4756 Annexation{Published in the Salina Journal. ORDII11ANCE NO. 47 6 w AN ORDINANCE providing that certain platted and unplatted tracts of land which adjoin the j present limits of the City of Salina be added to, taken into and made parts of the City of Salina; extending the limits of said city to include said added lands; defining the corporate limits of said city as extended; and repealing all ordinances and parts of ordinances in conflict with this ordinance. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Casa Loma Manor. That that certain platted tract of land lying in the northeast quarter of Section 11, Township 14 south, Range 3 west of the Sixth Principal Meridian in Saline County, Kansas known and platted as Casa Loma lUT Kansas, P anon according to the re- corded plat thereof in the office of Register of Deeds of Saline County, Kansas, the east and south boundary lines of which lie upon and touch the present boundary line of the City of Salina as hereto- fore established, be and the same is added to, taken into and made a part of the City of Salina, Kansas, Section 2. Part of Leavenworth Addition. That thatportion of a certain platted tract of land, to -wit, Leavenworth Addition, known as and including that part of Park No. 3, and that part of Block 11, and that part of Block 10, Leavenworth Addition, all lying west of the center of the channel of Dry Creek as originally existing and lying east of the center of the channel of the Dry Creek cut-off channel as now established, running north from the intersection of Walnut Street and Dry Creek, the westerly boundary line of which tracts lie upon or touch the present boundary line of the City of Salina as heretofore established, be and the same is hereby added to, taken in and made a part of the City of Salina, Kansas. Section�3. That that certain unplatted tract of land lying in the southwest quarter of Section 11, Township 14 south, Range 3 west of the Sixth Principal Meridian, Saline County, Kansas, described as follows: Commencing at the intersection of Dry Creek as originally existing and the center of the channel of the Dry Creek cut-off channel as now existing, being; the first such intersection north of the po-nt where the channel of Dry Creek crosses the main line right-of-way of the Union Pacific Railroad, and being adjacent to Block 10 in Chicago Addition; thence northeasterly along the center line of said Dry Creek cut-off channel as now established to the first intersection thereof with the center line of Dry Creek; thence up the center line of Dry Creek as originally existing to the point of beginning, which said tract of land is so situated that all of the easterly boundary line thereof lies upon or touches the present boundary line of said city as heretofore established, and which said tract of land does not 161 B exceed twenty acres in area, be and the same is hereby added to, taken into and made a part of the City of Salina, Kansas. Section 4. That that certain unplatted tract of land lying in the northeast quarter and the northwest quarter of Section 11, Township 14 i south, Range 3 West of the Sixth Principal Meridian, Saline County, E Kansas, and described as follows: Commencing at the point of intersection of the center l ne of Dry Creek as originally existing with the center line of said Section 11, running east and west, thence down the center of the original channel of Dry Creek to the intersection of the center line of said channel of Dry Creek with the west line of Whitredge Street in North Park i Addition; thence south along the west line of Whitredge Street to its intersection with the center line of said Section 11, running east and west, said line being in North Street; thence west along said line to the intersection of said line with the center line of Dry Creek, being the point of beginning, which said tract of land is so situated that all of the easterly and southerly boundaries thereof lie upon or touch the present boundary line of said city as heretofore established and which tract of land does not exceed twenty acres in area, be and the same is hereby added to, taken into and made a part of the City of Salina, Kansas. Section 5. That the corporate limits of the City of Salina, be and the same are hereby extended to include the territory added to, taken into and made parts of said city under the provisions of the preeedin�, sections of this ordinance, and that all of the land lying within the following described boundary be and the same is hereby declared to be within the corporate limits of said city and made a part of said city, and that such corporate limits be and the same are hereby d efined, as follows: Commencing at the point of intersection of the center of 14inth Street with the center of Cloud Avenue, being the corner common to Sections 23, 240 25 and 26, Township 14 south, Range 3 West of the Sixth Principal Meridian in Sali e County, Kansas;thence west along the south line of said Section 23 to the southwest corner of Evergreen Park Addition; thence north along the west line of Evergreen Park Addition to the north- west corner of said addition, such point being in the south line of Claflin Avenue as shown on the plat of Pleasant View Addition; thence west along the south line of Claflin Avenue as shown on the plat of Pleasant View Addition to the southwest corner of Pleasant View Addition; thence north along the west line of Pleasant View Addition to the north- west corner of said addition, said point being the southeast corner of Park View Addition; thence west al,ng the south line of Park View Addition the southwest corner of said addition; thence north along the west line of said addition to the south line of Jewell Avenue, being the northwest corner of said Park View Addition; thence west al�.ng the south line of Highland Court Addition to the so-I.:thwest corner of said addition; thence north along the west line of said addition to its intersection with the easterly line of the right-of-way of the Missouri Pacific Railroad Company; thence north along the east line of said railroad right-of-way to the poi.t of intersection of said line with the south line, produced east, of Walnut Grove Addition; thence west along said line to the southwest corner of said addition; thence north along the west line of said addition to the south line of Leavenworth Addition; being the center line of Walnut Street; thence west along the south line of Leavenworth Addition to the center line of Dry Creek; thence in a northerly direction down the center of said creek to the intersection of the center line of said creek with the center line of the channel of the Dry Creek cut-off channel as now established, being the first point of intersection of said lines lying north of Walnut Street; thence north along the center line of the channel of said Dry Creek cut-off channel as now established to its next intersection with the center line of Dry Creek as originally existing; thence down the center line of the channel of Dry Creek as originally existing to the point of intersection of said line with the center line of the channel of the Dry Creek cut-off channel as now established, being the first point of intersection of said lines lying north of the main line right-of-way of the Union Pacific Railroad and lying adjacent to Block 10 in Chicago Addition; thence northeasterly down the center line of the channel of the Dry Creek cut-off channel as now established to the next intersection of said line with the center line of Dry Creek; thence down the center line of Dry Creek as originally existing to its intersection with the west line of Pacific Addition, being the west lire of the northwest quarter of the northeast quarter of Section 11, Township 14, Range 3; thence north aling said line to the north line of said Section 11, thence east along said line in Pacific Avenue to the intersection of said line with the southwesterly line, extended southeasterly, of Lots 1, 3 and 5 of Block 32 in Military Addition; thence northeasterly along said line and along the west lines of Lots 7 and 9 of said Block 32, being the westerly boundary of said Block 32 in Military Addition, to the northwest corner of said Lot 9 in Block 32; thence due west 40 feet to a point; thence due north 132 feet to a po'.nt; thence due east 170 feet to east line of the alley in said Block 32; thence due north to the north line of Harsh Avenue in Military Addi- tion; thence east along the north line of Harsh Avenue to the west line of Twelfth Street in Military Addition; thence north al. -)ng the west line of Twelfth Street to the southwesterly line of the abandoned I railroad right-of-way running through said Military Addition; That all ordinances or parts of ordinances in conflict with the provisions of Section 3 of this ordinance be and the same are, insofar as they specifically conflict with any of the provisions of this ordinance, hereby repealed. Section 7. That ordinance No. 4749 passed on May 17, 19370 and which has not been published in the official paper and has not be- come effective be and the same is hereby repealed.
