lateral
Sanitary Sewer District Noe 174, and which shall include all of
the following described property in the City of Salina, to -wit:
/Lots 1 to 14 inclusive in Block 8 in Leavenworth
Addition in Salina, Kansas. '
Section 4. That it is necessary and it is hereby ordered
that a late --"-al sanitary sewer with all necessary connections,
man#oles, flush tanks and other appurtenances be constructed
and built in and to serve said lateral sewer district No. 174
as created by Section 3 of this ordinance, along the following
described course, to -wit:
In the alley lying between and parallel with Olive
Street and Chicago Street beginning at an existing
manhole in the intersection of said alley and Uni-
versity Place; thence north in said alley 346.5 ft*
to a manhole to be constructed in said alley=eet
south of the south line of Marietta Street
Section 5. TLat the City Engineer shall on or before July ,
12, 1937, prepare and file in the office of the City Clerk plans
and specifications for the construction of Lateral Sanitary Sewers
provided for in the preceding sections of this ordinance which
shall be of proper character to serve the property 1-ying within
the districts within which such sewers are to be constructed and
shall on or before the same date prepare and submit to the Board
of Commissioners detailed estimates under oath of the cost thereof.
That thereafter the City Clerk scall advertise for three consecu-
tive days in the official city paper for sealed proposals for the
building and construction of such sewers according to such plans
and specifications, which proposals shall be filed with the City
Clerk on or before the time fixed in such. notice, at which time
the Board of Corunissioners may let a contract for the building
and construction of such sewers to the lowest and best res1,onsible
bidder-h-erefor, provided, that such bid shall not exceed the
estimated cost thereof and provided further that said Board shall
reserve the right to reject any or all such proposals.
Section 6. That for the cost of building and constructing
such sewers special assessments shall be made for the full cost
thereof, on all lots or pieces of land within said Lateral Sanitary
Sewer Districts, within which such sewer scall be built, according
to the appraised value thereof, without regard to the improvements
or buildings thereonp except such portion of such cost as may be
secured from ,V. P. A, or any governmental agency, and the City
Engineers City Mlanager, City Clerk and City Attorney of Salinas
and
Kansas, are hereby authorized Jt directed to make and execute
in behalf of said city all proper applications, reports or other
written instruments which may be requisite or necessary for the
purpose or securing contribution'of funds from the W. P. A. or
to be
any other governmental agency=94APE used for paying part of the
cost of such improvements.
Section '7. After the passage and publication of this ordin-
ance the Board of Commissioners shall appoint three disi,aterested
appraisers who after having taken an oath to make a true and in -
partial appraisement of all lots or pieces of land liable to taxa-
tion for the cost of such improvements, shall within five days
after having been notified of their appointment proceed to appraise
all of the lots or pieces of land within such districts liable to
assessment and taxation as aforesaid, without regard to the build-
ings or improvements thereon, and after slaking said appraisements
shall return the sane to the Board of Commissioners of said city
and said Board shall designate a time for holding a special meeting
of said Board br the purpose of hearing any con -,plaints that may
be made as to the value of any lot or y4ece of land appraised as
a�oresa- s of ^rhe ch special session due notice shall be .riven in
the official city papers and at which special session said Board
may alter any valuation of any lot or piece of land if, in their
opinion, the sariie has been appraised too high or too lovr. ,
Section S. The special assessments herein provided for may be
paid by the person liable therefor in ten approximately equal
annual installments but the owner of any property liable to such
assessment may within thirty days fror.! the date of deternining the
ar:iount assessed against his property pay the same in full and his
property shall not be liable for any assessment for the cost of such
improver:3ents, and bonds as hereinafter provided for shall be issued
for the amount of the assessments remaining unpaid at t, -e end of
thirty days fror,the time such assessment is fixed.
Section 9. For the purpose of paying for the work and
( improvements in this ordinance provided for, the Board of Com-
missioners are hereby authorized and directed to issue Improve-
ment Bonds of the City of Salina in an amount not to exceed the
cost of such improvements, or such part of such cost as ray be
in excess of any funds received from the 01. P. A. or any other
overnmental agency which may contribute to the cost of such
improvements and to run for a period of tdn years and be payable
in ten approxi ately equal annual inst-allments,, toc�e 4 ;her viith
interes not to exceed five per cent der annum, which bonds shall
be issued and payable according; to law; and for the purpose of
paying; the principal and interest on .said bonds as they severally
become due and payable the Board of Corunissioners shall apportion
and assess against the lots or pieces of land within the ta_:ing
districts of such improvements special assesszents covering the
cos} of the improvements constructed within or for such districts,
respect_ rely, as herein provided for, and the apporti onnent therein
con `aimed shall hold good for all of the installments that are to
be collected from the specific property chard eaj?le,Vith said improve-
menLs. Such assessment and appor;;ionment ordinance sl -al] contain
t�1e total amount of tax apportioned to such tract of land within
the taxin� district and shall state the rumuor of annual ins'-all-
ments in vrhich such tax is to be collected; and thereafter the City
Clerk -shall annually at the same time other taxes are certified,
certify to the County Clerk of saline Col-nty,Kansas a full list of
all property liable fog^ such work and improve,�ents, tog,' e with
the respective amounts due on each of said tracts of land, which
